  1. Hi,

    I'm applying for a CR-1 visa, handed in packet 3, and been set an interview date in Bangkok for 5th April. However, I'm meant to be going on holiday to the Philippines the following day, so the questions I have are:

     

    Can I attend the interview, and if my visa is granted, keep my passport, go on holiday for a week, then mail the passport back to the IV unit at the embassy for them to process the visa into my passport? Or do they have to keep the passport there and then at the interview?

    Alternatively,

    If I was to re-schedule the interview, the interview date would highly likely be after 18th April (Songkran holidays for the country), which would technically mean, the most recent tax transcripts we submitted (2015), would no longer be the most recent, 2016 tax transcripts would be. If i took this route, would we need to submit the new tax transcripts (which would be a hassle I'm keen to avoid as we used a joint sponsor too)?

     

    Last option would be to cancel my holiday, which I'm also keen to avoid.

     

    Any help would be appreciated.

  2. Does your Chinese Police Certificate have anything on it saying the Translator was certified?

     

    I have a Police Certificate from China, inside the a white booklet with red stamps, which I obtained from the Notary Public Office. It was also translated into English here, too, but its only states that it is a true and accurate translation, it doesn't mention anything about the person who translated it being certified. Does it matter? It was translated by the Notary Public Office in Shanghai so does that mean it's certified anyway?

    I used to live in China and before I left I obtained a Chinese Police Criminal Record Check from the Notary Office. The document was translated into English by the Notary Public Office in China and also includes a page that states the translation is 'true and faithful' (See attached image of the English translations). However I'm worried it may be rejected as it doesn't seem to state that the person who translated it is certified, but it was done at the Notary Public Office so does that make it certified?

     

    If it needs to be translated and certified again, can anyone recommend a place in Bangkok to do this that is recognized by the US embassy/visa processing people?

  4. Hi @smm,

    I'm also in the same situation. My wife (US citizen) has been working abroad for 6 years, but still has plenty of proof of her ties to US (Bank accounts, transferred funds, driver's license, paid taxes, voter's record, parents letter agreeing we can stay with them, as well as showing our work contracts abroad and rental agreement abroad will soon end.)

     

    On form I-864 my wife must state: 'Country of Domicile'. Would she therefore put US (as she has a lot of proof of maintaining ties) or should she put UK (and explain the plan to re-establish domicile, explaining the above?)

     

    Any help would be appreciated.

    My Father-in-law (USC) will be a joint sponsor for me (British) as my wife's (USC) income doesn't count as we currently don't live in the US. Just looking to clarify my FiL's household members. He files his taxes jointly with his wife, but we are only going to use his income as it's above 125% poverty line and saves additional paperwork. So household size would be 3?

    Me (Beneficiary)

    FiL (Joint Sponsor)

    MiL (Joint Sponsor's wife)

    Part 6 Q13 - My total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax returns for the most recent 3 years was:

    Does my FiL put his individual income or whats on line 22 of his tax returns (total income of FiL and MiL)?

    We are providing the FiL's Tax transcripts and W2's from past 3 years.

    Also, on my wife's I-864, would she put employed or unemployed (her income will show $0). She works at an international school, but her income doesn't count as it won't continue when we move to the US.

  6. I am a British citizen and lived in England until July 2015, which is when I moved to Thailand to live (where I currently am now).

    I have a UK police certificate up until May 2015 (I needed one for my work visa), and I also have a Thailand police certificate from July 2015-Nov 2016. Do I need to get an updated UK police certificate, or is the old one still acceptable as I haven't lived in England since I left in July 2015? Would obviously like to avoid paying for a new one if the old one is acceptable.

    My Father-in-law will be my joint sponsor along with my wife (USC), but on his Income Tax Returns he has blacked out some of his social security number with a black marker as he doesn't like having his SSN recorded down. Is this a problem when submitting his tax returns for my application? Do I need him to send me copies without his SSN blacked out?

    Across his Income Tax Returns, he has 'CLIENT COPY' or 'DO NOT FILE' printed diagonally across all the pages, I'm assuming it's whoever helps to file his taxes has done this. Again, will this be a problem, or acceptable?

  8. I don't know for sure, but can your husband enter the USA as a LPR (once his visa has been issued) and leave, even temporarily, so soon after gaining LPR? I thought he would have to stay in the USA for a period of time before leaving, but I really don't know for sure?

    I have a job contract in my home country until the end of June 2017, so I can't leave until then, but would want to move as soon as my contract is up here, so that I can get employed in the States as soon as possible (minimising my unemployment period). That's why I'm trying to plan out my application time period to meet this time frame. If I could stall on the Packet 3 part, it would definitely give us more flexibility!

    Is there a time limit that the completed Packet 3 documents must be submitted? I haven't started the process yet, but just trying to figure out if we could file the petition (to get it out of the way) and hopefully be approved, but then drag out the Packet 3 process so that we could submit it, say 3 months after receiving it, so that it could work better with my planned timeline to immigrate to the States. This would greatly help us figure out an ideal time frame of when to ideally submit our petition which would allow me to immigrate at our ideal time, but also allow time for any problems along the way.
