  1. Hi all. Please help! I filed 2 petitions - one for my husband and one for my 18-month old baby. My husband's case is complete and the interview is scheduled for December 30th. So far so good. But i got a checklist for my son saying i needed to submit I-864W instead of I-864 and it is stated in the letter "do not submit the correct form to NVC, instead bring it to the interview", so I prepared the form for the embassy. A week before I got this checklist I called NVC and the agent told me my son and husband will have the same interview together. Today I decided to call NVC and check if after all I should get a separate interview letter for my son or my husband's enough. They told me they are still waiting on form I-864!!! I want to cry. Do you know how can I ask the embassy to expedite my son's case and is it possible to make it for December 30th?

  2. Sounds to me like they haven't yet processed the document package you sent. If you're sure they got the package (got your scan date from the call center), I would wait and give them some time to get to it. Were the documents on the checklist included in the package you sent? It could be a false checklist.

    Yup! All required docs in a folder. Package was received July 25th at NVC. Agent confirmed. That's what I will do - wait till august 25th and see what happens. I'm almost sure it is a false checklist but wanted to know VJ family's opinion ? I see Bulgaria on your timeline. Is that where you're from?

  3. Hi all. I submitted DS-260 in mid June, but sent the package to NVC in July (scan date july 25th). I got a checklist dated Aug 1st saying they got my documents but they are missing my I-864 plus financial and civil documents. When I spoke with an agent, she told me the case has been reviewed for the last time on June 30th (i have not sent anything except the DS-260 in June). Is it possible they reviewed my DS-260 form and thought they have lost my physical package and that is why they sent the checklist? Cause it sounds quite suspicious that they reviewed the whole pack in just 5 days and generate a checklist. Any thoughts?

  4. If you have copies resend them in right away, You only need copies sent into the NVC original's are needed for the interview.....Did you send by reg. mail or E file to NVC?

    I used regular mail. I put all documents in a folder - all paperclipped. I don't understand how they lost them.... i have copies, but the issue is my joint sponsor is on 2-month vacation and i don't know if i'll be able to get his documents again ???

  5. Soooo frustrated! I sent both packages together on July 20th along with cover sheets, cover letters summarizing what's enclosed and guess what i got - a checklist. According to them I have not submitted an affidavit of support form, beneficiary's passport and birth cirtificate (copies, of course). I asked the lady which affidavit of support they are missing - mine or the one filled out by my joint sponsor. She said she doesn't even see I have a joint sponsor. I am 10000% sure I have sent all the documents in one folder in the right order with the case number written on top of every single page. Please advise what shall i do. I really don't want to wait another 2 weeks gathering documents from my joint sponsor again....

  6. Your evidence of income is the tax return. It shows on Line 7 what you made. It shows on Line 22 it's not enough to sponsor because it's $0.00. Sending employer letters and pay stubs is optional, says the I-864 Instructioms. You do not fit the typical sponsor and NVC gave you a canned answer. If you fill out "my current income" as $0.00, then all you have to prove is zero. The required tax return backs that up.

    It's when you say "my current income" is $20,000 that they expect to see additional documentation proving that amount if your tax return doesn't. So they would RFE asking for proof of $20k. And a letter and pay stubs of your foreign employment of $20k would then be rejected as not meeting the requirements because it will end. So my logic says, say up front "my current income" is $0.00 and have a joint sponsor who can document sufficient income.

  7. A person filing a US tax return with only foreign income and taking the Foreign Earned Income exclusion would typically have zero on Line 22. That's because you list the foreign income on Line 7 and it"s subtracted out (excluded) on Line 21. If there was no other sources of income like interest or dividends (which can't be excluded) then zero is very normal.

    For the purpose of the I -864, you have zero income and there is no need to add your husbands zero to it. You either have to qualify on assets or get a joint sponsor to do an I-864 as well. You are required to provide your 2015 tax return with your I-864 even if it says zero. You do not have to provide any further evidence of income because you have no job in the U.S. yet. You don't qualify to be the only sponsor. Don't get too hung up on the form as specific to you because it isn't. It is typically for a person living and working in the US to prove they can be the sole sponsor. Just fill it out and don't worry about the zeros for income.

I called NVC last week and explained the agent that my income is earned outside the US, it's way below poverty guidelined, and it will not continue when I go back to US. Plus I have a joint sponsor. She said, "you still have to attach evidence of income". I asked her also about the assets -should I include assets in I-864 if they will not supplement income and she said "yes". So I'm really confused right now. What to prove?? My income will not continue anyway!

I called NVC on Thursday night and explained the agent that my income is earned outside the US, it's way below poverty guidelined, and it will not continue when I go back to US. Plus I have a joint sponsor. She said, "you still have to attach evidence of income". I asked her also about the assets -should I include assets in I-864 if they will not supplement income and she said "yes".

    I thought she didn't quite get my case and decided to call again on Friday. The agent said I should ask a lawyer if I need to put "0" on I-864 and also about the assets. Any advice what shall I do? ?

  9. Hi Mim4eto, sorry for the delayed response. I think I filed my tax returns in ~November 2014. In Feb late 2015 I heard from the IRS requesting a form be completed explaining why I handn't filed previously (basically since I'd moved to the UK since I was 10 so had no idea I should have been filing US tax returns). I sent that and heard nothing more and was advised by my tax guy that "no news is good news". Still have never heard from them to this day but I did request my transcripts last week so everything must be done. I don't know if that really answers your question but would think it should only take them a few months providing you're not in the busy season when everyone is filing. You can request the transcripts online for free even if you live abroad on the IRS website. I suppose you can go there and put in your details and if they're available they will appear! Hope that helps in some way.

    Thanks! I filed late taxes. Something is bothering me though... Do you have "0" on line 22?

    And another question - I will put "0" under current individual income. Since me and my husband take care of bills together, should I put that I use his income in I-864 even though his income would be also "0" as it will not continue or no? In this case do I need to provide any evidence of income or evidence of assets if neither one meets the poverty limit? Thanks and sorry for the long post.

  11. Before I call NVC tonight and ask my questions, could you please help me with this one?

    I did not know that I had to file taxes even when I reside abroad so I filed taxes for the last 3 years and I am about to mail them out to IRS on Saturday.

    I will send NVC a copy of all three returns (despite the fact i have a joint sponsor) and of course, W2's are not applicable in this case.

    When I read the I-864 instructions, it says:

    "If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file all late returns with the IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting Form I-864."

    When I submit my returns (done on paper), I need to wait 6-8 weeks before ordering a transcript and another 10-30 business days till I get it.

    Unfortunately, I am not able to get it online as I do not have a US based phone number showing my name or bank account.

    So, my questions are:

    1) Will copies of my filed late returns be enough for NVC when I have a joint sponsor?

    2) If no - will it be at any help if I submit an official employer's letter showing income from wages and local taxes paid for all 3 years (instead of W2's)?

    3) Can/Will they reject my package due to the lack of a tax transcript of my filed late tax returns?

    I'm really nervous. I do not want to wait for months till I send the package ;( ;( ;( Please help!

    Please see this link. It is very helpful. I agree that bar code will not feed all the data in the computer and the human eye has to verify it. I was able to click the box for my apartment, but wasn't able to write apartment number. Therefore, I just hand wrote apt no. I feel like this might not be an issue. But oh well we never know what they will do. lol

    I already read it. I'm still not sure though.

  13. I am in same situation. I was not able to write numbers in my apt box so I hand wrote it. Hopefully it will be fine. I don't want to get check listed for simple thing like this.

    Since we cannot be sure if the bar code contains only information about the current page or affects the whole application, then I prefer to add an explanation letter. What I'm thinking is that the bar codes contains the information on the current page plus is somehow connected to the other pages to avoid overwriting a form. For example, I might make my sponsor sign a I-864 form and then re-do the whole form except the signature page. Do you see my point? I'm afraid if I print only the corrected page, they might get the wrong message and reject my whole package.

  14. I think you can only edit and print the page containing the check box (hope its not on the page where the signature is)

    Then you can replace the old one.

    My husband did that and according to him, the barcode on the page is only for this same page.

    I'm not absolutely sure but you can at least consider it...

    I might do so or the other option is to add a letter with an explanation that my sponsor has added tax returns for 2 more years.
