It took 17 days and she still has not recieved visa . It was approved at the consulate and my fiancee gave her prints and was told the courieir would be delivering it momentarily . Now over two weeks and nothing . Sent emails to the consulate and get replys that the courrier service will be sending it out. It is so frustration after waiting 5 years. We still don't have it. It has been 5 months since the first interview and 3 months AP and finally approved but no visa in hand . Don't know where to turn . They have her passport and gave us a courrier reciept but nothing happening . I thought this process would be only a few days looking at other timelines. can't fiqure it out.

Thanks for all your replies. My Fiancee did leave with vouluntary departure under an order fom the immigration courts. We were never given a reason for the misrepresentation as I guess they don't have to tell what it was for. So we are at a lost as to why. She never applied for a visa before other than her first interview ; so we don't know why we were never given the oppurtunity for a waiver . We have contacted Senators when she had her first interview but the paperwork was still sent back and was in review for 2 years and eventually canceled. Therefore we filed again but wanted to get married and send in the I-130 . It seems that is doesn't matter which way we file but have to overcome the misrep part. Any other info would be appreciated.

Thanks again for the reply. I actually did file a FOIA request but all I recieved was information pertaining to her court apperance here In the U.S. for voluntary departure. I asked for info regarding her visa interview but there was none . I see by the link posted that this form is different than the one I submitted. It may be why I filed with the office for immigration review in Virginia . I may try this route. I was never sent any letter of Intent to revoke ; The only thing I recieved was the letter stating that the service center recieved the revocation from the consulate and that it would be reviewed. Then almost 2 years later ; I recieved a letter that the petition was canceled witout predjudice to further filings. Thanks.

I have a question regarding withdrawing 1-129f and getting married and filing an I-130. I filed a 1-129f 5 years ago and my fiancee was denied visa at the interview with misrepresentation with no explanation of the misrepresentation or given the oppurtunity for a waiver. She was EWI with vouluntary departure. The petition was sent back and sent for revocation . The petition was eventually cancelled by USCIS . We now filed a 1-129f for a second time but have decided that we want to get married now and file a I-130 as it seems that the consulates are picky with fiancee petitions and we have waited so long. Does anyone know what I have to do to withdraw the I-129f . Do I have to wait to get married to finalize the withdraw and then file the I-130 or can I just get married file the I-130 K1 with both petitions active. I assume I will have to file for a waiver as this would be the third filing for my fiancee. Any help would be appreciated.

I noticed that the I-601 forms expire on Jan 31st. I don't see any new form for the I-601 . I have gone to various websites ; but it seems they have all taken them off. Just wondering if anyone knows what is going on with them .

I received my Noa2 . Then 5 days later I got another RFE which is imbra . Now I have sent that back . Does this mean my paperwork has now gone to the national center or is it still up at VSC. Little worried about the timeline here as my Noa2 says December 28th as the deadline.

I cannot beleive this . They are now asking for more evidence after they already approved our application .

I cannot beleive this . They are now asking for more evidence after they already approved our application . This is the worst day of my life. We were just thinking that we are almost there and now this . I was actually waiting for a call today from my lawyer saying the Noa2 has been recieved and now this email from The VSC. It must be a computer errror or It looks like I need to take another day off of work to talk to the lawyer , Congresswoman and now It looks like I need to contact my senator and the head of the VSC. This is totally unaccepatble after almost 12 months ; They give me an approval email and now a week later are asking for more material or evidence. ( Absolutley absurd uncalled for and pathetic ) . They are home having picnics parties with thier fiamilies while I sit here hurt,confused and sadly depresesed. I just called bella in albania and gave here the bad news about the delay . She is now devasted and things were just looking up. Maybe this was a computer mistake or this email is actually coming from the National Center. Someone please help if the have experience with this same situatuion.

Dump the loser, I mean lawyer. If you need one, find another that does not have his/her head up the #######...

You are paying this idiot for non-performance. Lawyers are a "dime-a-dozen" in this country. Find one with a functional brain!!!

At least a "security check" means someone's doing something. They "lost" my application for a good 4 months or more.

I've been sending email to CSC now and it seems a bit more informative than the customer "disservice" line.

As to lawyers, I have yet to find any with a good reputation.

The lawyer can only do as much as we can in theese situations ; as long as he is monitoring the situation contacting senators wrting letter and submitting perfect paperwork.

Anyway I got touched today ; stating that I will recieve a written decision shortly . Since thay wanted pictures last week again and now they are sending us a decision ; wonder if that's an approval. Hope so as 9 months of waiting is very stressfull to me and my fiancee . ANy comments ?

I just got touched today after 9 months . I had called our local congresswoman and she did an inquiry . Nothing had been touched since November 7 . I just recieved an email that a RFE went out to me in the mail. What could that be? Any at least we have some movement . with no thanks to my lawyer.

Hello Guys!!

I just want to ask some help regarding our case. I already approve before but my X and I did not work out together so while my stay there is not yet get into 3 months i stay to my cousin to have time to think. But i meet my love right now but I go back to my country before I due of my visa but before i leave I already engage to the real person who love me. And now I want him to be with me on my interview in manila. He call the hotline for the US immigration but he said the lady tell him that if will be in the other room if i'll have the final interview. Is it true that the fiance will not be in the same room when the consule will ask me?

Please please help me about this coz Right now we already waiting of the pocket to arrive anytime this week and we want everything will right before of the said date of my interview.

I hope you gonna help me about this matter.
