You will have to file a US return.  Doesn't mean you will owe taxes -- likely won't, but you have to file (if you earned more than $10,000).  Whether it is better to use the Foreign Earned Income Exclusion (FEIE) or the Foreign Tax Credit for the taxes you have paid in the UK will depend on your specific situation -- either way, filing a US return is required.

You can't be a non-resident alien for tax purposes whIle you have a green card.  Surrendering your green card now has no bearing on 2019 tax requirements -- the surrender is not retroactive to last year.  You're a legal resident for tax purposes until you turn in the green card (with the proper I-407 form).

    Many thanks for your help!

Is there any help line for advise on taxes for resident alien living  abroad?

Well you are still a LPR and the UK and the US systems are different, you may not owe anything but I know enough to know it can be horribly complicated. For example tax efficient UK methods may not work as far as the US is concerned.

Many thanks. I have no idea how to deal with this but I will try to find out. Cheers.

  3. Hi All,

I have decided to withdraw the LPR status in the US.

I have been living in the UK, working here and paying my taxes here. I think I am eligible for the 2555 Form:

"The tax law permits certain U.S. taxpayers to exclude up to $80,000 per year of earnings from taxation if they live and work outside the U.S. for a year or more"

Could anyone here tell me if I submit the withdraw form with a letter explaining that I am in re-entry permit period (and I have not declare taxes for the US, only here in the UK) will I be exempt of any tax file process?

Thank in advance for your help.

    Regards,

    Lis

If you look at the official Dept of State guidelines they are accepting the announced five year extension on existing passports.

    https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Venezuela.html

Effective, June 7, 2019, Venezuelan passport validity was extended an additional five years  past the date of expiration printed in the passport. Venezuelan passport holders who have already received an extension or “prórogga” will have the validity period extended by five years from the end date of the extension. NVC will accept all Venezuelan passports, valid or expired, so long as it is still considered valid after adding five years to the printed expiration date.

You are Amazing Sussie. God Bless you.

  5. Dear Sirs.

Please let me know if you have knowledge about the situation of Venezuelan citizen who has the passport expired and they are not able to obtain an extension of the validity as they are currently living abroad or they have been waiting for extension approval for months and months.

Currently the Identification authorities (SAIME) is a totally corrupted institution and there is a high possibility that you can not get a passport. However, Venezuela is not denominated as communist - controlled country but is well known specially in US what the situation is.

I will appreciate if someone could give me some guidance.

    Kind regards,

    Lisbeth

  6. Dear All,

I am LPR of United state since 2017 and I need to file 2017 and 2018 taxes. I am single, I live in London and I pay taxes in UK. My earnings are below 50K dollars.

Please help me I do not know what to do, I am confused with all the information on IRS.GOV

Many thanks in advance for all your help!

  7. Hi All,

I will write here my experience of Re-entry permit.

I arrived to US on the 03rd of March 2018, on the 5th of March I submitted my application and paid the fee.

I received a letter 10 days later that my file was received. As my Re-entry permit reason was Health and I had an appointment with the doctor on an specific day in London, I went to the Biometric centre

with the letter i received and I requested the fingers print to be taken. Even though they asked me to wait and talk to the office manager (and he was not in his best day, I must say) they made everything to help me

and they took my details, fingers print and I was sorted on the 19th of March I was ready to go back to London.

I received a few day later the appointment letter for the 28th of March, I called them and they asked me to ignore the letter.

After a month I received a notification saying that the Re-entry permit was approved and it will go to the US embassy in London. However, up to now it is not listed yet on the Embassy web page as received.

I hope my explanation help someone.

    Cheers!

    Lis

  8. Hi Everyone,

I hope you could help me as soon as possible as I can not find any information online.

I am applying for a Re-entry permit, do i need to include 2 photos or this is only for the other two type of application on this form?? If I need to include the Photos, where do you recommend to take that photos with the thin paper instruction? is that a passport or visa photo that I can take in any walgreens??

Also, on the form there are two fields I can not find out how to complete. Province: I am in Orlando, florida and I dont know if this area have  a province . Postal code: I have 32xxx-60xx  this is the zip code and postal code? is the same information???

I need to arrange an expedite biometric appointment , shall I pay an additional fee for this ? or only mentioning on the envelope they will take that in consideration?

Thanks for all the help I can get from you as usual.

Have a lovely day!! I love floridaaaaaaaaaaaaaaaaa!!!

  9. Hi All,

My cousin received the interview appointment email today and she is having difficulties with one of the police records of her husband. He lived in Mexico from 1980 until 1984, and he has been trying to get the police records from Mexico and the have as a request that the person should be present in the country to get the police records or give a authorisation to a direct member of the Family to proceed with the request on his behalf.

Sadly, my cousin husband is not able to travel from Venezuela to Mexico to just request the police record and he has not direct family over there. What is the worst case scenario if one of the police records is missing?

Additionally, he is waiting for high school degree registration and apparently is going to be longer than the interview appointment. As he is not main applicant, but my cousin does that affect the visa approval?

Thanks a lot for your help.

    Regards,

    L

You will have to prove you've maintained domicile in the USA as well.  Just a friendly fyi.

I appreciate your comments, I have not maintained domicile in the USA because I am not living in the USA. Diversity Visa process is different as far as I know. At the end of the day, if they consider I am not doing the things in the right way eventhoug I am complying with everything under the legal requirements, I am happy to defend my position.

Im sorry pardon? You are living in the UK? How long have you been there? You are an LPR? When was the last time you were in the USA?

You still need to file US taxes but you're seriously endangering your LPR status by not living and working in the USA. You really need a specialized accountant at this point so you don't shoot yourself in the foot and kill your lpr status completely, unless thats the plan?

Thanks for your comment. I am ok with my status. I want to do the right thing and I want to file my taxes. I am moving to USA on 03 of March complying with the requirement of not remain outside of US for more than 1 year.

  12. Hello All,

Please help me with this request. I became LPR on 1st of March 2017 after GC activation (diversity visa).

I have been living in United Kingdom. I read that I should not be paying double taxes, (here in UK and there in USA).

My income last year was about 31K dollars (gross) and I already paid taxes for that amount here in UK.

How should I file my US taxes? It is a simple step? I have been trying to read different posts and also I completed a set of questions from the IRS but I really have no clue on what to do??

hopefully someone could give me some guidance.

    Cheers!

    Lis

  13. Thanks Sussie. Thanks to all the members! you are awesome! When they say take me to the judge is in the airport? I will be staying at the airport? could they ask me to buy a return ticket to come back to UK or proceed with deportation?

I know this is too much Drama, but I would like to know the chances of worst case scenarios.

  14. Thanks Geo! I am not planing to go back and live abroad and do doggy actions to keep the GC. In case that I need to leave the country for job purposes I am clear that I need to apply for a re-entry permit.

As I said, the reason why I stayed until now if because I needed to save money to start a new live as I have no sponsor and I am not earning a huge salary in UK. I have been complying with all the legal things and I have not plans to change my behavior.

  15. Thanks Sussie, but they could revoke my GC because it is to close to a year from when I left the country? Am I in risk of being rejected? I also have other profs such as expiring working contract and I my applications (email confirmation) that show my intention to work and live in US.

  16. Dear All,

I have been living and working (and paying taxes) in United Kingdom. I moving next month to US and I know I need to fill a form to declare my taxes as I have been LPR since 1/03/2017 when I flew to US and activated the Visa.

All my savings are in pounds and I already paid taxes on that earnings. What will happen when I transfer my money to any Bank account in the US, will be that considered as an income? How could I declare that money?

Additionally, I would like to tell that I am a little bit anxious about entering the US as on 1/03/2018 expired my year, I left the country on 08/03/2017 and I am planning to go the second week of Feb. They reason why I stayed until now it was to save money. Could I still be denied when the date is so close to the year or is still valid?? I am staying, but I can not afford one way ticket as the difference is 1:5 .

Thanks for all the guidance and advice :)

    Congratulations on winning the DV!

Have you prepared a US version resume yet? It’s very different to the one you might be using in the UK. That was the first thing I did before submitting my applications online.

I understand that you’re anxious to secure a job before you move over but as you probably know it is very difficult when you’re not physically located in the US during the recruitment process, not to mention time differences etc. Avoid having an expectation that you’ll get an offer when you - the candidate is overseas.

Having said that, there’re a number of things/ideas I can provide if you want to make a head start.

    1. On your LinkedIn profile header, include something along the lines of: Green card holder, have work authorization. This is to minimize the chance that recruiters skipping your profile when they see no US based work experience.

    2. Create candidate profile and notification emails on the company websites you want to work for rather than just applying to jobs online.

    3. Use LinkedIn effectively. You can ‘cold-email’ people that have studied in the same universities as you or worked at where you’ve worked before who are now working at the US companies you want to apply to. You can arrange for future coffee catch up when you get to the states or just ask about their work environment/company culture.

    4. Sign up for job email notifications from online job sites like Glassdoor, LinkedIn, as well as from recruitment sites like Michael Page US etc. Most people overlook recruitment sites which also have email notifications on vacancies.

    5. Sign up for a US Skype number to use as your contact number.

These are the ones I can think of that you can easily start. Best of luck and I was told  that even when you’re sick and tire of networking, keep networking.

I really appreciate your reply! Thanks! :)
