    I did the same thing and we don't have any problem with it. You can't file Married Filing Jointly or Married Filing Separate because your wife did not have SSN or Tax ID. So the only option is to file as a single. For future purposes, you can file Individual Taxpayer Identification Number (ITIN) with the IRS so that you can claim your spouse on your taxes and rake in some deductions. See the link below

    we have some issues with RFE and also they said we were randomly chosen for extended background checks, so if took us about 9 months to have  our I-130 approved and the NVC just take about 2.5 months

    I did file that K3 and to my surprise, It was tied together with our i-130. Both applications were granted on the same day but NVC just only pursue the I-130 and forget about the K3. So you can just file for CR1 and forget about the K3, it's obsolete

    They told him since I'm already here we can just marry and do adjustment of status and I can be here for the whole process. Isn't that route way longer waiting time? Like 12 months?

    Also, if we did that, would I be able to go back to Canada during the process for a month and come back to America? Or would I have to wait? I still have my pet and rental apartment there..

    Plus if we got married now, wouldn't I lose my benefits/health care in Canada?

    Really, why are you doing the K1? Are you going back to Canada to live and be separated from you partner for another few months? Since you are here, file a K1 is a waste of time, money and natural resource. Get married and file the AOS straight away. Come to think of it, you will technically bypass the K1 route

    I've been thinking what isn't it weird if submit 2016-1040 or joint sponsor which they dont ask for? ( they ask for 2015-1040, but my husband's 2015-1040 doesn't meet the poverty line) 

    You can do both.....just to be on the safe side. It's not weird. the tax season is over. You can submit 2016 tax. To be on the safe side, you can also submit a joint sponsor.

    If they are not denying people just to make money, then they should be refunding the money.

  7. Thanks for the reply, I'm the US citizen and my wife is in Nigeria. So does that mean I have to travel to Nigeria to file CBRA or can I do it here

    It's unlikely that you will be able to expedite the process based on pregnancy. There are many people who are in the same situation.

    If you want to be there at the baby's birth then you will have to travel to wherever your wife is.

    As you are married and assuming you meet the requirements to pass citizenship to your child, the baby will be a US citizen and won't need a visa to come with your wife when hers is approved.

  8. We are currently filed form I-130 and have not been approved. Here is the problem, my wife is currently pregnant with our baby and the baby may be due before visa is ready. The question now is what can I do to get the baby here early with his mother? Do I have to travel abroad when the baby is born? What paper do I have to file? Please help me out.
