    Well we are both worried about it since it pretty much determines our future!! How could it not? And that is absolutely true....she says stop worrying it will be fine....but then that's his attitude for everything....you have have to have faith!!

  2. Now I am just talking from the heart and I don't know if people here will disagree.. When in your interview be completely honest.. Let them know the situation.. From what you stated you didn't mean to do anything intentionally... And that is the key right there.. These guys that interview you interview many people a day and hear many lies.. I can guarantee you that .. they hear many.. and they can key onto this.. Just be honest and say... "Hey before we understood the process here is what we were gonna do, then we found out it was not the right way so he went back to canada. and that is why we started researching and following procedures, etc, etc, etc... "

  3. really though he was trying to come into the country with the intent to EVENTUALLY get married.....but that was when we were kinda stupid and didn't have a clue about the process....just some false info. that we got from some lawyer....

    If this is explained to them at the interview will it have a big impact on their decision?

  4. How can the officer just pick a random amount of time and tell him that's his limit??

    I have no idea....because i think they can just do whatever they want to do....

    they didn't even change the date for his return flight....they just told him to do it himself....

    they really are stupid....after they denied him entry and i had to later drive back through myself....they asked me if i had anyone else in the vehicle with me....like i was hiding him...and they i was told that they were just going to do a "random" search of my car.....silly people

    then the same lady from the day before actually asked me what my fiance and i decided to do.....like we had many options at that time!!

    I think they're just all crazy

  5. Okay I learn something everyday.

    Still am concerned that there was restrictions put on him though. Definitly would try to find out exactly what his status is before going to the interview. Either way would be totally honest with the official conducting interview and on the forms handed in at that time.

    Well when he tried coming in the officer he worked with was really nice....and he mentioned that my fiance shouldn't be allowed in because they knew what his intentions were.....but my fiance reassured him that we didn't think we were doing anything wrong at the time and we wouldn't do anything illegal or whatever...

    his return flight was actually supposed to be in about 3 months...and the guy just said well i can't let you stay that long but i can give you a month....

    he would have been back in a month but since we realized he probably would not be allowed back in a second time...he couldn't really fly and leave all his stuff here....

    so he just waited the couple extra weeks until his parents were free to drive down to get him....

    We definitely do not have any intentions of not mentioning this at his interview....

    Where exactly can i look to find out what his status is??

  6. Hmm, but I'm assuming since he was coming from Canada, he wasn't coming on a visa, correct?

    I don't *think* this will be a problem. UNLESS at the border the officer took his information (finger print, photographed, fill out anything?)

    this will be hard to explain but....he was in school in virginia until january....i'm in illinois.....he came straight here then and talked to a lawyer and she said obviously he would no longer have a student visa....so he would have to go back home and then he could come in as a visitor....

    so him and i drove up to canada for the weekend....on the way down he said something about us being married....as we didnt know what the process was actually like because that same lawyer gave us wrong info.

    so they told him he would not be able to come into the country at that time....and they did get his fingerprints....

    so i went home myself and about a month later he got a plane ticket...we didn't think they would let him in but we thought we'd give it a try....

    so the guy said yes you can come in but only for 30 days.....

    and she he was here for around 45 days....then drove back home with his parents.....

    and since then hasn't been back....

    What was on his I-94?

    If he overstayed, yes you have a problem. He could have earned an automatic 3 year ban. However it is waiverable but requires additional paperwork and time.

    You will need to find out for sure whether he did or not. If he is on a ban, you will need to make sure you state that on his paperwork when he goes for the interview. Do not lie about, or cover up the facts. Be honest and open about it.

    he wasn't coming on any kind of a visa....he was just coming to visit and for whatever reason the guy said only a month....and he was here a month and a half before he left....

    well how do i find out if this is a problem?

  8. OK...we've filed the I129F.

    I'm a USC and my fiance is from Canada.

    I just have a question....the last time he came here....which was around Feb. 20th...he flew in and was told he could only stay for a month....this was before we started our visa process.

    He had a return flight but his parents ended up driving here to get him since he had a lot of stuff here that he needed to take home (a couple boxes of stuff, lots of clothes, computer). He was here probably like 2 weeks over the month.

    Is something like 2 weeks going to cause problems with him getting approved?

  9. I was reading through here and i don't think that I sent sufficient evidence that my fiance and i have met within the past 2 years...only a few pictures and a flight itenerary...

    So...I was thinking...I'm a very disorganized person so I cannot find any boarding passes or receipts or anything like that...

    BUT we did attend the same college at the same time....could something from the school saying we both attending at the same time period work?

    or we both signed as witnesses for a friends wedding...so maybe a copy of that??

    I'm not sure...but that's about all i can think of....any suggestions?

  10. Alot depends on the country. If you have them I would send anything you got from the center, just in case!! If for some reason you lost one of them i wouldnt worry about, from what I have heard it wont be a problem. Your fiancee definitly should have NOA1 and NOA2 though.

  11. My K1 visa is processing....when my fiance goes to his interview will he need to bring all the notices that i received....like including transfer notices?? If he does not have one of them will that be a big problem?

    What exactly do you mean by "transfer notices"?

    I sent my application to Nebraska but it was transferred to California. I received a notice stating that it would be transferred to California. And I think I should be receiving one stating that the application was received by CSC. Sorry, I know i word things a little funny and make everything more confusing.

  12. My file was transferred to CSC, and I know they received it on June 16th by the email i got....but i still have not received any kind of notice from them on this...Is it a big deal?? I got my transfer notice as soon as it was sent to Cali. though. Something was off on my address but I've gotten that fixed and received my RFE but still not the notice that they've received my file....do u think it will find its way to me?

  13. My NOA2 has finally arrived 4 1/2 months after being approved. It took USCIS this long to fix the problem of someone (at USCIS) forwarding our approved case but not updating the USCIS computer. Without being approved according to the USCIS computer, we were able to:

    Receive our K-1 visa

    Enter at JFK POE (Eliana has been here since 5/18/06)

    Receive Eliana's Social Security Card

    Looking at the NOA2, it appears the case was approved and forwarded to the NVC on 2/10/06 but the date of approval was 6/21/06. I am not sure if writing my Senator helped or if calling every week helped but the NOA2 is finally in my hands

    Only 17 days until we will be married (Vegas, here we come) and we will get to start the AOS/AP process.

    Thanks everyone for all your assistance and advice. Today is a VERY happy day!!!!

    Is the NOA2 the one you receive when your visa has finally been approved??
