    It's been a while since I've posted and I'm in need of your valuable wisdom again!!

    I am filling out the I-864 for my husband for his I-485 and I'm a bit confused about something. Last year I didn't meet the poverty guideline because I was out of the country with my husband (waiting for that whole K-3 fiasco to get sorted out). I now have a full-time job and make over the poverty guidelines but that isn't reflected in my tax returns because obviously I haven't filed my 2007 yet. I have 8 months of paystubs to prove that I make enough but is that sufficient proof for USCIS? Are they going to look at just my tax returns and automatically reject my application?

    Thanks for the reply. It stinks that we have to wait for the I-130 but like you suggested, I'll have the AOS form ready to go and hopefully jump start the process that way. Thanks again!

    My husband also came on the K3. Good thing too beause his I130 took 17 months in Nebraska for approval.

    It is true, you need to wait til you have the NOA2 from the I130 before you can file for AOS. When the 2 year visa is nearing expiration, you can file for an extension if the I130 is not approved yet. Be patient, you should see an approval soon. Have the packet ready to file to save time when the NOA2 arrives.

    I was talking to my congresswoman's liason about AOS for my husband and she told me that we can't apply for it until the I-130 petition is approved. Is this true? My husband came in on a K-3 visa in October. We applied for the I-130 back in March and have not been touched since March 24th. I call and they say that we're still not outside of the processing times so I don't see this petition being approved anytime soon. If we apply for AOS after this petition is approved we are just delaying the green card even more. This is so frustrating. In every step our plans have been delayed. Can't someone give us a break already!! Please, someone enlighten us. Is this true or can we submit the AOS now and get one step ahead of the game?

    I have filled out my husband's EAD paperwork, but haven't done the AOS yet. I know that you can submit the two concurrently but I'm still waiting for some documents that need to go with the AOS that we don't need for the EAD so I'd just like to send out the EAD right away. If I send them separately does that cause any delays? Have people found that sending the EAD concurrently with the AOS gets an approval faster or is there no difference at all?

    Hi malie. Sorry to respond to your questions a couple days late.

    I was on a tourist visa while in Venezuela. The Onidex had closed all visa changes so I couldn't get a visa that would allow me to work or become a resident even though being married to a Venezuelan it was my right. This probably isn't the case in many other countries. If I had been able to change my visa status I could have DCFed which I would recommend if anyone has the opportunity to use that.

    Since I wasn't able to work my funds were very very low, but my dad was kind enough to offer to be my joint sponsor so we had no problem.

    As far as the interview they only asked my husband where we got married and what he had been doing for work. I think the fact that I was there for the past 8 months was proof enough that we had a valid relationship so they just checked paperwork and that was it. They didn't even ask to see any pictures.

  6. Hi everyone!!

    My husband's K-3 visa was approved today at the embassy in Caracas!!! We are sooooo excited!!!! We pick up the visa tomorrow morning and fly out late tomorrow afternoon!!

    It was really quite painless. We had our appt for 8:30 in the morning but were there by 6:30. As soon as we went in I went racing for a number and we waited maybe half an hour. The only thing that took a long time was when we had to pay for the visa because the systems were down for about an hour and a half.

    I also have to add that the immigration officer was really really nice and she has been very helpful through the entire process. I've constantly been in contact with the embassy because of all the delays we ran into and it was thanks to her that we were able to get an appointment before my Venezuelan expired (which is on Monday).

    Thanks to all the VJers for their support!!! I hope that everyone gets quick and easy approvals!!!

    Mew is right. It will probably be a problem that your name doesn't appear on your birth certificate. I believe, and please someone correct me if I'm wrong, that on the instructions for the I-130 there is a list of other documents you can provide if you are unable to provide a birth certificate. Baptismal certificate comes to mind although I know there are a couple of other options.

    In my country, we name the baby after he/she is born. That's why normally there isn't a name on the birth certificate. Can I use the Identity Page on my passport instead? It has my date of birth as well as the birth place.

    Where are you from? There are other forums on this site especially for different regions of the world. You might want to post this question on one of those forums. I'm sure that someone else from your country has had the same problem and can probably offer some suggestions! Good luck!

    I took the poll and am interested in seeing the results. However, how do you account for US citizens born outside of the US but who marry someone from a country different than where they were born? For example, I was born in Germany but am a USC from birth through my dad and moved back to the US when I was five, but married someone from Venezuela. That fits into a different category all together right? If you change the poll question to include naturalized then I no longer fit into that category. I'm probably just complicating this more than you'd like but wanted to give you that information so that you have the most accurate results.

  10. I would personally recommend that when you do decide to move to the US that you apply for your husband's immigrant visa through DCF. This way you file just a couple of months before you anticipate you will be moving and when he enters the US your husband is able to apply for an SSN and work right away. If he enters on a K-3 and then you adjust status he will be in the US without an SSN or permission to work until he receives his EAD (which takes approximately 3 months) or his green card, whichever comes first. This means no drivers license for most states as well. Just my recommendation! Best of luck to you!!

  11. Michaela_Hassan, check your USCIS account and see if it has been touched after your NOA2 approval date. This is usually when it has left the hands of USCIS and been sent to NVC. However, don't freak out if you call NVC and they tell you they haven't received it yet because it takes a while for them to get it into their system (2-8 weeks for some people, just a couple of days for others). Good luck and congratulations on your approval!!

  13. Thanks everyone!! We were cutting it very very close here because my Venezuelan visa expires the 9th and I can't get it renewed, so lets hope that my husband gets his visa the next day so we can fly out together!!

    My husband has his interview on October 5th in Caracas. I was just wanted to take a quick poll and see how long it has taken between the interview to getting the K-3 visa in hand. We're trying to get an estimate on when we'll be traveling to the states and just how long we'll be spending in Caracas. Any chance that we could get it the same day or the next?

    I'm so excited because my husband has an interview date for his K-3 visa on Oct. 5th! My question is how long after the interview do you get the visa in hand? I am with him in Venezuela right now, but we have to travel quite a distance to get to the embassy and I'd like to know so that we can at least estimate how long we'll have to stay in Caracas and when we might be flying out. Any chance that we could get it the same day or the next?

    Your inquiry indicates that the approved petition has been forwarded to the National Visa Center (NVC) for processing. The NVC has not yet received this petition from CIS (Citizenship and Immigration Services).

    Check your USCIS account and see if you had a touch after your approval date. Normally that indicates that it has been sent by the Service Center. Once you see that it is at the NVC, it just means that they haven't entered it in the system. I was approved on August 31st, had a touch on September 2nd and received the same response you did until it was entered into the NVC system on September 14th. Try giving them a call and see if it hasn't been entered yet. Good luck!
