  1. Sorry, the I-864 will be later when your spouse files to adjust status.

    The rules are the same for the I-134.

    The co-sponsor counts his wife and minor kids because they are his wife and minor kids as required by the I-134. It has nothing to do with claiming them as dependents on his tax returns. Even if they were not on his tax returns, he still needs to count them in his household for the I-134.

    Whew! OK. Thank you. On the I-134 section 3 for my cosponsor "This affidavit is executed for the following person" It asks relationship to sponsor? Do I type "Friend" or "Cosponsor" or something else?

  2. It doesn't matter if his kids and wife are on his tax returns. The I-864 requires him to list his wife and minor children as household members because of their status; it has nothing to do with being on their tax returns.

    Stop using the words "partially dependent" because it's has nothing to do with the I-864.

    Provide at least the latest tax return. Better to have 3 even if it's not needed.

    I wasn't aware that I had to fill out the I-864 if I am using the I-134

  3. Yes, he must count his spouse as well. Did they file taxes married/jointly? If so, your joint sponsor will need to include his W2s as well so they can determine which portion of the income is your sponsor's.

    I think they filed jointly. So the two children and his wife will be listed as partially dependent? One other question, in the K1 guide and the I-134 it doesn't it only says to provide the last income tax filing yet I have read here that some send in 3 years worth. Should I send in three years worth or just the one? I also have a new job that I am making more money at so the last years income tax return won't show the increase. I am including the last 2 paystubs along with the letter from my employer.
