Are you a US citizen (USC)?

It may be relevant because as an immediate relative (IR) of a USC, a visitor entering on a tourist visa could appear to be a risk to adjust status (AOS) and not return to their country.

I am a Permanent Resident, but I have applied for USC, waiting for the interview. I hope that won't be a problem. Thanks for your help :)

I didn’t send anything nor my parents brought anything with them as US Embassy in Nepal has banned bringing any supporting documents for a non immigrant interview. May be its different in other locations.

Yes, so I heard. Thank you very much for your help. Really appreciate it :)

I wouldn't lie to the US government.

    I agree! Thank you :)

We put my name in there, otherwise we would be lying because I did sponsor the trip and it seems like so are you.

Make sure you send her your paystub or something to show your income in case she gets asked for that document in the embassy.

Thank you very much. Will do :)

Whoever is paying, needs to be stated under Person/Entity paying for trip question on the ds160.

Have you become a USC yet, or soon to be?  That might come up because IRs of USCs are AOS risk.

Thanks for your respose. Not sure about your question though. I did not understand this part at all "Have you become a USC yet, or soon to be?  That might come up because IRs of USCs are AOS risk. " What is USC, IR and AOS?

I put my name and details on “who’s paying for your trip” when my unemployed parents applied for the visitor visa last year.

Thank you so much. That makes sense. I'll do the same. One more question, do we need to submit affidavit of support if we put our detail for paying for the trip?

  5. Congratulations! While filling out the DS-160, what did you answer for the part "who's paying for your trip"? My mother is unemployed and I will be paying for everything, should I say "other" and put my info on it?

Some people suggested to put "self" but since she's unemployed I am concerned that it might raise a question of how will she afford to pay?

Yes he said it was ok but i was really worried and he said i could go ahead and say no with explanation. Either way it shouldn't be an issue since I really wasn't required to file taxes for that year. In my explanation i included the Interactive tax assistant from irs.gov explanation (see below) with the fact that i didnt become a PR until june of that year. I haven't done my interview yet but i just felt so much better in disclosing it.

    Hope this helps.....Good luck!!!!

Do I need to file a tax return?

You are not required to file a tax return for 2013

You are not required to file a tax return because your income does not equal or exceed $4,000, nor do you owe any special taxes or have any special situations that require you to file.

    Great, this is very helpful.

Thank you and good luck to you too!

I had written that I always filed taxes on the application because I thought it only applied to filing when you needed to file. But I did mention at the interview when going through the application that I hadn’t when I was a student because I didn’t have any income and he said that was not an issue because it wasn’t required and he did not change the answer on the application. So no he didn’t bring it up, I was the one who brought it up because I wanted to make sure I was being truthful about everything.

Got you. Thank you so much!

This statement is inaccurate as there is actually criteria from the IRS on who needs to file a tax return. If everyone should be filing taxes every year, why would these criteria exist?? It is NOT a requirement for everyone to file taxes even if they make $0. I have been a permanent resident for 14 years and didn’t file for the first 5 years due to not working while in school. I was not required to file any of those years and I stated on my N400 application that I’ve always filed my taxes, which I have when I was required to. No red flags , no suspicion or issues during my naturalization process because I didn’t make any income and according to the federal government, I was not required to file. Do not claim that only people who don’t file taxes are “drug dealers” because that’s just not true.

Thank you both for your valuable advice, but let's not fight please.

CTgal18, That's what I thought, that I don't have to file it since I wasn't working. What did you answer to that question anyways? Did you just left with yes, or provide explanation? Did they bring that up during the interview?

That's exactly the same situation i'm in. I didn't file 2013, i became a PR in June of that year and earned no income (husband filed separately).  Based on the info i got here i decide to file back taxes but tax service ppl (&irs ) said i had nothing to declare i am not legally required to file with no income/tax to report. Also couldn't ask my husband to amend his cos we are no longer together after almost 7 yrs..(married for 5 1/2....funny how lovers can become strangers  :( ...but that's another story).

Well I contacted an immigrtion attorney that reassured me everything was fine and suggested i select "NO" with an explanation if it made me feel any better cos i was concerned about not disclosing it could be perceived as bad.  I have also read similar situations where people have ticked yes and that did not bring up any problems.

So if youre like me and are worried about the category you fall in, in that question....selecting no with an explanation would suffice.

Sorry about your marriage, this is how life works I guess :(

Did your attorney said that it was ok to say yes and provide no explanation? What did you do anyways?

  10. Hello Everyone,

I am filling out N-400 but got stuck on the question where it asked "if you have filed taxes after you have become permanent resident", I became permanent resident on Aug 2013, but I was unemployed during 2013, so didn't file taxes for the year 2013. But I have filed for all other years after. So, my question is should I say "yes" to the question as I have filed for every other year I was employed? Or do I have to say "NO" and explain why I didn't file for 2013?

Has anyone been in this situation? Would you kindly let me know what have you answered on this question if you have similar experience?

    Thank you

  11. As per my knowledge, I don't think tax filing status would be anything of their concern as long as your husband has never been to U.S., or he has a social security number. You may amend your taxes once he comes to U.S. if necessary.

Since, you've sent your documents, there's not much you could do anyways. So, just wait for them to respond but it shouldn't be a problem.

Hope this helps and good luck!!

  12. Hello Everyone,

At the US port of entry (JFK, to be specific), do we have to point out to the officers that our marriage is now more than 2 years or will they just figure it out to get 10 years permanent residence rather than conditional residence? Anyone been through similar experience?

Also, about the visa package that we receive after the visa approval at embassy abroad, do we get it back or they keep it?

    Any information is appreciated.

    Thank you

    Hello there,

    my pd is 26feb 2016 F2A (India)

I have submitted all documents and got email from NVC saying you are in interview line..

Can anyone tell me when I will get the email for the Interview?

    Thank you

You can follow the visa bulletin that gets published every month. https://travel.state.gov/content/visas/en/law-and-policy/bulletin/2018/visa-bulletin-for-october-2017.html

They are processing the cases that were filed by Oct 22, 2015. Your pd has to be current to get the interview date.

I hope the wait isn't too long and wish you a good luck!

Not yet. We are about to submit the document soon. I will keep it posted.

Hi Coco, I'm updating my case. I'll try to brief the time it took us.

We dropped our missing document to the bank on Sept 17th (we drop and pick up at the bank) but it was Sunday so, the bank told us they'd take the document to embassy on Monday, Sept 18th. Sept 19th was public holiday in Nepal. On Sept 21st, the status changed to Issued on CEAC and on Sept 22nd when I tracked the passport number on ustraveldocs website, it said it was ready for pick up. Since it was Friday and banks (that's where we pick up the passport) were closed early so we were not able to pick it up and it was picked up on Sept 24th. So, thankfully it didn't took long at all and the visa was granted.

    I wish you a goodluck!

  15. Hello,

Came up with another question again. When we're still waiting to submit the missing document as instructed during my husband's visa interview, we were trying to create a profile online which Consulate told us to. Now, my husband signed himself up and clicked Immigrant, but the thing is we can't find the visa category F2A. They only have K categories. I clicked on it however and it took me to the page where it says pay visa fees. Is this what I am supposed to do? Or do I just do IV Address Registration and put my address? Please advise. Any information is appreciated. Thank you

What document is this ? Can you share your hubby interview experience and questions? If possible , thanks

The interview itself wasn't too bad. Just the standard questions like my address in US, phone number, when where and how we met. Nothing too stressing but the document they said missing is a marriage certificate. The one we gave somehow happened to be a marriage agreement. After doing some research, we found out that we were supposed to go collect the Marriage certificate which we didn't as we though the agreement was the certificate itself. So, once we have the certificate and we provide it to them, hopefully we will be fine. They kept my husband's passport, so I am assuming it's a good news.

  17. Hello,

My husband had a visa interview today in Nepal and we are now put under Administrative Processing for a missing document. Does anyone know if there is any time frame that we have to submit the document within because that missing document might take a while to be available, or is it just sooner the better and no specific time frame?

    Any information is appreciated.

    Thank you
