  1. Guys,

would appreciate your help, parents got called in for interview on Jan 10 2023 for i485 interview.. interview seemed to go well.. IO stated that everything looks good, came back home.. next day i130 was approved. 2 days later rfe was sent to father that his fingerprints are not good enough and to get police reports from where has been residing for last 5 yrs. I submitted that on Jan 19 2023 and there still is no update.
My mother had no rfe but there is no update on i485 and her i130 was approved also on Jan 10 2023. I have been waiting a long time, and parents need to travel back home. I didn’t hire lawyer but I’m thinking of hiring.. could anyone advice on how to get info on case or should I get a lawyer. Also is this regular timeframe. A lot of people who had applied after me have been approved. Getting very frustrated with this situation.

    i130 and 1485 concurrent filing jan 14 2022.
    i130 approved Jan 10 2023

    i485 pending

    i131 still pending also

It may take some time for them to update the status. You might want to wait for may be a week or so and if the 485 status still doesn't change, you can contact them directly.

So I got a RFE for my father stating that the fingerprints couldn’t be distinguished and used for him so I have to get police reports for towns cities where he has lived for than 6 months. Would you know the process for this as I’ve never been to a police station and does this include his stay in the USA. He’s been here for 1.5 yrs now.

Check your  I-130 timeline and see if the latest status is case approved or case closed.

Read in some of the other forums that USCIS has been accidentally sending I-130 cases to NVC and then closing the case abruptly keeping I-485 in pending status.

Well that would be odd. I130 says it has been approved. I485 says interview scheduled even though they had the interview. the case officer literally said I am approving case as I don’t need more documents.

If you mean the USCIS processing times tracker, that only includes the I-130 petition processing time.  Applicants cannot get visa interview or file I-485 before PD is current on the visa bulletin.

Yes I meant the processing time.. now I understand that the PD is what matters.. so the PD will have to get Jan 2023 and then she can have her interview and in the mean time the i-130 will be approved

Check the visa bulletin.  Only F2B cases with I-130 filed on or before Sept 22, 2015 are getting visa interviews now -- https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-january-2023.html

Yes seems like that’s about 8 yrs.. I don’t know why the processing times on uscis website has it as 5 yrs

    Hello Guys,

had my parents interviews. Went pretty smooth, She said she will have decision for us soon and literally congratulated us. I came home and the I-130 was approved online for the parents but i485 is still pending. Does anyone know why or what the process is ?

That means it is still in transit, not delivered yet. Did you send it to PO box or street address? Did you ask for signature confirmation?

I sent it to P.O. Box. I sent the i485 application. No signature required. I don’t get it. What’s the delay?? Really worried as there visa expires in 2 weeks

  8. Guys i sent my parents i485 paperwork to Chicago postbox on Feb 2.. still had no response and the checks haven’t been cashed. I would appreciate it if someone can tell me how long it’s taking for them to cash checks and issue receipts. I don’t even know if they have received the application, USPS website keeps saying package is still in transit. It all makes no sense to me. I had sent it using priority mail.

    Thanks

  9. Hey guys,

So I submitted my parents i130 couple of weeks ago online. I Got the receipt. Submitting other documents and needed your help,

    1) in the i485 application whos A- number do I put in at the top of evry page in the application.

    2) my parents are unemployed for last 10 yrs, do I leave that blank in the i485 or put N/A in that section

    I864 Question

    1) Do I file 2 different i864 for each parent

    2) Part 3 section 2 , if I’m sponsoring by mother and father do I tick this box as it states” I am sponsoring the following members immigrating at the same time or within 6 months of the Principal immigrant named in part 2.”

    3) part 5 section 1-7, If in sponsoring my father and mother my household size is 3? I have no other dependents?

  10. Thanks for your reply guys, really appreciate the help. I checked the notice and called USCIS, notice was sent from the Texas center in Irving and uscis said that I would have to file I824 to change it. I’m going to go ahead and file I485 as the process from the consulate seems to be very long, does anyone have an estimate how long it takes to get travel document?
