  1. My husband and I went went through the K-1 process and he now has his green card. A friend of mine asked wether her and her fiance could do the same. Her situation is really different from mine, she is engaged to a guy who was caught illegaly crossing the border using a fake or stolen passport. He was on his way to marry my friend here in Arizona. He was encarcerated for two months and then deported for 5 years. I believe he signed a document to deport himself instead of facing more prison time. Is it possible for him to still apply for a visa later on once they are married? She wants to marry him in Mexico then apply for a visa for him to come to the States. I believe she has a "lawyer" helping her out, but with all the fraud going on these days, I am afraid that she is giving her false hopes. If anyone has any imput please help!

  2. Hey - I wonder if anyone could help me? - Its a trivial question - but its annoying me!!

    I signed up for the on-line 'case watching' with USCIS - and got notified of my NOA1's for AOS and EAD.

    Since then, there have been no 'Touches' on these cases - although i received my Biometrics appt letter in the post.

    I attended my biometrics in December - and last week received another letter giving me my AOS interview date (March).

    My question is - shouldnt my on-line USCIS files have showed some 'touches' by now? - or been updated to show my interview date??

    Also, will they deal with the EAD application at that interview also - or are they treated as 2 seperate things??

    I've never been touched besides a RFE back in December, we did our Biometrics late in Dec. and we were approved yesterday. Maybe we just dont have that "touch" luck, but it doesn't mean no one is working on your case. I had the same thing happend to me and look we're already recieving our green card very soon. Oh and as far as the EAD, it doesnt have anything to with the interview (thats what the lady at immigration told me) She said it will be useless once we get our GC, she said many people dont even file for it, cuase they are getting cases processed even before EAD are mailed out. So good luck hope this helps.

  3. My husband and I had the "initial interview" yesterday afternoon. It was at 2:00 pm and we arrived there at 1:30 but weren't seen till 3:00pm. The interview was taped and we were sworn in to tell the whole truth and nothing but the truth. Anyway I was able to translate for him, which was great. My husband was asked his date of birth, address (which he forgot, cause he was nervous), mothers and fathers name-Just the basics. Then he was asked all these other questions like has he ever been convicted of a felony, smuggled drugs/people, used illegal documents, had government assistance for example welfare (he asked "what is that?"-which oviosly meant NO, very funny lol), or if he ever claimed to be a US citizen, all of which he said no. Then she asked if we had any additional evidence to add to our file, and I showed our supporting evidence like pictures, bills, accounts etc (By the way-make copies of these). Then she asked how or where we met. And then asked if I knew what conditional residence meant, and i said yes. She printed off a letter stating that my husband was granted conditional residence as of 1-30-07. And that was it. I had a few questions but nothing too important. She said our green card would arrive in the mail-God knows when.

    Anyway so those of you who have an upcoming interview, good luck and dont get nervous, its not that bad, unless you have something to hide.

    Yay its over for the next year and nine months!!!!!!!!!

  4. what are you filing for, K-1? My now husband interview time wasn't set, but we arrived at the consulate like at 6 in the mornig there was a long line. He got in there like at 8 then they called him like at 9 or so. He said that when he went in the interview was like less then ten minutes but we waited till 1pm to get his visa, the printing was what took a long time.

  5. On a side note unauthorized work can be forgiven at AOS interview if you are married to a USC..

    I swear I heard somewhere, even from like a uscia website, that is was perfectly okay...but man, was I wrong, anyway I really hope that it's true, so Im gonna call USCIS and find out for sure......gosh this is terrible. I even went as fas as to argue with someone that I was absolutetly sure a k-1 could work without EAD. Thanx.

  6. Okay I'm officialy freaking out! So when I was doing all my studying up on AOS, EAD, AP etc....I clearly got that K-1 visa holders do not need EAD to work when they arrive in the US. So my husband got his SS, and DL and found a job that he could do in his sleep. Anyway now I'm getting the impression that it is not so. That he has to wait for an EAD and that he could only work until his I-94 expires. I could be absolutely wrong about the whole thing, but I dont want our AOS to get impacted by this, please some one give me some good news about this and tell me it isn't so.

  7. I have the same problem, I dont know how to file! My husband came to the US in July of 2006 and we married the same month. I never tought about changing my marital status with the IRS, and now its almost time for taxes and I wonder if that will affect me in any way. How do we go about filing, I know we have to do it together but since I make a little bit more money am I the head of household? It's so confusing....does anyone know of a good tax service in Phoenix, AZ.

    iam in America now 8 days Ago with a K-1 visa and i dont know yet what i have to apply for to get married in 90 days ...

    if someone can help and Give me some instructions will be thanksfull...as i read i need a Social security number and i dont know how to apply for one i have my passeport and my form I-94 juste ...

    you dont have to be married in order to get your social security card but just wait two to three weeks after you arrived, before you head down to your local SS office or else they wont have you on file. My husband just took his passport/I94 and a copy (not the original) of his Birth Certificate (which was not in English) and a form that we had downloaded from SS website-which I filled out in English for him He said it was painles. Then got a letter saying his SS card would arrive in a week or two... and it did but the first time he tried to use it, they told him no such number existed...so he went back to get a letter showing that SS # was assigned to him...and all is fine...you'll also need that to get a drivers license which will expire the day your I-94 expires (THAT SUCKS) but its just another reason to hurry up and get married and file for AOS...so good luck

    that varies probably by state - nessa's license didn't expire in kansas.

    yeah you're right, it does vary by state...sorry.... But that's the way it is here in Arizona.

    I did so much research to get THIS FAR, now I'm at a loss!!!

    Okay so one clarification, more to come later :)

    So I can apply for a SSN BEFORE applying for adjustment of status correct? (using for SS-5) and just check that I'm a Legal Alien but not allowed to work?

    No, you are not, without the EAD stamp.

    WELL I KNOW FOR A FACT THAT MY NOW HUSBAND WAS ALLOWED TO WORK ONCE HE GOT HIS SS CARD...HENCE THE SS CARD SAID "AUTHORIZED TO WORK" OR SOMETHING OF THAT NATURE...PLUS, EVERYWHERE I READ UP ON IT....IT CLEARLY SAID THAT K-1 VISA HOLDERS DID NOT NEED AND EAD STAMP IN ORDER TO WORK IN THE U.S.....BUT OF COURSE YOU DO HAVE TO APPLY FOR AND EAD LATER ON. AND AS FAR AS THE DL GOES, THAT DOES VARY FROM STATE TO STATE, BUT HERE IN ARIZONA THATS THE PROCESS.

  11. This goes along with the original question... Did anyone crossing at Blaine with a K1 have trouble getting their temporary EAD stamp?

    Also, any different experiences at the Peace Arch compared to the truck crossing? I suppose with a UHaul we'll have to go through the truck crossing.

    K-1 doesnt need EAD stamp, fiances are allowed to get a SS without it and work...as well as get a Drivers License, however you will need to apply for it later on once you are married in order to keep your DL up to date...cause it expires when your I-94 does.

    I have my interview with the US Consulate in Vancouver on the 22 January

    just looking one step ahead at this time...

    can anyone tell me what happens when you present yourself at the border

    crossing with your Non Immigrant K3 Visa? What are the formalities to get

    your I-94 formal entry into the USA? I plan on driving thru the Blaine

    border crossing.

    When my fiance recieved his visa in Juarez (Mexico) we were so excited and though it was smooth sailing from El Paso to Phoenix, however it wasnt that easy. I had no idea he had paperwork to deal with before leaving, at the consulate they just told us to hand over the yellow envelope but thats all......at the border crossing we are sitting in our car and pull up to the agent, who gives us a bad attitude...makes my husband get off the car and send him into the office....we had no idea we had to get off and wait in line in order for my fiances passport to be registered and stamped and to recieve his I-94. It took about an hour and a half more than we expected, so make sure you plan for it. All they did was take his fingerprints..I think then we had to pay some administration fee (like $6) and other than that it wasnt that bad..but the confusion was what made it seem kinda overwhelming.

  14. My wife and I were married in mid January, filed in mid February for AOS, AP and EAD. Had biometrics 3rd week in March. Received AP and EAD the first week of May and had the AOS interview the last week of May. Received her greencard two weeks later in June.

    This was all in 2006 and in California. So, I don't know it that helps but it is real.

    Wow how cool, I hope mine is approved as fast...It seems like it will, we sent in our AOS EAD & AP in November of 2006 then biometrics in December, then the interview is set for last week of January, but no sign of EAD & AP (DID YOU GET THOSE FIRST, EVEN BEFORE THE INTERVIEW?????)

  15. I had some questions regarding AOS, EAD & AP. My husband and I sent in our AOS package in November of 2006 and we recieved reciepts for all of it, then just a week ago we got scheduled for our "Initial Interview" for the end of January...now my question is....do we have to get approved (at the interview) in order to recieve an EAD & AP while we wait for our GC or do we get the EAD & AP before we even get apporoved for the GC, cause if we dont recieve and EAD & AP before the GC then filing for those is a waste of money cause your GC is both of those right?

  16. Hi again guys just another quick question, I was looking at the site http://www.uscis.gov and I saw 4 Biographic sheets the : G-325,G-325A,G-325B,G-325C The only one the lady at immigrations in Portland Maine gave me is 2 copies of G-325A do I need to fill out the other three as well?

    You need to fill out both of the four, each packet comes with four, if you look down at the bottom you'll see they are each attentioned to a different department....four for you and four for your fiance

  17. Is this referring to how you first met or how you've met over the past 2 years? Should it be in paragraph form or with bullet points or what? Sorry if this has been asked many times before!!

    Well as for me, I just wrote one paragraph explaining how we met, that we talked on the telephone every night until we saw eachother again. I also said that I would visit very often (I included receipts, tickets, photos etc) Also that we had been dating for over a year and the date that he proposed marriage. But the most important thing is to establish that you have had a relationship/contact in the past two years, to show that you didn't just meet a week ago and decided to get married in order for them to migrate to the US.

  18. I absolutely agree! Without VISA JOURNEY, I would have never gotten this far. I only had help filling the 129F from a person specializing in this type of thing, the rest I did on my own with the help of Visa Journey...originaly I had no idea there was something AFTER recieving the K1 visa, I just thought that was it....but then I saw the whole AOS process, and everything else that follows. SO thanks again to everyones questions and answers, FYI's and forms.... because I would have been clueless just visiting the USCIS website. Wish everyone the best on their VISA JOURNEYS.
