  1. Nizounette - you should amend your filing. If you do not amend the filing and get approved, you will run into trouble during citizenship. They can deny your right to naturalize. I would recommend that you immediately file for divorce because you are not eligible for a waiver without a divorce decree. After you receive the decree, amend your filing to good faith marriage waiver. Please note that you are required to change your address by filing an AR-11 online. Getting a waiver is not difficult if the marriage is legitimate.

    i have all the evidences ready in case they call for interview , my mariage was real and we lived together for 2 years and 2 months , my husband left me , i didnt, and i have proof of that

    Anamatt has a good point. It would be better to change your petition into a waiver. You guys are living separately now, not because of jobs but because of your marriage don't work out. And I don't know whether you two have the intention to save your marriage or not. But based on what you said here in which your estranged husband is not willing to go to interview with you or help you with RFE if there's any, it seems like there are some marital problems. If things don't work out and you've tried to save your marriage already, why still stay in an unhappy marriage? There are two components of bonafide marriage, one is to prove your marriage is entered in good faith and that you aren't married for benefits. You said your marriage is legitimate and now you said your husband left you but you stay married and hope there won't be any RFEs or interviews. Based on what you said, it can't justify the second part.

    You are not alone here. There are USC spouses who is not faithful and left the other one behind. It would be best for you to file divorce as soon as possible and change your joint-filing into a waiver. Or you can pray everyday and hope there won't be any RFEs and interviews and be able to file N400 within the next couple months under the 3-year rule.

    I'm April 2016 I-751 CSC waiver filer. I checked both divorce and extreme cruelty boxes. I recently learnt that my file was transferred to VSC even though I'm a CSC filer. I didn't move and I didn't live in the East Coast before.

    Question:

    Now that my file is in VSC. Will it follow the regular I-751 timeline in VSC which takes 12-14 months?

    OR

    It will follow VAWA's timeline which I believe is March 28th 2016 as of September 30th?

    It's been over eight months since I filed my petition. I called the USCIS number and talked to a Tier 2 officer. I was told that my file is now in VSC and I need to mail my inquiry to VSC. I tried to find an answer to my question but couldn't find any. I appreciate if anyone had experience or if anyone knows and can share your insights. You can also PM me. Any input is greatly appreciated!

    I got a RFE in October, and they received my RFE package on Dec. 2, 2016. It only took them 6 days after they received my package.

    It's such a relief. My husband and I were both very stressed out about the RFE, thankfully it went through.

    I did. He said I shouldn't expect any news in December because the process is now taking from 9 months to a year, and I should hear back from them in Feb. I didn't mention anything about visajourney and was very polite during the call.

    I understand that I'm from a red flag country, but I think we sent out enough financial joint documents: 3 leases, 3 tax transcripts, car registration, car insurance, health insurance from my employer, checking account, and credit cards with him being authorized users (he has very bad credit so he couldn't open any). We also included airfare tickets to Asia with our names and pictures. We're both mid 20s and obviously can't afford to have any other property.

    I had to wait over 6 months after the AOS interview to be approved (and it wasn't a stokes interview), and now this ROC is taking too long. If they want more evidence, I don't know what else we could send to satisfy their need.

    Based on what you mentioned here, your evidence looks good. I don't think you should concern whether you are from a red flagged country or not. It differs case by case. May be you should try calling them again. Ask if your file is with an officer right now or if your file is in pending adjudication, they should be able to tell you. If there is a RFE, they should be able to tell you too like they are going to mail you a RFE or something. You know sometimes you get different answers with different person. But if you still get a generic answer from them, then you should approach your local congress person for further assistance.

  5. I made an online inquiry about my missing RFE today, hopefully I'll get the response soon!

    I feel like I submitted enough evidence with my package so I'm pretty nervous and clueless what else do they need, so hopefully I'll receive my RFE soon and can start working on gathering more evidence. The email said I should expect a reply by December 29, 2016, hopefully it won't take that long -_-

    You can probably call the customer service number and talk to a rep. to make sure they have the right address on file.

    I was in a similar situation before. You can file it when your 90-day windows open. Just make sure your divorce get finalized before the I751 waiver. It will make the whole process easier. There are two VJ members who filed their petitions the same month as me (April 2016) and just got approved without an interview. Don't worry too much about what you didn't have because you can explain it on your statement / declaration. Focus on what you can find in the meantime.     Did you talk to a Tier 2 officer and What exactly did they tell you? On the bright side, you can probably file for N400 at the beginning of next year and force them to adjudicate your pending I-751 if you still haven't heard anything back.

    Once you find out who your congressman is. Give them a call or visit their office. Let them know that you need help with an immigration issue. As for me, I filled out an authorization form at the office. I explained why I need his help and authorized him to contact immigration in regards of my case. My congressman's website was pretty resourceful. You should be able to get information from yours, too.

    I filed my i-751 waiver based on divorce and extreme cruelty (I checked both boxes). It's been eight months since I submitted my application (I submitted on 4/1) and I recently learned that my file was transferred to Vermont's VAWA unit through calling the USCIS number and talked to a Tier 2 officer. I PM'ed Sandra couple days ago and she suggested me to contact my local congress person. May I ask if anyone had experiences contacting your local congressman / congresswoman before? What should I tell my congresswoman? (Sorry it's kind of a dumb question) What information can they receive when they make an inquiry on my behalf? Do the i751 cases has the same process time as the VAWA cases now that my petition is in Vermont? Or it will follow the regular I751 timeline in VSC like 12-14 months?

  10. How can I talk to a tier 2 officer? Call (800) 375-5283 and just ask for them? Did they give you any helpful information?

    If I recalled correctly, follow the prompt and dail #2. Enter your CRI89 number. The letter WAC is correspond to the number on the keypad. After you entered, you following the prompt again and choose the option for further help / talk to a representative. The representative will ask you few basic questions like what petition you filed and if you are the applicant/ petitioner / attorney and your reason for calling. You give them the CRI89 number and if they see it's beyond six months they will transfer you to a Tier 2 officer or drop down your information for a call-back from an Tier 2 officer. Hope this helps!!!

    I did an online inquiry as well but the message I got is very generic. I called the USCIS number yesterday but they couldn't give me any further information.

  12. Kikat, i think they are basically saying that the case I still pending. Weird how everybody gets diffrent message.

    Waiver family - Kikat and Misuzu - I spoke to a USCIS officer and was told that waiver cases take 10 to 12 months because of multiple reviews. I think we will have to wait till 2017 :( Atleast we are in this together!

    There are 36 / 53 CSC April 2016 filers approved already (Google doc and VJ timeline combined) = 63%

    I guess we just aren't the lucky ones. Hopefully, we will have some good news around Christmas or New Year.

  13. Yup, I sent my online request on 18th as well and I also got today that the case is waiting adjudication. I think that means that soon the case will be resolved. Pending consideration means that they probably haven't worked on the case yet.

    I sent mine on the 19th but the message I received today is:

    Is it bad news? There's no mention of my file is with an officer nor it's in pending adjudication :( I filed my package on 4/1 :( Which number did you guys put it for online inquiry? I put the I-751number and not the CRI89 number.

  14. Hi kikat, yes grand deed and theme parks are included in the list I shared. I don't really have much utility bills cause we lived in our condo for very short and they were on split names. I might try asking him for his part and dig for my part to combine it. It was just never handy. Maybe that's just one thing I could add if rfe comes. No doctor office emergency but my work place emergency contact, yes.

    IMO, You have more than enough bona-fide evidence. They probably want both of you and your ex's name on utility bills anyways so it doesn't matter that much at this point. I guess if you are still in good terms with you ex, you may ask him to see if he's willing to write you an affidavit when you receive a RFE.

    All this person al, affidavits, explanations, trip tickets and story is attached in whole diffrent list under category "evidence in support" and I put the whole story before bona fide evidence.

    Let me know what you guys thunk. If I get free then idk because I litellary sent everything possible.

    I think you have great evidence. Here are some extras I can think of:

    -Have you guys purchased any home / renters insurance?

    -Did you guys have each other as emergency contacts at doctor's office or hospitals?

    -Any cable / internet bills, Gas, electricity, utility bills?

    -Have you guys gone to any concerts, shows, theme parks etc. together?

    So with Form I-751 I sent all of these documents:

    Filing and biometric fee in the amount of $590.00.

    A copy of Permanent Resident Card, front and back.

    A copy of marriage certificate.

    A copy of divorce certificate.

    A copy of our driver licenses showing joint occupancy at our previous address.

    A copy of our 2013 and 2014 joint tax returns.

    A copy of our Geico joint car insurance documents during the marriage.

    A copy of our joint Sprint cellular phone bills from June 2013 to April 2015.

    A copy of my life insurance showing my ex-wife as beneficiary.

    Affidavits from my ex-wife, her best friend, from our boss (we were working together) and two other friends of us.

    A copy of thank you card for both of our name from XXXX Casino Executive Sarah after attending an event.

    A copy of wedding invitation to us from our friends xxx and yyy, Happy Easter card to us from our friend zzz.

    A copy of our Fitness Club Membership Agreement Documents showing to we joined together.

    A copy of our Sam's Club membership renewal.

    A copy of e-mail showing our New York flight information and tickets.

    Photos of us with our friends, my ex-wife's family and relatives, from different events, and at home during our relation and marriage. I sent photos from when we are at home, concerts, different cities and states like New York, Georgia, all over the Florida, different places like Kennedy Space Center, Disney, Busch Gardens, also bunch of different photos from holidays like Halloween, Christmas, thanksgiving day, 4th of July and birthdays, one of our friend wedding, lots of photos like we are at home with friends making barbecue, lots of photo from work, photos from voluntary jobs like we helping one of the animal rescue center, super bowl parties from each year, her two cousin visit our house for 2014 Christmas so photos from that night, etc. Also, photos from a dinner with my ex-wife father and some other relatives when he visit his friend who living in Florida.

    A copy of some Facebook posts, photos, status updates etc. during our relation and marriage from my, her and our friends Facebook.

    I attached a screenshot of my RFE letter.

    My lawyer wrote a 4 page of the letter and explain to them why I do not have that documents and she wrote a long story of my marriage (how we met, how our relation start, how was our marriage, why we decide to divorce) I also get two letters from my first home owner and roommate which is after our marriage we were living there together.

    I also get a letter from our friend which is she was living with us in our second house. She is one of her good friends. It was a really big townhouse and she explains why my name was not on the lease (she was the one who found the house and asked us if we want to move together. Also when we were signing the lease my driver license, work authorization was expired so that's why my name not on the lease) also she said we were a happy married couple in the beginning but in time our relation starts to get bad.

    I also look my old bank statements and find lots of checks and online money transfers to my ex-wife and our roommate. Thank god on the checks I wrote like "rent for march" , "electric bill" "water bill" etc. The lawyer said they are also great evidence. Soon my lawyer will send my RFE and after will see. What you guys thinking about it?

    I think they asked you for rfe, because you didn't have letter of explanation, bank statements, loan.. did you put health insuatnce? Life insurance? I see that you put a lot of travel, card etc but not much of ecinomical evidence like housing, financial, medical. I thunk that's what matters most. And did you come on K1 visa?

    And wow 26 months? Holy **** i hope mine get solved soon... how do I get info pas vtw? My extension is until April I think and how long before it expires we need to get another extension and how? I'm completely lost in it..

    I think Misuzu has a great point. Based on you provided, it seems like there is not sufficient financial co-mingling evidence.

    Some examples I can think of:

    -Joint checking, savings account

    -Joint credit card or credit card that you put each other as authorized user

    -401K / IRA / retirement showing you guys put each other's name as beneficiary

    -Renters insurance

    -medical / dental / vision insurance that you purchased together

    -Donations that you two did together

    Also, you can show you two put each other as emergency contacts at school / work / hospital if there are any.

    You've mentioned auto-insurance, by any chance were both you and your ex-wife's name on the title / lease?

    Those online transaction and checks are showing your financial co-mingling are good, you can print those out and show the itemized transactions if needed.

Well, technically I didn't reached the tier 2 on my first call coz the automated system asked me to setup a callback and I had to go to work I had to asked my husband to get the call for me and I wasn't present so the officer won't talk to him without me and second call I made yesterday was the same, had to setup a callback, I got the call from the officer and that's when she told me no decision had been made yet.

  19. Good news! After I called USCIS yesterday and submitted an inquiry this evening, my case status changed! "On November 19, 2016, we ordered your new card for Receipt Number WAC**********, and will mail it to the address you gave us."

  20. Hi guys, I was just able to send online request outside of normal processing time. The confirmation said that I should receive answer by Dec 10th, I am April 18th filler.

    I submitted an online inquiry too and the confirmation said that I should expect an answer by December 11th. I filed my I-751 on April 1st : (

    I wonder what's the next step after the online inquiry if anybody have any suggestions. Make an Info-pass appointment? Talk to a Tier 2 officer? Ask local congressman / congresswoman for help?

  21. I am also still waiting! I got RFE middle of September and I said okay time to get a lawyer. So lawyer looked my case and said wow and they want more evidence. So I kinda have some of the evidence they want but some I do not have! I also found some extra evidence about my marriage. I will send soon and will see what is going to happen...My green card extension will be expired on January 27, 2017, so I think I start to look how to do infopass and get one more year extension...

    -When did you file your I-751?

    -Was your divorced finalized before you filed the I-751?

    -Would you mind sharing what they asked you on the RFE? May be some of us here can give you some suggestions!

    From what I found, they usually respond to your RFE within 60 days of receipt. You should be hearing good news very soon! I wish you best of luck.
