It seems something is going on across the Board changes in routines etc I hear tey are Hiring new directors for all uscis Centers from postings here on this site, so something is up, and mostly a slowdown in any progress, Sorry to hear of Your ordeal Ours is getting approved bewtween IMBRA Becoming law, and IMBRA being put into effect, so instead of getting held at USCIS we got approved and sent to Guangzhou then, wait on this one, 3 Months for them to acknowledge receipt of our petition and then to get sent back to ???? Still trying since 7/20/06 to Find where it was sent. Guangzhou is just as bad, I was told 3 different dates in regard to our case and again no one knows what in Gods name is going on.

So We are back to ground zero as far as our petition goes, Hope You get Yours Located.

well here is my problem.. we are together for 4 years and married for 2.. we just found out we are pregnant and hubby decited not to be a part of this.. to make the story short i wont have an abortion and he wont be in his/her life.. so i am flying back home to germany to be with my family and to raise my child.. now my question is should we file for divorce now and take care of my visa.. which i should get in june 2007 (the 10 year one) but i dont even wanna have it anymore cuz i am not coming back.. and is there something i can do so he wont get my baby? i am just soooo darn scared that he comes to germany in a couple years and trys to steal my baby.. should we go to a lawyer that he writes his rights over to me? i dunno what to do? :help

Today when actually getting a live person on the PHone at USCIS, I inquired as to our Case and as to where is it ?

It was returned after 3 Months in Guangzhou China, and now after more time no response from either NVC or USCIS. When explaining the details to the customer service rep at USCIS, get this, He asked me what is IMBRA ? Do they actually hire ####### that are this stupid ? He did not know what IMBRA was,who processes it, or how to find information. I asked to speak to a supervisor, but he got back on in two minutes claiming the supervisor had the same answers as he did. Thank God no terrorists are trying in infiltrate our Country ! What a joke.

The DOS in DC told me the case was returned on July 1, but on July 5 I received an email from Guangzhou China that they had not received the file, Hey how can You return a file before You have even received it Duh !

well. to conclude my opinion that there are many incompetants working for USCIS, NVC and the Guangzhou embassy, I wonder why my Fiance is unhappy as she has not received one scrap of paper since we applies back in April. and wonder how these people can even sleep at night making all of uswait for unconsionable amounts of time.

To all of You Out there that have had the Consulate Fiancee's Interveiw. I have heard of instances where the Visa was denied due to Poor ability of speaking and understanding English.

I have heard of this in Guangzhou China in particular but some may have experienced this in any consulate.

Would Love to hear of any problems due to language.

I must say that My Parents came to the USA from Europe many years ago, Not speaking any English and did not have a problem with Immigration, But we all know things do change.

Then at Your liesure at not rushed plan a nice wedding at Your liesure, note You can still use the same license as You allready got married here, Just do so in the same jurisdiction as where You did the first marriage.

My fiancee has sent thus far 2 packages to the US Consulate in Guangzhou, China. One package arrived at the Little White Goose Hotel on July 29, 2006, the other arrived again at the Little White Goose Hotel on August 19, 2006. I have emailed the US Consulate's Office on several occassions, each time the reply back was that they never received the packages. Just today I have paid for my fiancee to place a phone call to them, the cost is $6.75, very reasonable for peace of mind. They informed her that they didn't receive the packages but gave her a fax number to fax the biological form needed for her/our daughters interview. This is for a K1 Fiancee Visa.

Has anyone else encountered problems with the hotel there giving the packages/mail to the US Consulate? This is very aggrevating as my fiancee is having to take time away from work each time she has to send out the package.

Just noted Your question on Guangzhou and their response in regard to mailings.

Our experience has been that when we emailed in response to never hearing anything, They obviously just send a routine email "WITH OUT Checking Anything" Again after 3 + Months of waiting to hear that they "Received our Case File. They told me this time that They still have not received, Note this email was

on July 5, 2006 after another few weeks I telephoned the Department of state in washington DC to ask what is possible going on there, They looked it up and told me that the file was received and sent back to USCIS on july 1, 2006. When I asked about the july 5 date email the guy was baffled and I told him this is why I called, Nobody in Guangzhou seems to really know what is going on, and Perhaps just does not care what goes on there. Now the latest, They have sent back the case file on July 1, 2006 Fine,but where is it ? No change of online status, No RFE Hmmm Me thinks no one there is competant !

I am sure that when I do finally get the RFE and return it, it will sit in USCIS for 60 days before the long road to china and sitting there again for 3-4 months before my Fiance may receive her P-3 Package,

I might be worrying too much, but I just want to make sure everything goes smoothly when he goes for his interview.

So, I'm wondering, my fiance has never been married before, but how can he prove that he's single? I know you can prove you're married because you have your mariage license/certificate. But if you're single? Will they go by what his passport says?

My fiance is actually a Paraguayan citizen with Argentine residency, so his papers are all from Paraguay. Almost nothing is computarized in most third world countries such as Paraguay, so you can lie about anything and everything such as marital status. I love Paraguay, but trying to do something legally is almost imposible!

Ok, to make this short, how can he prove that he's single? Do they just go with their gut instincts and trust what the passport says? I'm afraid they'll say someting like "yeah, you're single? Can you prove it?"

You write up a sworn Statement and have it signed and witnessed by a Notary or an official office there in Your Country, Dept of state or something like that

statement should say who he is where he lives and that he swears he has never been married. Simple, done, get to the Embassy with it !

I can understand the frustration people feel about how this law has been implemented and the impact it has had on their current petitions. That said, I think the new limits on K1 petition filings make very good sense.

I've read posts in the past on VJ that sound like some people see the K visa process like shopping for something at the mall. If it doesn't work out with this one, no problem. I'll just go shopping for another one. People say they should be able to marry anyone they want, however many times they want, and the government shouldn't interfere. What they don't take into account is that when a US Citizen marries a foreign national, they are putting that person on the fast track to Citizenship. Bringing a fiancée to the US is a privilege and the government has a valid interest in ensuring that our immigration system is not abused.

Why shouldn't there be a limit on the number of petitions you can file? If a petitioner knows that their number of K petitions is limited, I would think it would be incentive to be extra careful, especially the second time around.

What is so unreasonable about having to wait two years after having the first K1 approved before applying for a second? If you get burned the first time around, why be so anxious to rush in the second time. This restriction allows time for some soul searching and reflection. This may not have been the purpose of the law, but it is a good side effect in my humble opinion.

I'm looking for information on petitions that were sent back to the USCIS from a foreign embassy by mistake. The consulate in Naples recieved my petition last week, saw the priority date of April 24th, and sent it straight back to the US! Nevermind the fact that my petition already included the IMBRA related evidence and therefore should not have been sent back. Has this happened to anyone else? Also, is there anyone who can give me some advice on how to get my petition back on track?! It was sent from Naples on the 20th of July, NVC still has no record of recieving it.

You mentioned the Date of April 24 th, well USCIS did not yet have IMBRA Compliant forms until the end of June, Therefore in the eyes of Our ever inefficient Government, You are not IMBRA Compliant, whether You sent the Info or Not. Hate to be the bringer of bad news,

Gee, let me see, 3 months and they haven't received it, Now when They finally do, they got to send it back to Vermont. and then RFE me, return it and send it back to wait 3 months again for them to receive it. wonder if My Lady will receive her p3 this year ?

Their Email states due to Mail transit times and Customs processing, it may take two to three months to Receive the File ! Hey better feed the Pony Express, They are starting to slow down. Customs ? for Diplomatic mail ? Hmmm Thats a new one

Anyhow, in Checking today with USCIS they respond to my question of IMBRA, that if I am approved that I am approved. OK, then why is everyone getting the RFE's right.

I asked If I can send IMBRA Info to USCIS and they say not without an RFE so, Now I must wait for China to find MY File and officially receive it, only then to mail it back for IMBRA info right ?

Then to wait again 3-4 months for china to receive my file again and by Christmas perhaps my Fiance may finally get her DS-230. Talk about the most inefficient agency out there, DOS Wins hands Down

-Proof of residence. I thought driver liscense could work for that. Or does a special form or certificate excist for this?

-Certificate of nationality. You can get this at a USCIS office?

Certificate of marital status. Where to get this one?

As for ASingle status Papers, Here is How to do it,

He must Type up a Document with all personal address info Etc. Stating he has been divorced on ____ Date of the recording of the Divorce, He must sign thi in Front of a Notary, and then, Going to the County Clerk in the County of His Residence He must get Certification again, Yeah, I KNow,,,, But You are not done yet !

Now You must take all this to the LOcal office of His State of residence Department of state for final Certification. This is not US Department of state, but the State of HIs residence.

Be sure to bring proper Identification such as a valid Driver License, Better yet his current Passport.

Now, You may also need translation into another Language after all this, Well, I think You get the Idead Now.

Hello everybody,

I need some help putting together my package here.

First of all, on both the I-129F and the G-325A there is a spot that states that if your fiance's native alphabet uses other than Roman letters, write her name in the native alphabet. However, my fiance is Chinese and I don't know how to write Chinese. Is this part necessary? How would I comply with this?

Second question, I'm confused as what I am actually submitting to USCIS. Do I submit ORIGINALS of everything or Photocopies of everything to them. (except pictures ofcourse) The reason I ask is because my fiance is in China and even to get orginal signatures is a burden.

Went thru the same thing, Had to fedex the 129F and 325A to her, Luckily there was a nearby fedex office in her part of China, Then she Fedexed the package back. Don't worry, It's only time ! Yeah Right, We started in March and now in Limbo for 2 1/2 MOnths, waiting probably to get a return of petition and IMBRA'd

only to start again, as it's been said before, Any Day Now,,,, Any Day Now !

I am new to this site, but have noticed many times the mention of "Touched"

I have not seen anywhere that this is mentioned in INS, NVC or DOS Sites Can anyone PLEASE Explain this to me, I know we can all have a quick laugh and say we will feel "Touched" in the head before finishing this process, but It would be nice to hear some explaination of the use of the term and where everyone has been finding this.
