    I hope your wife will receive her visa soon. Sometimes, cadidates have to wait for a week for the visa to be received.

    The only information I've read, seen, heard or been given was 2 days on the embassy website. I am glad to hear it can take longer, not glad it is taking longer mind you...probably won't sleep soundly until she has it in hand.I was worried maybe they'd changed their minds, I haven't slept in like 2 days.

  2. My wife had her interview in Guangzhou, China on March 21, 2007 for a K-3 visa. She was the last one to interview that day, and she passed. The only item the visa officer wanted to see were our pictures, no income or anything even after my wife offered it. We've been married almost 2.5 years when she interviewed..waiting on paperwork for 2 of the 2.5 years in seperate countries, so I figure they might have had a moment of compassion and figured we'd been through enough. She was on a J-1 visa, hence the longer than normal long processing time to complete her 2 year home residency restricition. Which she has proof of being completed, with no trips out of China after her return.

    They say you can pick up the visa in 2 business days, and the others I have contacted who had an interview on the same day all had their visas in hand by 9am on the 23rd of March. Their embassy website states 2 day pickup, with no footnote to indicate you may wait longer.

    They told my wife to pick hers up on March 27th, not the 23rd. What is going on? They didn't give her an explanation stating if everything is ok, or everything is not ok. Simply, come back on the 27th. I can't find anything on the web with anyone taking longer than 3 days, but that maybe simply a bad search string on my part. I can't call DOS until Monday to see if there's a problem or not.

    We had applied for the CR-1, but God only knows where that thing is at, still processing I reckon. Is it possible after she passed the interview the CR-1 showed up and they decided to "bump" her to a CR-1? I'm fearing that I'm going to have to give up and move to China, I pray I'm wrong.

  3. Well, they bent me over and rammed a duplicate RFE in my @$$ as well. I overnighted my first one back, got confimation of delivery, got an email saying they received my first one. This second one is dated 3 days before they receipt date of my first one.

    I don't have a copy of the first one, as I thought someone might know what they were doing...hah.

    Reckon I'll send a copy of the email they sent me.

    Is there anyone that works at USCIS, NVC, DOHS, or anywhere in the entire US government that is not a total incompetent moron and has some "say so" or "know how" as to how things should work? Good lord...

  4. Yes the card specified Temporary Social Security Card, Valid for authorized employment only by INS or something along those lines. I called Social Security Administration today, they told me that she would be issued a new permanent one when she immigrates, not to list the old one. I had gotten mixed answers from USCIS and NVC when I asked them about it, I honestly don't know why I didnt call the SSA to begin with lol. Overwhelmed with getting employment letters, proof of residence, birth certificates, proof reading the whole thing checking for errors, making copies, notarizing every page I attach for proof just for the hell of it. I get free notary from my friend.

    Worst case scenario, if someone at NVC or wherever entered her name wrong, one YING for first, one YING for middle, and I send in ths form as YING YING for FIRST no MIDDLE, and ZHAO for last what could happen? USCIS and NVC both told me it really didn't matter, they told me the namecheck would be done using her Chinese characters by the Chinese embassy. This sound right?

    Do I make a forecast as to what the person will earn this year, or enter what has been earned up until today?

  5. My wife is Chinese, and her first name is 2 parts, Ying Ying, her family name is Zhao. I am unsure how to enter her name.

    FIRST: Ying MIDDLE:Ying LAST:Zhao

    FIRST Ying Ying MIDDLE LAST:ZHAO

    FIRST: Yingying MIDDLE LAST:ZHAO

    I asked USCIS, they told me to call DHS. They didn't know what to do. I called NVC they said it should match her passport, her passport is Chinese and the names are entered YING YING ZHAO. That really doesn't help, being as it's a Chinese passport wouldn't it have been made in China and entered by someone who knew what they were doing, using the English format to only specify that the name has 3 parts, not necessarily that one is the middle?

    She had a temporary social security card while she was in the USA as a student. Should this number be put on paperwork, or is it only valid for the stay in the USA?

  6. When I got my transcripts from IRS, my federal income one was perfect, showed full amount from both jobs, all matched up. My parents requested their's and all was peachy.

    Then we opened the W-2 envelopes.

    My 2005 W-2 transcript was missing one of my jobs. I called IRS, they said my employer sent them a W-2, I work with my father, notice his was missing, he got the same "no one sent us the W2 message".

    So, I decided to use my mother as co-sponsor since I recently got downsized, and my father still has the W-2 to get sent in from his employeer, and mine as well.

    Well, then another question arose, looking at the I-864 from join sponsor viewpoint.

    #25 in the instructions says submit individual tax return...my parents file jointly...my father has the W-2 f####up on his. The tax release form seems to indicate they might check W-2 and or tax returns.

    So, what do I do? Do i wait til the IRS gets this W-2 and enters it into their system before I file the I-864? God only knows how long that will be.

    Do I send in a nice note, with a copy of the W-2 my employer gave me (IRS won't accept taht they said, has to be mailed from employer) and explain the whole mess up.

    Do joint sponsors need to sign a tax release form as well? And if so, will a copy of the one I have with a barcode on it be the best to use?

  7. I just got the I-864 paperwork and need a little help. My job recently cut back, and I was one of the lucky one's selected. They opted a service contract with an IT company, rather than have an IT guy full time.

    When I came back from China, I decided to crash at my parents home both out of the fact, that I just found it comforting to be around people I know, instead of alone in some apartment and to save the money I'd waste on rent and what not so that Ying could decide where she'd like us to live, California, New York, wherever (she came all this way for me, so it's her choice when she gets here).

    Since I now only have part time work , I will probably need joint sponsor or whatever. I noticed something on the form about adding income of people in the household related to me by birth. My folks have no problem being a joint sponsor, what I wonder is...should I do the household member thing? the joint sponsor thing?

    It's been 8 months since I came back from China and been living here, so I have the 6 month deal covered as well. Originally was going to use my full time job, and parents to show we have way more than enough.

    I get a little lost as to what is the best, and what forms to use with which one. Any advice would be most appreciated.

    Anyone give me a little pointer on what would probably be best? And what forms to fill out for whatever you suggest?

  8. Help. I need to get tax transcripts and W-2's I think I read on here recently that someone had a place to get them other than the IRS. I think it was acudocuments.com or docuverify or something like that. Can anyone tell me the easiest, quickest way to get past copies of the income tax and the W-2's. Thanks everyone.

    Free from the government. Unless you want state information, they will tell you the state number to call where you will request them. There is a 39$ charge per copy for state w2 and tax forms, federal ones are free.

    So does that mean all I need is the most recent tax return, NO W2, NO LETTER OF EMPLOYMENT, NO PAY STUBS?

    Never knew pay stubs were needed before, I never save those.

  10. Forgive me if this sounds stupid, and please if this is wrong correct me as this is just my thinking.

    K-3 is not necessary to get spouse here, just quicker under normal situations.

    I-130 is necessary

    It seems to me, that since the I-130 is a way around the whole IMBRA thing, they would either skip people that are already married and using I-129f, or decide to include I-130 in IMBRA along with I-129f. Hope they don't do this.

    People could still get married, and just use the I-130 for a CR1 right?

    Maybe they'll just make a sepearte version of the I-129f for K-3. If the morons had did that to start with...we'd be ok.

  11. There's always the bizarre possibility that K3s get nothing, since as you pointed out, it's too late to warn anyone anyway. In another thread, someone said they were told by an official on the phone that K3s would not be affected. Misinformation? Wishful thinking? Or simply that future K3s will have to answer a question about brokers?

    Had this to say about K3.

    NVC was able to run a data base list of all petitions

    meeting these criteria. We have notified those

    posts that have received these cases and given them the

    case numbers and further instructions. All cases on this

    list, even those with firm appointments or in 221(g)

    status, are to be delayed while the petition is returned

    for further information. No cases in issued status will

    be recalled. If posts have any question about the correct

    priority date of the K1 case, they should use the priority

    date (receipt date) written or stamped on the original

    petition. DHS has not requested return of K3 or K4 I-129F

    petitions.

    Why the K3's are taking longer, or seemingly froze also...maybe they changed their minds?

  12. . Hopefully someone that knows for sure will have some advice for you but it looks to me like she may have to wait until she has completed the 2 yr HRR before she will be issued a visa.

    Not looking for a waiver or anything. Just hoping to find out if they will continue processing the paperwork, I haven't even sent in the I-864 yet. So I am a few months from the question at hand. I just want to be prepared.

    I am just worried when it comes down to the DS-230 Part2 question about the 2 years, if it is before January will they throw out my petition? Or maybe send me an RFE?

    Basically, I want to know what happens if ....Mr. or Mrs or Ms. Visa type officer opens up the DS-230, looks it over and sees she has not finished 2 years. I didnt see an area to explain when the time would be up if you checked yes. Surely they would send out a request for more information? I don't forsee her having an interview before the time expires, I do forsee filling out the form before the time expires though, or else giving up on the whole deal and moving to China :hehe:

    I mean it would suck if say, by the time her interview rolls around, March, April, whenever by which time she would have been there 2 years...if they hadn't processed anymore past the point where they got the form, and saw the YES.

    I'd call USCIS, but it's a different answer every phone call with them.

  13. If you mean what I think you mean it does help me alot. She intends to comply with her 2 year restriction. We follow everything to the letter. I was concerned with the effect it would have on the whole visa process, i.e, would it stop the procees dead in its tracks until January 8. If what you say is correct, then she could still get the visa (hopefully if she had a nice interviewer) and use the 6 months time she has to enter the USA with the visa to finish out any unserved time. That is of course, assuming by some miracle the government pulled its head out of its own butt long enough to get everything approved by January. I know that most likely won't happen.

  14. I was browsing around, looking at forms, preparing things months in advance so I could just mail the paperwork in when requested, mail my wife documentation before she needed it and what not.

    Was looking at the DS-230 Part2. Noticed this line.

    My wife was an exchange visitor. She left the USA on January 7, 2005. I think she was in China on the 10th due to a flight cancellation. I have a few little questions.

    First, I reckon I should have asked this already. Should she have notified someone, the government or something so they would know she is back and start taking time off her 2 years or does it just come off by being back?

    Second, When that question is answered YES, which it will be...will they simply check and say, "oh, she still has some unserved time, let's put everything on hold right now until 1/10/2007"?
