  1. i am overstayed visa married to us citizen with 3 steps daughters us citizen

    i sent my aos application on 8/11/2016 and received by uscis on saturday 8/13/2016

    whats next ?

    i did all the paperwork myself my marriage is a real marriage and me and my wiife we stand up and do it by ourselves

    Same case here, Overstayed, married US Citizen, did all the paperwork myself. We filed on April and by July I already had my interview and The green card came 6 days after our Interview. As long as you sent all the right papers and the marriage is real it will go fast for sure.

  2. Hi everyone! Just wanted to provide an update and answer my own questions should anyone stumble on this in the future. I'm happy to share we were approved yesterday! Our appointment was a very pleasant experience despite how nervous I was. We started by swearing an oath and the officer went through all of the information we sent in with our original application. She went through and verified all of the information was correct, asked my husband a series of yes or no questions, and also asked about employment / if he had a SS card / etc. Then she moved onto the evidence portion which basically the only thing we had originally mailed in was our certified marriage certificate and photos of the wedding as well as our apartment lease for evidence. She asked if we had any other evidence we wanted to submit so that is when we shared our updated lease, auto insurance, health insurance, tickets showing trips we took to visit my family and just on our own as well as photos, a bill with both of our names on it + showing our current address, as well as our tax transcript from last year showing we filed jointly. She was happy to take this and add it to the file and was pleased we were prepared and brought the additional evidence in.

    Afterward she let us know we were approved on the spot and asked if we had any questions at all and went over the future process (2 year conditional green card, we'll get a letter when we need to submit everything for ROC, etc etc). Super nice and very helpful. When we were in the waiting room we noticed a lot of people had lawyers and got a little nervous, so at the end we asked about that and she more or less said some people chose to have them, some don't, but really it is just all of our information and is necessary - she actually even said nice job for doing it all on our own which felt good. :)

    Anyway, nothing but positive things to say about the interview and she said we should have the green card via mail in 2 to 6 weeks. Yay!

    Congrats! keep an eye on the mail, i got mine 6 days later.

  3. Has anyone here experienced your online case showed "CARD IS BEING PRODUCED" while your case was actually still being reviewed? The reason why I'm asking is because my wife and I just had an interview for AOS this morning. We were told to wait 30-60 days while the case officer reviews our case. Whatever the reason was I think she suspected something and she wanted to review the case more. However, we just checked the case on USCIS system, and it is showing CARD BEING PRODUCED???

    He probably just told you that but I guess you did get approved. We got approved right away and the status changed online. Got the green card 6 days later on the mail. Congrats!

  4. Hello Juan ! Congrats!! Did you had your interview at Newark ? according to your timelines your interview came pretty quickly, I had my fingerprints also taken at Elizabeth !

    Thanks. I think it went fast because i sent a huge package with pics and evidence of our living together, finances. yes Elizabeth was our fingerprint office but somehow interview was in Mount Laurel which was kind of nice because there was a hotel a block from immigration office, so we stayed there the night before and used the pool..next day we just went for the interview.

  5. My wife's I-94 will be expiring in the next week. We have not filed for the AOS yet since I did not have a job for the past couple of months and don't have the proof of income needed for the affidavit of support. However, in June, I will be starting a job with great pay and benefits.

    We were not able to get my wife a state ID (Illinois), but we did get her a social security card. We went to the DMV a couple weeks ago and they told us since her visa was expiring in 3 weeks, she was not eligible to receive an ID. They even told us that she had to leave the country when her visa expired, which I do not believe is the case.

    My first question is about the ID. Should she actually be eligible for one? If so, is there any documents I can show to the DMV to prove this?

    My second question is about health benefits once I start my new job. Since her visa will be expired and we haven't completed the AOS, will she be eligible to be on my healthcare benefits at my new job?

    your wife will be out of Status but by being married to a US citizen the overstay will be forgiven. as long as it is a real marriage you have nothing to worry about. We went last week and the interview was so easy and nice.

    by the way DMV is way more scary , went today and i felt like i was being asked by immigration, she is like so you had an id over 10 years, what have u been doing all these years, i almost said none of your business, but just said i always had my work permit.. then they asked this lady "are you here ilegally?" like really loud in front of everyone..

    def immigration are way nicer than DMV.

    so my husband called last week because we still haven't received a job permit for him yet and it's been since April 18th, they told him that they were back up that's why the delay but everything was fine, I went check just a few minutes ago and I got this " On July 23, 2016, we ordered your new card".... Does anyone know how long it takes after they post this online? I am soooo happy as my husband is waiting for this to sign a job contract so THANK GOD for the perfect time...a whole lot of PATIENCE REQUIRED :dancing:

Yes, deep down I feel like I shouldn't be too worried, once they meet us and talk to us I'm sure it will all be super evident, but you read some horror stories on here so I always get a wee irrational. Thanks again for sharing your experience and congrats on your approval!!

    You didn't have copies of the medical though, right? My understanding was this needed to be sealed by doctor and sent so that is how we did it, so there wasn't a way to make copies. Did you go to your doctor's office and ask for your own copy afterward?

    We have copies of everything else (K1 Visa package, AOS package, etc.) - just not the medical forms.

    Thanks. The Civil surgeon made a copy of The medical form for us to keep. the original forms he sealed in the envelope. Also remember that your medical form expires I think after a year, so if by The time the interview comes it had expried, they may ask you to do it again. But yeah don't worry, All the people at the immigration office we went were super nice, and if your is also real it will go easy and quick. They do separate couples into different offices when they have suspicion of Fraud. so relax, and just organize your file and whatever you are taking which most likely they will not even look at. I brought a ton of papers and was only asked for our passports, my birth certificate, and 2 questions, then just the legal question if you are going to be a good resident etc.. anyways good luck .

  8. We just got our interview last tuesday and got approved. We did not have a joint account or even joint taxes, you can explain at the interview how you guys handle your finances. We did have a credit card together, also costco and kohls card accounts in our names. As long as you can prove with pictures and other documents it should not be a problem.

    They usually know when it is a real relationship. best of luck!

  9. My case is overstay and married US citizen. We have lived together over 18 years so we had a lot of BonaFide Evidence. We filed I-485 I-131 and I765 all at the same time. We did everything ourselves, even took our own passport pictures.

    3/08/16 We got Married

    .4/14/16 AOS Package was mailed.

    4/15/16 AOS Package arrived at Chicago Lockbox.

    4/25/16 Received emails and text messages that the package had arrived.

    5/06/16 Got 3 letters in our mailed that each application was receipt.

    5/13/16 Got Biometrics appointment on the mail.

    5/25/16 Biometrics done at Elizabeth NJ-went early -was the first one in and we were out in 15minutes.

    6/03/16 Status online "Interview for I485 is ready to be scheduled"

    6/14/16 Status online changed to "Interview scheduled for July 19"

    7/19/16 We went for our Interview-Approved on the spot. interview about 15-20 minutes. gave us Welcome letter.

    7/19/16 Status online changed immediately to "Card being produced"

    7/19/16 Champagne toast !

    Never got the EAD, and status online for I-131 and I-765 never showed anything at all.The Interview:Appointment was at 9 am so we went an hour early, went through security, gave our appointment letter. We sat on the waiting room.A bit after 9 we were called in. The guy was nice yet very serious, asked to see our passports, marriage certificate, and my bird certificate. Other than that he did not look at anything else and believe me I brought tons and tons of evidence.He asked how did you meet? when we moved in together? then he took his time looking at everything on the file he had and kept checking thins on it with a red pen and kept typing things on the computer. finally he said i know your marriage is real and I am approving this right now, he congratulated us and gave us a welcome letter and said the green card should arrived in one or two weeks. My husband said now we can live our lives and I said yeah now we can travel and the officer smiled. We left and went home very very happy, and the status online immediately changed to Card being produced.I want to thank everyone on this forum because i used a lot of information from here to build up our case. wish you all the best of Luck.

    Congrats! Colombian here too. We just got our interview today, approved on the spot. they did not even look at anything we brought, just the passports and a few questions, he said I see your marriage is real and congrats.
