  1. We started the process while living in San Francisco and are currently in Florida where our case is being processed, but we will be moving to NY by the end of the month.

     

     

    I have my interview scheduled to adjust my status in the end month and since my wife (US citizen) and I applied, she lost her job and has been on Unemployment for the last month while waiting for a job to come through in NY. If she doesn't get a job before our interview, will I be denied? We completed the I-864 Affidavit of Support with the I-485 packet in August, which has lead to us getting this interview. All paperwork has been provided. Do we still need to bring the most recent pay stubs (as listed on the 797C Notice of Action) even though it says not to bring the 864 if it has already submitted? 

     

    We are both financially stable and are worried this period of unemployment will affect my eligibility. 

     

     

     

  2. Hello everyone,

    My wife and I are about to send out the first package with I-130 and I just wanted to run this by the community and see if we got this right.

    Contents of package:

    - I-130

    - Marriage Certificate

    - Passport Photos (Husband and Wife)

    - Affidavit support (Couples pictures, wedding pictures, letter written by a friend that witnessed our weeding and joint account)

    - G-1145

    - G-325 for husband and wife.

    - $420 check

    Am I missing anything here? Are we ready to start the process? Looking for help and advice.

  3. I understand your point. I'm actually the CEO of my company and work most of the time on-the go.

    I still have a few more questions and would love your input.

    • We still don't have a joint bank account, but that's easy to do... should I do it tomorrow?
    • We have no children.
    • We have been dating for almost 2 years now, we both share the same religion and have been living together for over a year.
    • We signed a lease together.
    • We currently live in NYC but my wife just received an offer to move to SF in 2 months, should I apply using the NYC or SF address?
  4. I just got married about a week ago and now i'm preparing all the paperwork for my CR-1 application, since there's too much information out there I was wondering if you could let me know if I got this right.

    Step 1

    1. Fill I-130 (filled by the American spouse)
    2. Fill G-325A (filled by the foreign spouce)
    3. G-1145 (optional)
    4. Payment (how much?)
    5. Cover letter
    6. Birth certificate of the American spouse
    7. Marriage certificate
    8. One passport photo of the american spouse
    9. One passport photo of the foreign spouse
    10. Evidence of marriage (lease, pictures, marriage license, travel history, same religion)

    My question/facts are:

    • We still don't have a joint bank account, but that's easy to do... should I do it tomorrow?
    • We have no children.
    • We have been dating for almost 2 years now, we both share the same religion and have been living together for over a year.
    • We signed a lease together.
    • I'm still on a tourist visa and we are taking a cruise to the Bahamas next month for 4 days. Will I have any trouble when I come back? Should I bring a copy of my package with me to show that we already have an application pending?
    • Should I cancel the trip?
    • We currently live in NYC but my wife just received an offer to move to SF in 2 months, should I apply using the NYC or SF address?

    I understand that after a few weeks/months we will receive a package with a few more forms to be filled and sent back for the second phase and interviews.

    Can you let me know if I got this or if I need anything else? Thank you all for your support and time!

  5. You will have to show both passports to USCIS, one for the visa, the other for the name and identity. You also might need to show a name change document or explain how you were able to change your name. Birth name will be in "other names used." As long as you spell it out clearly for them, it will be okay.

    I see in your profile that you're also from Israel, correct? Anyway I want to use my Israeli name as my legal name in the US. I'm assuming this is ok, correct ? Thanks

    I'm in the process of getting married now and have a few questions about how to fill the 130 form. I have an uncommon situation and would like to hear your thoughts about it.

    I was born in Brazil under one name and immigrated to Israel at age 18 and adopted my Jewish name as my first name. I'm currently on a B2 visa using my Brazilian passport, however I intend to marry my fiancee using my Israeli passport and my Jewish name instead of my birth name.

    While filling the 130 form we were asked about my legal status in the country, even though I'm legally on a tourist visa with my Brazilian passport the US government doesn't have any records of my Israeli passport coming in/out of the country. Will I have any trouble? I'd like to get your feedback about it.
