  1. Hi everybody!! I have not get in here since time ago because I was waiting that at my Embassy send to me the final pkt 4 since July...

    Now almost 2 moths later, I already receive it and also my appointment letter... but I am so worry, because some people have told me that I don´t have to present my marriage certificate from my country, I mean, my housband is a permanent resident since 10 years ago because his aunt is an american citizen and she asked my mother-in-law her husband and sons (there caught my housband his permanent residence) well, they wait to obtain it almost 12 years... since my husband was 8 years old. Whe he was 19 so like me, we got married at our country, but we (he and me ignore about the petition of his family and that it was almost ready, nobody told us nothing) so, he went to USA with his parents 8 months later that we got married.

    A year later being there (he), we got married under the USA laws (by power) and the petition process for me started (the I-130 F2A). Now, 10 years later waiting, now that we already have our interview, some people have told me that I have problems because we got married at my country before he obtained his permanent residence and because he continued that process without inform that he had get married.

    Please tell me if that is true?? Could I have some problem?? Do I have to present my usa marriage certificate and my country marriage certificate too? Or just one of them?? I am so worried, I have waiting here, I have not done anything against law never :(

    Please give me an advice or tell me if that is false or true... I will be thank of you!!

    I'm not sure if I understand your post, perhaps you could help me to better understand.

    Your husband's Aunt petitioned her brother and his wife and children (one of the children is now your husband) to immigrate to the USA many years ago, when your husband was only a small boy. Many years later, when his parent's visa was approved, they all then moved to the USA, but prior to that he married you in Guatemala. Once your husband received LPR he began a petition for you to join him in the USA as his wife under F2A. Is that correct?

    Are you concerned about your husband's status, since he was married to you before he received his green card?

    F2A: Unmarried children or sons/daughters should not get married prior to the green card approval. If they get married after I-130 is filed, the petition is considered invalid. Neither the married child/son/daughter nor his/her spouse would be able to get a green card under this category.

    Thats right, more less, I really don´t know that he had that process. To began my process we got married later with the law at USA so he began a petition for me. He obtained his LPR by F4-3. Could you please check were you read that paragraph if an F4-3 could get married prior to the green card approval?? please!!!

  3. I know your wait has been very long but unfortunately all you can do is wait. Your priority date may be current but until a visa becomes available there is little you can do. Visa applications subject to preference categories are processed in chronological order according to the priority date. There is no way of any of us guessing how long that wait may be.

    All the best and I hope the wait is not too much longer for you. Hang in there. You are almost there.

My case was sent to my embassy country on June 29, and they received it on July 12, and my priority date was current and they have told me that they were going to send to me mi final pkt 4, but now, they (the embassy people) told me that I have to wait until october with the new fiscal year when the visa authorizations for F2A are unavailable.

    Someone could please tell me what will happen with my case now that 2A numbers SUBJECT to per-country limit are “Unavailable”? On October the embassy will call on me?? my priority date will be yet current?? please!! I am so worried about... I was so close and now I don´t know... please!!

  5. Each embassy is different and delay times vary wildly. I would suggest two things

    1. Go to the regional forums here in VJ and see if anyone can answer your questions there.

    2. Email the embassy asking for information and keep calling, Tell them the details and find out why they havent got packet 3 to you. Also might try contacting your congressman. They seem to be a lot of help with issues like yours.

    Hi alcoy!! well, actually I don´t know if this could be the same for K1 visas, but well, after doing the things that dwar49 have told you, I can tell you that today I have called my embassy because my case was sent there on June 29, but the operator told me that I have not wait anything until october (may be with the new fiscal year) because there is not authorization number for my category (F2A) so, she told me that I have to wait... :( so, it could be a reazon for you too, although I am from Guatemala and my case is different, but it could be... I hope it is not like that for you.. bye

  6. If niki's case has been pending since 1998, as her timeline says, filling out a neat little chronology like a lot of us have probably won't be so simple for her to do. Don't go "daisy" on the woman--she's trying to help us help her, and she did her best to give us as much information as she could.

    Unfortunately, I am not familiar with this type of visa at all, or the Guatemala embassy. But I'm sure that if anybody here does know anything about this type of situation, they'll help. Hang in there! ;)

    Yep, I can see there is no too much people from Guatemala, but all of you are grate!! Thanks a lot for your help and advices, I have learned a lot of things here that have helped me!! I will tell you when I get my interview! I have been waiting for it a lot of time :crying: many years!! :wacko:

    Everybody sais that it is because is a Legal Permanent Resident case, and it is longer than others, but thanks god It is almost done, I hope so!! :P I miss my husband although he comes two times a year.. (L)

    From looking at your timeline, you have been waiting a long long time for this. Hopefully you will hear something from them soon. I could only find one other in Guatamala and that was a K-1 but they had their interview 2 months after the petition was received at the consulate. Hopefully this may be an indication at least for you.

    Thanks aussiewench!! :yes: It is an indication for me, I mean, If I don't have any notice by August 12 I will called on them may be I can get an interview letter at the embassy ;) and every week I will call just to see if they have an appointment for me.. may be mine could be in two months too!

    Could you please tell me how much time later that the embassy received the case papers from NVC they schedule an appointment? They received my case last July 12. They confirmed that to me when I called on them. Now my priority date is current, but I would like to know how much time do I have to wait to receive from my country embassy any notification about my appointment .. :unsure:

But thank you, I wondering wich documents do I have to bring with me the interview date... Do you know how much time after the embassy receive the p4 is the interview ?

    It all depends on which embassy you're going to. What type of visa are you going for?

    In general, you'll need birth and marriage certificates, police certificates, passport, proof of relationship and medical. It's kind of hard to tell what you'll need for the interview because I don't even know what visa your going for.

Well, my case is a legal permanent resident family petition, (my husband is asking for our daughters and me) Our case was completed last week and sent to my embassy at Guatemala. We have been waiting to obtain the papers since almost 10 years ago.. so, now that already were completed and sent to the embassy here at Guatemala, we are so happy!! but I would like to know how much time more do I have to wait, and if somebody knows something about that interview if it is easy or too complicated, what do they ask for, or I mean, what questions do they do.. please!

    Because we have been trying to advice a certain Daisy who just won't fill out her timeline and give us details about her case, which pretty much makes it impossible for us to offer good advice.

  10. In that case you may want to check with the consulate exactly when a visa will be available.

    If the wait is going to be a long one you can apply for a V class Visa.

  11. I called my country us embassy today, the human told me that my case have just came there, but I have to wait about a priority date, that they almost are ther with it. She told me that my priority date was July 9 88 but I think she got confused because if the priority date is the date that Inmigration received my case, it was on 98 so?? cuould you tell me what is a priority date?? it is on the date that inmigration received the case or iis another date. please!!!

    She told me that I have to wait and in some time the embassy would sent a letter to my lawyer putting my interview date, what does it mean?? please!! help me!!

Please, let me know because I got confused, you complete case was at July 6, and embassu received on July 7, right? please tell me, because my case was completed on June 29, and at NVC told me that it was sent to my embassy, but now, July 11 my lawyer has not received the notification letter and in a moment I will call to the embassy to know if they already received the package 4. Is bad that my notification letter has not arrived to my lawyer office, please, tell me what do you think!

  15. Hi! this forum is grate! I have learned a lot of things here. Today I checked my case delivery at DHL website and it suppouse it was delivered on July 3, please could somebody told me what do I have to do so? If I have to wait the embassy call on me or do I have to call on them? please!!! I am so nervous, please tell me..

    They will call me to tell me whats next? or do I have to call on them to pick up the package 4 and make my medical exams??

  16. When the NVC send your case to the embassy, the automated system will update with a message letting you know what date your case was sent.

    Once you know what date the case was sent, go to www.dhl.com. Then select USA as your location, at the top of the website click on track and then track by reference. The reference you need to put in is EXPEDITE IV SECTION if its a CR1 visa. Then put in a date range which will incorporate the date that the NVC sent your case to the embassy. Once this is done the search will show all the packages that were sent by the NVC, look down the list to find the location of your embassy in the destination column. If there is only one package going to your embassy, it is likely that is your case.

    Thank you very much russ79 and all of you!! I think I found the package and it suppouse it is delivered. Al NVC told me that my case was completed al june 29, but in DHL there is no any case to my embassy ship on that day, just on june 28 and other on July 3, both of them are delivered! I suppose may be one of them could be mine!! Although at NVC told me that may be on July 30 would be my package at the embassy, what do you think about?

    Please, tell me what is next?? what is suppouse to do now?? My case is a permanent resident petition, do you know if I have to call or do I have to wait they do?? Please tell me if you know if my housband have to como to our country to be with me and my daughters at the interview or not? please! Thank you again!!

  18. Congratulations dya_rule!!! That's grate!! could you pleas tell me if the system has the same message or just that they have received your papers? Please tell me, I have heard the NVC system since last week and I have not talked to an operator because last time they told me I would have to wait until 6-8 weeks since June 8 when they received my papers.. please!! ask me!! When I get out of my work I am going to call, may be they make my day too!! :o

  19. Yes it is really hard for us to be waiting all this time... I have been waiting almost 9 years to have my permanent residence papers.. I am from Guatemala and it seems that I have to wait a some more... :crying:

    My lawyer at usa was a pain :angry: we have to wait a lot of time for her to send our papers to NVC, and then results that they sent this bad.. so... NVC returned a letter asking more papers on April 20th, then the lawyer sent the papers again until June 2... and from June 8th that NVC received them, we are waiting for any answer, but nothing... it is too much time to be waiting... they just say 6-8 weeks... it is hard.. :(

    I would like to know, just in case you could help me,.. if they confirm that they have my papers completed, whats next? how much do I have to wait to get my interview? please! :help:

    Pharmacist I understand you , I am in the same situation, I would like to travel to see my housband, although I have a tourist visa, one of my doughter don´t so.. we have to continue waiting...

  21. Hi! I am waiting that my case get completed... I sent the papers that they asked me to complete on june 8th and the operator told me that I have to wait 6-8 weeks to receive a notification.

    I sent the Ds 230 on march 13th but then they told me that my AOS was incomplete so, I had to sent it again, they received it on June 8th.

    Someone knows how much time do I have to continue waiting? :help:
