My husband applied for and got the fiance visa, husband came to the USA and we married but then a change in circumstances meant we did not apply for adjustment of status (and we both moved overseas together). He just left the US within the 90 day visa window and there was no problem. He then applied for (and got) tourist visas to enter the US while we were living over seas for the next couple of years - they crossed out his K1, but it was still in his passport. Also, if you are in the US and she is living overseas they might be concerned that she is an 'immigration risk' and question her when she applies for a tourist visa or when entering the US, so she should be prepared to show her intent to leave again after visiting you.

    thank you so much for all the information, I see a lot of you has mentioned about overstaying.

    Her last stay of the date would be July 3rd, as mentioned by zilchofox, and she is leaving April 17th, so this wouldn't be an issue.

    and Ya, we understand that we will be filing all these paperwork for CR1 or even just the travel visa. 

    I am just afraid that since we didn't file any AOS like everyone else did, she just get married here and leave, would that get her blacklisted from entering to the country again.

    'cause I know if you applied AOS you cannot leave the country while waiting for your permit unless you filed a form.

    But since I didn't apply AOS for her, so i don't know if I need to file any form.

    From all the info you guys gave, I will just make sure to talk to the CBP before she flies out & keep it update after she leaves the country.

    If she does not intend to stay or be in the US for 1-2 years, then nothing much you can do. Whenever she is ready and things are settled down you can petition for her with a CR-1(spousal visa, since you married).

     

    She can apply for a tourist visa from wherever she is to be at, but it might be tough seeing as she is married to a USC; but she can definately try. Or you just go visit her.

    Thanks for replying.

    As far as CR-1, I'm fully aware that I will have to file all these Spousal Visa again when she ready to come back and stay.

    I just worry that if we decided to come travel to US like going to NY just for a week or so, would that be harmful to her visa-application because she left the US after she married and not applying AOS, maybe she will be terminate/blacklist something like that?

    So my wife POE was on April 3rd in Hawaii under K1, and we just got married on the 6th. Now,  we are now back to Kansas.

    Due to her family situation, she cannot be permanently staying in the US for the next year or two,

    We understand this situation before we get married, and I believe i should not have applied her for K1 visa because i didn't know you can still get married in USA with a travel Visa.

    Anyway, so she is leaving on Sunday this week, I wonder if I have to file some kind of form before she leave the country?  

    or if she leave as is, would that hurt her from returning in the future even just for visit??

  5. haha ya,,,now I am~~it wasn't until yesterday...I checked the passport status,,

    it says "you passport has been picked up"  but my fiancee didn't receive anything,,,we were all freakout....then later the day she receive the package...funny thing,,,she only need sign,, the guy didn't ask for any IC or anything....is it suppose to!?

     

    anyway, we are planning to go hawaii and sign our marriage cert, having a getaway wedding just two of us hahah. what about you guys?

    Sorry haven't come back and update after the interviews,,,we were rushing here there.

    Anyway, we MADE it! Haha, a lot little drama going on too hahha

     

    I don't know if you guys met the Clinic reception Chinese auntie....she is so fierce, not to us cause we have everything with us...but Jesus..She scolded everyone there,,,,someone even forget to bring their passport.

     

    When we got to the interview, we just checked out the hotel and brought our luggage, but i forgot we can't bring in or store anywhere...and I as the petitioner are required to go in with my fiance, i was so worried....

    The security told me there is a Micasa hotel see if i could,,, i ran and ask them and they say no only their local customer...sigh!!! then i walk to the cafe that next to it,, they are nicely enough to do so..god bless! 

    the interview only went like 30mins and we are out...there were no one in there either

  7. Fei23k, yes! He went in with me. They asked him is he's the petitioner and asked for his driver's license to leave at the gate and told us that the consular officer might want to see his passport during the interview.

    This info is awesome!! it will be so helpful if I can get in there, 'cause I pretty much did all the paper work beside those Bio stuff.

    And I printed out all of them just in case she needed it during the interview, now I can just show the interviewer instead of having her memorizing those DS-160, 129F, etc...

    we schedule a doctor appointment in KL on 27th 8am, which is the earliest they can do,....i hope the result will go through quick,,,the nurse/phone person told me should be okay...

  8. Hey guys! Thanks for the support! We did it! :D James was with me and i almost didn't believe it when the CO said she's approving it today. :D We didn't translate our documents, and my kids' birth certificates are in Malay. No translation needed. They just want a copy of it. I can say this for sure now because we did it. Yes! Thanks again guys!

    Congratulations !!! Did they let you fiancé to go in to the interview with you??

    I just received my instructions from the embassy yesterday! so relieved! I have a question tho - for birth cert, my cert is in malay entirely. if i go and get it extracted from the national registry,l will i be able to use that for my interview?

    They just opened two more interview dates~ woohoo! it's on Jan 3rd & 5th..

    We scheduled ours on the 3rd since i'm leaving on the 4th.

    but we will have to do hers medical exam on the 26th...and I'm not sure if we can get it soon enough :'(

    Just wonder does anyone know having a similar problem like we facing. there is no any interview slot at all (even 2017), beside these two days - Dec 20th & 22nd, see attachment. We submitted our cash payment last Friday, I don't know would that be the reason to hold up

    My fiances is trying to schedule the interviews after Christmas because I will be there on Christmas eve.

    We have everything ready but the interview & medical exam, according to the instruction they sent, it will need a Appointment Confirmation Slip, which, I believe, is the interview appointment.

    In that case, there's not really enough time to both especially they both have to done in the capital which requires travel.

    Anyway, I just wonder if anyone know the reason why they block all the availability

  11. Lol, yes. Only two now I guess. I was hoping to do mine in Kuching, because I live in Sibu Sarawak. But they no longer do medical exams for US visa. So I have to fly from Sibu to KL for my medical exam. With my two young children. Lol. Oh the adventures we have this week. Anyway, the medical exam was a breeze. (Thanks rachealwsw!) but as rachealwsw and the nurse said to me, the medical exams will be ready in 10 days. If you have already picked the date, you can only change your appointment 2 times. I read that some couples change their interview date because they couldn't make it in time with the medical exams.

    And I also read somewhere in other countries thread that the dates are greyed out because the embassy needs to collect the fees payment. Or something like that. Some people just grab the given date, then change it later. You can do that but you won't know when the next available date or slot will show up. Remember you can only change it twice! Plus there's the petition expiry date to worry about. One couple got their application denied because their petition expired. I will try to find the links for you about what I said in here. So hard replying from my mobile phone. :D

    So you went to KL from Kuching twice? my window is still showing only those two options...I email to the gov. hopefully they can adjust something...

    December is the busiest month for my fiance since shes a dancer a lot of christmas show...there is no way she can't go to KL twice in this short period of time especially the report gonna takes 10 days..

    And I hope it was the payment things that holding up..cause she did the cash payment last friday..hopeful it goes through tomorrow

Oh wow! means there are no interview slots til after march? i just made payment for my visa but i think there is a delay in the system and i wasnt able to schedule my interview just yet =( really worried now, being apart too long already. i was hoping to get the interview after christmas when my fiance is here..

    sorry to hear about the doctor in penang. lets just keep our fingers crossed and chin up. we will get through this =)

    oh hey, we in the same boat i guess..

    well, even march or april or may is still grey one. So what I'm thinking is you only have 3 weeks in advance to schedule if I assumed correctly.

    For example, it's Jan 12, 2017 today, you can only schedule the week of Jan 31st, 2017

    but of course, that's just base on my observation, i'm not sure..

    and yes hopefully we can get this together :( it's really frustrating...

  13. In short, interview appointment date first, then you can schedule your medical exams. The medical exam validity has something to do with your visa validity period that's why its the last step in the process.

    thanks for clarifying that for me, but we just find a problem today...

    We did our deposit payment today and decide to called the doctor in Penang to ask about how the medical exam goes and such..and he tells us that this is the last day he is doing the medical exam for Visa...and my fiancee won't have time to go to KL until after Christmas..(there is only 2 doctor can do exam..really? >>here<<)

    I will be there on Christmas Eve..so we were aiming to get out interview done during that time..

    and i also wonder, can we only schedule interview 3 weeks in advance? I was trying to see if there is any availability on week of Dec 28th, but it's all grey out, see attachment, even next March and so on...

    Sorry for all the whiling, everything was so smooth and suddenly the doctor just abandoned us...sigh

  14. Btw, did they emailed you or did you receive a letter? The NVC emailed my fiance (petitioner) the packet of instructions and he forwarded it to me. I started right away. I-134 is filled by the petitioner to prove that the petitioner can support the beneficiary. Team effort! :D

    If the NVC replied that they have received your application, you can start the DS 160. That's the next step and all you need is your passport and your case number and passport photo of course. When you get to the passport photo, try to do it when the CEAC is during operational hours. Lol. I could never get through when I did that in the morning especially Monday morning in Malaysia. :D

    I just got an email from the KL office about instruction for appointment yesterday, and we have just completed the DS -160 today.

    We only missing the medfical & police cert which is in KL need to pick on the way to Interview.

    On the Medical part. It says that -

    "LAST STEP: Medical - only after you have obtained the above required documents, due to visa validity period. Refer to Visa Validity.

    MEDICAL EXAMINATION RESULTS. You must bring a medical examination report obtained from one of our panel clinics listed in https://travel.state.gov/content/dam/visas/Medical/KLL%20-%20Kuala%20Lumpur more information regarding the medical examination. Clinic needs your appointment confirmation slip.

    VISA VALIDITY: Generally, an immigrant visa is valid for six months from the date of issuance, unless its validity is limited by medical or other restrictions."

    I assume we can go ahead an make appointment to the interview then schedule medical exam while waiting on the interview??

    or we should do the exam first then schedule interview appointment....The sentence there is kind of contradicting :unsure::unsure::(:(

  15. Op you may also want to file an I-131 as well. It's free to file with the I-485 and will allow her to travel out of the country without needing to file for another visa to get back in.

    Oh?? Thanks for letting me know, does that I-131 has an expiration period? also, when would be the best time to apply that?

    We just got our I-129F apporved End of October, and still waiting on the schedule email.

    I think everyone applies for the CGC online. I did as well. I applied in early June and picked it up in July. No problems at all. Also yes, there is an option to have them mail it to you or have someone pick it up for you. Read the instructions again. They're VERY clear.

    So i got this Petition approval letter from NVC on Oct 27, 2016, telling me that they received my approved I-129F.

    It gives me all the Case #, USCIS #. The letter says it will contact my fiancee once the Embassy is ready.

    we haven't heard anything since. Should we do all the preparation at this point??

    Should she apply DS-160 & make appointment for Medical examination while we're waiting on that "Notification to her or to me" ?

    On I-134, I'm confused on who should be the one that filling it out? Should that me or herself?

    We already applied Police Certificate, and it's ready to go, we just need to pick it up at the capital.

    Question for people who knows the Certificate of Good Conduction (CGC) process in Malaysia -

    We don't have time to go to KL to pick up the CGC until December, would they hold on to it for another month?

    Or is there anyway they can mail it to us? I saw something about sending them an self-address envelop when apply, but we applied online, so there wasn't an options.

    We live in Hawai'i. It is easy to get a marriage license. Here is the link: http://health.hawaii.gov/vitalrecords/marriage-licenses/

    There is now a way to download your marriage certificate (two very different things) in Hawai'i rather than wait the few weeks for the official certificate to be mailed. I THINK this is the link we used when were just married, but the officiant has to enter all of the data online for this to work for you.

    There are plenty of ways as well as considerations to think of when getting married in Hawai'i. Here is a simple google search of "Getting married in Hawai'i. Best of luck to you and Aloha!

    These info. are awesome, this will save a lot of time. Will definitely look into it, I found a lot of hotel wedding package which offers officiant.

    And regarding of those package, Do we need to bring a witnesses, like relative wise, what if we don't have one that able to make it to there?

  19. Yes you can do that. Look up the requirements for obtaining a marriage license in the county your choosing in Hawaii.

    awesome, so it just like any other state, no other special process?

    Cause I thought we will have to sign in city where I living at.

    First time post, please forgive me if I miss anything.

    I just recently submitted my I-129F (Aug 22), and go approved on Oct 4th, now it's in the process of NVC.

    thanks to all of your Q&A here, there were no rejection in between.

    So my fiancee, she's from Malaysia, and I are discussing about where to sign when the time comes, and we have came up an idea of signing in Hawaii.

    I wonder would it be possible if we flight straight from Malaysia to Hawaii and get sign there? would her K-1 Visa allow?

    Does she needs to go through some sort of check-in to the Immigration office first?

    Sorry, I don't know anything :crying::crying:
