  1. You should second guess it for sure. Right now, it's fine for you to stay & file for AOS as it was not planned at the time of your last entry.

    However if you leave and re-enter on VWP with immigrant intent that's visa fraud, so I strongly advise against it.

    You should stay put, file for AOS, EAD and AP. Normally you get EAD & AP within 90 days of filing. You can leave at that point and return with your AP (Advance Parole) card, if you wish.

  2. You cannot go on your honeymoon if you want to AOS. You can AOS now and postpone the honeymoon until you get travel permission, or you can go on the honeymoon and then go home and file for a spousal visa which takes a year.

    Thanks for the reply. That's what I was thinking. Because I'm already in the country I will have to wait to get the AP card.

  3. Hi, I came to the US to visit (vwp) my partner which to my surprise proposed to me when I arrived. We got married in a small ceremony in vegas with a few close family members a couple of weeks later.

    For our honeymoon we have booked a carribian cruise so essentially leaving and reentering the country.

    After this we are going to file for AOS for me but I have a question.

    What POE doing I put on the forms? LAX or Galvesten?

    Is there a disadvantage?

    Do I have to wait 60 days from entering after the cruise?

    If I leave after getting married will they let me back in when returning to Galvesten?

    This has me stressing a little now and has me second guessing our choice or a cruise
