  1. Sorry I'm traveling and on my phone so I can't read everything you posted.

    Bottom line is that for k1 you will use the i134. If you need a joint sponsor, the person will also fill the i134. Both of you will need supporting documents as well, which I listed before.

    When the immigrant gets here, after marriage, when filling for aos, the form needed will be the i864. Same thing, if you have a sponsor, they will fill a i864 as well. The i864a is for household members, which I believe can only be used if you and the sponsor live together and/ or claim each other on your returns.

    Focus on your k1 step now and go prepare your i134 package! If your Brazilian partner needs help or tips, I can also speak Portuguese.

    First off, obrigado!! That is so sweet and kind of you to offer her. She speaks english very well, but sometimes things get lost in translation for anyone, so again thank you for reaching out with that. As someone else posted and now you just said, it's great to learn this about the joint sponsor inquiry I started. I don't know that I have much else to ask regarding it though I am sure something can come up. I'm grateful I can use my Father. I just am nervous about how it looks on me to the interviewer that I'm 29 years old and unable to provide for her right off the bat (Meaning I shouldn't be using a joint sponsor in their minds).

    I do live with him, but he doesn't include me on any tax forms (to my knowledge) so I'm still a bit unsure whether or not we include the attachment 864A with the 864. I'm sure we'll learn more over time as it isn't required right now. I just need to get her biographic information, letter of intent, passport photos, and any other miscellaneous stuff she wants to include and then I'm up to bat.

  2. Where is the beneficiary from?

    Rules on accepting the I-134 can vary from embassy to embassy, from what I understand. If your beneficiary is from a low-risk country however, it's likely accepted. (Edit: Sorry, I see you said Brazil. I was looking for a linked timeline. I really don't know what risk level Brazil is viewed as; I recommend you look up what Packet 3 and 4 entail for Brazil for post-NOA2 processes.) Assuming that:

    1) Beneficiary needs to take proof of financial support to the interview in the form of an I-134. If the petitioner cannot meet the requirements of the I-134 alone, enlist a joint sponsor. The joint sponsor ALSO fills out an I-134 and both parties have to submit their supporting documentation (tax transcripts, etc) as proof of income. Unless your embassy requests it, don't mail this. You do not need the I-864 yet.

    2) Assuming approval - your beneficiary moves to the US. Get married.

    3) When filling out adjustment of status (AOS) post-marriage, you will need to submit the I-864 with that package, as that's the one used for spousal applications. You don't need the I-134 again at this point. If your income still isn't enough at this point to sponsor alone, you will again need a joint sponsor to also fill out a separate I-864 with all supporting documentation.

    As for the 864A regarding household members, I hope someone else can chime in. Our joint sponsor is not a household member so I'm unsure personally how this works.

    Hope that helps clear it up a little. I know, this whole process is very confusing and rife with contradictory information :)

    Thank you so much for your response. We have done research and don't see Brasil popping up muchly for being a high risk country.

    It's something so easy to get anxious about. We will be together for a year this September so if we get everything to go the way we are hoping, we'll shred this distance apart and be together hopefully next summer/very early fall (Near our two year anniv). Neither of us have degrees. We are 29. I don't have any debt here. No good credit score (no bad either-Just got my 1st CC a few months back to start establishing credit).

    Care to elaborate on "Packet 3 and 4" ? Not FOR Brasil, but what do they entail. On number one, thank you for that detailed description. Her and I have been wracking our brains over the 864 and 864A. We get it now. Until she gets here and we are married, the 864 and 864A wait. The I-134 DOES travel to her for when she goes to her interview in Rio.

    I have looked into it. Is it difficult to get all the proper forms for the I-134? Doesn't seem too difficult, but thought I'd ask. Assuming approval part (#2), that's another one we get on. My plan is I am going to the interview no matter what. If I have a job and they won't allow me the time off, that's where I am stuck. She says she has no issue with going alone, but it's THE interview, you know? I'd love to be there with her when she finds out that she (hopefully!!) gets the K1. What a moment to share with her, you know? I want to be with her there too though when she officially moves here. Anyway, off topic. My question is what would you do in the position I put. Would you quit the job and go? If so, would that influence them at the embassy for the interview? I imagine it could. We've researched so much about the interview. It seems so intimidating, but we've read a good few where it wasn't as bad as people built it up to be.

    On the filing out the 864, are you saying I could use my father as a joint sponsor on the 134 and then after she moves here and we get married, I could just decide not to use him again? Wouldn't that be odd since I had just used him on the 134? Wasn't sure if that could cause issues.

    On the 864A, don't worry about it but thank you for your honesty. We assume that we'll do it, but as you noted before, the 864 doesn't get done until we are married and she's here. After that, the "A" goes as an attachment to the 864.

    The entire process can just be so daunting. I've lived out in CA for a few years with roommates and then I moved back to OH. I then decided to go out to CA one more time and then came back. I have never lived on my own technically without others ever. Never lived outside my Dads house IN Ohio. I wonder how many things are truly an issue because I overthink and overanalyze soooooo much about this process. When she moves here, there is no doubt we will be able to find a cheap place to live on our own and be fine. We also figure we can live with my Dad for some time since she won't be able to work for six months and that'll give me even more time to save up money.

    What is the difference between the I-864 Affidavit of Support and the I-134 Affidavit of Support?

    The major difference between these two documents is the fact that an I-864 is filed in connection with an immigrant spouse visa application and an I-134 is filed in connection with a non-immigrant dual intent fiancee visa application (commonly referred to a K1 visa application). The legal effect of an I-864 affidavit of support is slightly different from that of an I-134 affidavit of support as the I-864 is more enforceable against the American sponsor. That being said, the I-134's usage is technically by discretion of the Consular Post and acts merely as a means of providing a streamlined way of adjudicating multiple parties abilities to support foreign fiances. In the past, it was more common to see many Consulates accepting I-134 joint-sponsorship, but this trend seems to be receding as more Consulates now ask that the US Citizen sponsor show an ability to independently support a foreign fiancee thereby precluding the use of joint sponsorship affidavits in K1 visa matters. This is a recent trend as in the past there were Posts which were allowing this practice, but there are good policy reasons why I-134 joint sponsorship affidavits are in decline.

    Keeping in mind that I-134 affidavits are not legally binding, a US Citizen Petitioner could enlist the help of a friend or family member to act as a joint-sponsor on the I-134 affidavit of support for a foreign fiance. After arriving in the USA, the foreign fiance and the American Petitioner get married. Subsequent to the marriage, they file for the foreign spouse's adjustment of status. At the adjustment of status phase, the American Petitioner must file an I-864 affidavit of support, but the original I-134 joint sponsor decides not to act as sponsor on the I-864 affidavit. The I-134 is not enforceable against the original I-134 joint sponsor and if the American petitioner cannot show requisite assets it places the Immigration authorities in a position where they may need to find that the foreign spouse could become a "Public Charge" is allowed to remain in the USA. This scenario leaves all parties in a relatively negative position. Therefore, it is this author's opinion that I-134 joint sponsorship is being phased out in order to make certain that those sponsoring non-immigrant fiancees for a visa to the US can meet their obligations with regard to a future I-864 affidavit.

    After reading all of that, my fiance and I are still just as confused as before. I am not working right now. I will be here soon. When she moves here, I will have a job in place, but my Dad will be needed by us as a joint sponsor. Some stories I've read showed some folk filling out the 864 AFTER the fiance/spouse would arrive. I am being told otherwise and again this leaves me completely distraught.

    For a K1 Visa, the I-129F is sent with a G-325A. That's all I've found on this site and other sites. When the process moves along and she has to prepare for the interview, this is where the joint sponsorship kicks in according to this and various other forums. I'm then onto wondering which ones are filled out by who. Do my Dad and I both do the 134? Do we also both do an 864 and 864A? I posted earlier too that it said make sure the person submitting the form meets the definition of a joint sponsor and not the definition of a household member.

    REALLY hoping I get some more feedback on all of this as this seems to be where a lot more information is required and it is delicate information. It seems when my fiance would officially move here and we do the adjustment of status, the joint sponsorship can change? I don't know. I would be working and likely able to support her, but yeah...

    That confuses me terribly. My father is going to be our joint sponsor, but I live with him so he's technically a household member. It also tells me to use all capital letters when filling out the forms and I've been advised on here not to do that. This is what causes me to go into a tailspin about all of this because I read different things everywhere. :-( It really creates anxiety.

    I get all of these forms go to the interview I believe. And the more I'm looking into this, all three forms should be submitted. I am trying to figure out if both of us do certain ones or if it's just my father on some.

    That helps but still leaves me a bit confused. I have two other forms I've heard different things about that he may have to fill out and I'm not sure if I do as well. There is the I-864 and the I-864A. The 864 is also an affidavit of support and the latter is a contract between Sponsor and Household member. I assume we both fill out that.

    I haven't dove into the affidavit of supports fully with him yet, but do they list within there that he needs to include what you just listed? If not, where are you finding this information for what's required for him because the joint sponsor is honestly one of the last (I think) most confusing parts of this process for me because I will NEED to use him.

    The other question too is what are all the forms do I NEED my Joint sponsor to complete? The ones I have noted as what's required (I think) are the following: Form I-134 (Affidavit for Support), Form I-864 (Affidavit of Support), and Form I-864A (Contract between Sponsor and Household member).

    I get these forms do NOT travel with the I-129F package, but I could still have my father looking at this and taking care of it while I wait for her documents to get here.

  8. I've been curious with this one as well. USA here and fiance is in Brasil. We've been together (officially dating) for about a year. Within the year, we've visited each other once. Her here for Christmas & New Years (21 days) and me in Brasil recently for 44 days. When we aren't together in person, we are CONSTANTLY on Skype/Facetime for video and of course texting when we can (We talk everyday. Never once had a day go by I believe where we didn't talk). I've seen videos of people going crazy with the i-129F package in what they include.

    My question is this. We brain farted on one part of our trip because it was our first meeting. We didn't know about the k1 process yet, but when she was here, we didn't get any photos with her and my family/friends. Plenty of photos of her here in Ohio and with me, but didn't snap any of us with family. It was just so early on still. I got plenty of photos with me, her, and her family and friends in Brasil.

    Does her not having any with my family hurt our process?

  9. Hello all! My fiance is getting ready to send me her documents so that I can start and then finalize the package to send out to officially start the process.

    I've talked with others and I'm pretty sure I have everything (I go all over this site to make sure but I know some of this goes over my head so I appreciate any looking out for something I may have missed).

    She (Brasil) Me (US). She needs to send me the following:

    Letter of Intent to marry - Which needs signed and dated in ink. My question for this is, Does she need to date it there or can I date it here for her? Will the date at all affect the process for any reason due to it being signed and dated some time before the processing center would receive it? Doesn't seem like an issue, but I would like to hear thoughts. Also (and important question), does she need to get this notarized at all for any reason? I didn't catch this anywhere for the letter of intent, but it can't hurt to ask.

    Passport Photos - They are to be labeled with her name, date of the photo on the back, and then placed into a plastic bag. Any notarizing for these for any reason? No signatures on the photos at all?

    G-325A - Biographic information. The passport photos are attached to this form, correct? one more time, any notarization for this document required?

    And that's it. She will be sending this stuff this week to me so I want to make sure we have EVERYTHING covered. If I have missed anything, please let me know. I don't believe I need her birth certifcate or anything of that nature.

    We are just doing the K-1 visa/I-129F package and for her to come here to the States to live here. :-) Can't wait to officially send this in so we can actually put something down on our timeline and enjoy/freak out as time passes by and all of us see our statuses change hoping for that one day to come..

  10. I meant if it's asking a state for her address and the only options are states in the USA, you should leave it blank. (She is foreign, therefore she doesn't live in a US state)

    Not required for you to send her a copy of the package, but I strongly suggest you scan everything and put it on the cloud where both of you can look at the documents for future reference.

  11. I can't answer everything on this topic as I'm working on my sponsor papers while waiting for NOA2 right now - but the sponsorship stuff doesn't come into play with your initial filing of I-129F. That information will be needed by the beneficiary when it comes time for the interview :)

    Edit: maybe other countries need it submitted before the interview, I'm not sure. At the least it's safe to say sponsor information is not needed until USCIS is done with your initial application, and the NVC forwards the approved case to your embassy. After that the process can be a little different depending on the particular embassy.

    Thank you very much. First off, good luck to you and your special someone with the process. I can't wait to be in the waiting phase. I'm in the phase of putting together everything for the i-129f and as I said in my welcome letter, I tend to overthink things as well as having anxiety with all the different terms and wordings. They can be intimidating.

    I believe I have everything correct as far as what goes to the lockbox to start the i-129F.

    The I-129F form of course, G-325a that her and I both fill out separate forms and sign (with passport photos with them), G-1145 for notification, and that's it. Before I was under the impression the I-134 and I-864 (A as well) went WITH the I-129f package, but it seems to be the other way around. It goes after and it goes to my fiance.

    The biggest things I need from her then are a letter of intent to marry me (signed and dated), passport photos (as I said up above), and the form for biographic information.

    Is there anything that comes to anyone's mind on what else I absolutely need from her before I sent in the i-129f?

  12. If there isn't enough space to type, try printing the form and fitting what's left writing it down. If still there isn't enough space, you attach a supplement page.

    Which question is asking for her state? I believe you have to leave it blank for her, but can't be sure without knowing which item is it

    Sounds good. And for the example forms I've seen, it looks like state is left blank. It was for the section for her address and etc. I'm confused though by you saying leave it blank for her. This doesn't get mailed to her. This goes to the Lockbox in Dallas. I know I can and will (required?) mail her the same exact package for her records.

  13. Hello everyone. I just joined this site the other day and thank you all again to those that welcomed me here.

    As my fiance and I begin to pile up our notes and documents for the starting of filling out the I-129F forms, I have a question for those with experiences (good and bad) with using a joint sponsor to help your special someone move. I am from the USA and she is from Brasil. I have NOT seen anything much that goes against the grain of it working for us, but hearing personal experiences (and tips) would be very much appreciated. I live with my father right now and I am unemployed at the moment. Even when I obtain a job, I will not even be close to the poverty line needed.

    I believe I caught somewhere that regardless of my income, the one that will matter the most is my father's and it will not be able to combine with mine. I believe they will still factor in my financial situation and etc., but it's my Dad and Dad alone that will be the big one (or I'm wrong here). I have looked and I thought I saw that to use a joint sponsor in this case, I have to be living with him (which I am). I was trying to obtain a job and then a place so that when she moves here, we wouldn't have to shack up under my Father's roof for too long; however, if I am unable to use him as a joint sponsor, then I'll wait until she gets here.

    The other question too is what are all the forms you NEED for a joint sponsor? The ones I have noted as what's required (I think) are the following: Form I-134 (Affidavit for Support), Form I-864 (Affidavit of Support), and Form I-864A (Contract between Sponsor and Household member).

    I believe BOTH my father and I will fill out all of these each or at least a few. The first one came across (and from what I gathered online) as only me filling it out. The 864 (second one listed) was for both of us to fill out (or just my Dad?) and then 864A is strictly for my Dad and I (as it seems to state in the title of the document). The joint sponsor is very very crucial to us and honestly if for some reason it falls through, then we are definitely going to be forced to push back our goal (Her moving here next summer).

  14. Hello everyone. Thank you for taking the time to enter this topic and learn a bit about me. My fiance introduced me to this website and it's been our best friend. Today is my turn to integrate myself more into this site and I hope to connect with some of you to help each other out with our processes and journeys we are all embarking on (or for many of you, have already embarked on and are completed...lucky duckies)

    Long story short. I am from the United States of America and my better half is from Brasil. We are aiming to move her here permanently next summer (Summer of 2017). We are fairly aware (her more than me) about the process we have to go through, though I am a bit more intimidated by the bureaucratic stuff occasionally. We are going for the K-1 Visa for her. I am aware of other forms required such as: G-325A (Biographic info which I believe we both do), G-1145 (optional e-notif), and then the following three forms which are a doozy for me to get down.

    I am currently unemployed, though a job will happen soon. I am assuming I will not make the required amount needed to act as a sponsor for her, so we've known for some time we'd likely need a cosponsor/joint sponsor. Enter forms I-134, I-864, and I-864A. I am planning on using my father (whom I live with) as our joint sponsor as I live with him. I am under the idea that him and I both fill out all 3 of the latter forms or some of them.

    We are entering our one year anniversary soon and have visited each other once. Everyday we spend time on skype and it's been that way for quite some time other than our trips to be with each other in person. We want to kill this distance permanently. Being away from each other is downright rotten and I am the one who needs to take the lead with this area of our process since I am the petitioner (correct?). Now enters my anxiety. I have already bookmarked a section within this site that is a K1 Guide that breaks down step by step what is needed in the I-129F packet. A good chunk is self explanatory, though some things tend to go over my head.

    So here I am writing a super short introduction to get acclimated to this site. She has been a tremendous help with this entire thing and has carried me a bit more than needed due to my anxiety. It's time for me to step up and start picking away at this process so I can get this packet sent in and on to the next stage of this boss battle (as we call this distance). I'm sure I'll have plenty of questions, but I am just hoping to hear some responses to this so that I can perhaps get to know some of you who are going through the similar process and perhaps we can bounce off one another with our experiences to help each other out.

    So far today I've added the forms (PDFs) that I need for the I-129F and some other tips and tricks I've caught along the way in what to do and what not to do. (Using binders, not using binders, what to wear to the interview, you name it). I have heard some stories that can scare me a bit (stupid anxiety) with the joint sponsor and how they can negatively affect the process (I've read as well that they don't).

    Anywho, that's my ramble. I'm grateful grateful GRATEFUL this website exists and can't begin to thank everyone enough for participating to keep it alive as well as to those who run this page. Hope to touch base with some of you soon and please feel free to ask me any questions.
