    Seriously. Don’t do anything to amend the return you filed. Arriving in May, your wife had enough days of physical presence in the US in 2019 to be considered by the IRS as a resident alien for tax purposes. Her status with IRS is resident alien allowed to file a joint return with you. Her physical presence test means you don’t have to choose for her to be treated as a RA. She already is one.  
     

    Her status with USCIS is not a resident yet, but that’s a different ball game and nothing to do with filing a tax return.

    Yes I just read it and realized that we need a letter stating that we wanted to jointly file after I mailed out our 2019 tax return . However I wonder if we need to sent out Form 1040- X to attach the letter or just wait until IRS gets back to us. We hope she will has a stimulus check...  Anyone has ideas?

  3. My spouse came to US in May 2019 and we got married at the beginning of June 2019. She had EAD and SSN but not green card. I’ve just paper filed our 2019 tax return as MJF a few days ago. However I didn’t attached the declaration that we wanted to filed jointly. Do I have to file form 1040-X to amend and include the declaration letter? Thanks!

    This year is the first time we filed tax return together. I mailed out the form 1040 and now realized that we need to write a letter stating that we chose to file tax return together. Is this letter necessary ‘cos we may need to file 1040X to amend/add letter if it is 😖?

    It's possible, but in that case, my money would be on the 07/27 ceremony (unless they have a special July 4 ceremony).

    If you're not scheduled for the next ceremony after your interview (for example if you are interviewed on 06/18 and the 06/22 ceremony is full) then they may mail you an oath letter instead of giving you one after the interview.

  6. Sorry, I made a mistake... the 4 of us applied in December, did bio in early January, and were placed inline in late April and early May. All 4 got interview scheduled within 2 weeks of being placed inline (for 2 it was less than 48 hours). Visit our page and look through the latest table.

    Remaining Houston ceremony dates this year:

    May 18

    June 22

    July 27

    August 24

    September 21

    October 19

    November 16

    December 14

    There's a thread about this in the main citizenship forum... it's from a second hand source (a legal organization), but the first 4 ceremony dates have proven to be correct.

    Yeah I still remember you applied 12/17 and was inline 4/26... When will your interview be may I ask? Or can you please share here whenever you know the date?

  7. 4 months and 2 weeks for me in Houston before I was placed inline. I applied in December.

    3 others in my month waited between 4 months and 5 months. All others were placed inline right after bio.

    Everyone has had their interviews scheduled now.

    I wouldn't worry just yet.

    That means people got interviewed scheduled around one month after being placed inline?

    I know that Houston only have one oath ceremony a month, but you have more info? (like every Monday last week of the month?)

  8. Here's my info if it helps:

    I applied in Houston on 12/17, did biometrics on 01/13, and was placed "in line" on 04/26.

    So that's 3.5 months so far.

    After being placed in line, your case is transferred to your local office, so it depends on how busy the office is.

    I expect to be interviewed between late June and early August, but that's just a guess.

    If I had to guess, I'd say that you will be interviewed between July and September (again, just a guess).

    This is assuming nothing too strange happens with your background check.

    Then Houston usually schedules you for the oath ceremony the same month or the month following your interview. Since there is 1 each month, it's very rare that you have to wait for more than a month for an oath in Houston.

    As I said, most people in Houston finish in 7-9 months... if you are placed inline right after biometrics, it'll be closer to 7 months... if you have to wait a few months to be placed inline, it'll be closer to 9 months.

  9. I'm in Houston, filed 20 days before you and got my inline notice last week.

    Two other December filers (not in Houston) got their inline notice last week too.

    Some November, October, and May 2015 filers (not in Houston) got their inline notice last week too.

    Some background checks take longer than others.

    Hang in there... if it helps, most Houston applicants finish around 7-9 months after applying, but in some cases it takes a little longer.

    I'm waiting for to be "in line" now.. From being in line to get interviewed will take a few more months, right? At least we can can see some progress if status is changed to "in line". :( :( :(
