  1. Hello fellow immigrants!

     

    On Saturday, i checked my case status on the CEAC website and it changed from refused to ready and that same day i received an email stating that the consulate had sent a document to me via DHL, i checked the tracking number and it said "shipment Information received". It has not changed since.  So today I called the NVC call center to ask for an update on my case and the nice lady said that the last update was Friday and was to send my passport to the consulate, after the call i received an email to send the passport.  Now, this has happened before, the exact same thing, the consulate sends a doc then they request my passport, the last time this happened, I sent it, a week later they sent it back with from I 601, we appealed the form because it didn't apply to me, now they're asking to send the passport again.  

     

    Does anybody know what they want it for and if they're going to waste our time again?

    No, it won't jeopardize your case. However, one of the prime requirements for a tourist visa is proof that you intend to return back to Mexico. Since you have an immigrant visa application pending (on top of which it looks like a complicated history with USCIS) this will very likely disqualify you for any tourist visa.     Okay let me give you an insight on my case and hopefully everyone else can see this so i can receive good advice, my parents practically screwed my life over.  My father is a US citizen, my mother is a permanent resident and has been since I was born. When I was born, in tijuana, mexico, my parents were super negligent and didn't register my birth, which meant no birth certificate.  All my life until a year ago I had no birth certificate, I lived in the USA undocumented and we couldn't do anything about it because in order for me to receive a birth certificate was to leave the country and that had a risk of myself not being able to come back to the US. Thats what makes the case complicated, we already did DNA tests to prove sanguinity and we were moved out of the fraud prevention unit and then given a waiver for staying in the us illegally after my 18th birthday.  My attorneys are currently battling to appeal the waiver because I petitioned when i was 17 and left the country before the 6 month penalty mark.

I have been waiting for a green card for over 1 year.  My case is a complicated one and it very much looks like it will be a while till my next interview or if it will get approved.  I was wondering if i could apply for a tourist visa just to visit my parents for about two months then go back to Mexico and stay till we hear from the consulate.

     

    Would it jeopardize my case?

    Where were the instructions "sent"? How do you know about them?

     

    If you are not on good terms with your father, I would not take his word at face value. Pick up the instructions, and call the consulate directly to confirm your appointment. And go to the appointment if you have it scheduled and don't have information that otherwise says you shouldn't go.

    Sorry, here they dont send anything to your house, they send it to the nearest DHL, it stays there until you pick it up.  And yes I agree, Ill be there tomorrow pick it up first thing in the morning. also there is no direct line to the consulate, only the Visa call center and they have very limited info.

Okay so, we were told about two weeks ago to schedule a second visa appt, last week they returned my passport because they asked for it, they returned it it got to Guadalajara on Friday, then they sent "instructions" i have yet to pick up either of them because Im far from home I called to ask if they know what the instructions could be and the guy told me they could either be interview instructions or visa port of entry instructions.  Yesterday my father supposedly got a call from the consulate asking us not to go to the interview, I don't know whether to believe him (we are not on good terms) or not because usually they would call or email me too. 

    Does anyone know what the instructions could be? And if the consulate actually asks to cancel appts?

    Please I am anxious as hell and scared, I have been living abroad for over a year now I cant take living here, I cant go to school here at all thanks to my parents negligence and i dont want to work a job where they pay a dollar a week.  

    PLEASE any info will help! :(

  6. Difficult to say. Has a decision been made on the waiver needed/ not needed yet?

    My lawyers successfully appealed the waiver process because they proved that I left the United States before the 3 year ban. They returned my passport along with the interview instructions, but this morning i received an email from the consulate stating that they sent more documents, I called the call center and they don't know what it is. Now I'm curious about the documents they sent.

So, I had my first interview in September of 2016, it was sent to the FPU we had to do a DNA test to prove my father was my father, then we received a 221g for financial docs, we sent them in and they were fine all was fine. But then we received a waiver (I 601) for illegal stay in the USA and my lawyers appealed it because I left the USA before the 3 year/10 year ban mark (before the 6 months after my 18th birthday). Now this morning we received an email asking us to set up another interview in Juarez. My interview is set for January 9th of 2017. What should I expect? What should I bring? They have my passport, they asked for it two weeks ago.

    Any info is deeply appreciated thank you!

  8. Sorry, I read again and realize you are bringing family... Maybe the DNA results raise a red flag or something in the process couldnt be completed, innacurate information... Good luck in your journey

    I lived in the united states all my life with no identity, no birth certificate, no id. So yes I did live in the united states illegally. The DNA tests were A okay. They asked me to send the passport over the phone then i received an email asking me to send the passport. Then this morning we got the email telling us that they sent the waiver and refusal letter, but we have no tracking number.

  9. Our interview was on September 8th, we were put on administrative processing and our case was sent to the Fraud Prevention Unit and we had to do a DNA test. Once that was done we received form 221G and we followed the instructions and sent all the documents they requested. Now, last week I called the visa call center and they told me that all that was left was to send my passport, we sent it and they received it yesterday. Then this morning I received an email which was a reply to an inquiry i sent months ago and they said that three days ago they sent a refusal letter along with a waiver. I checked for a tracking number on the AIS website couldn't find anything. My question is why would they ask for my passport when they're going to send a refusal and a waiver?
