    I had to do this because I filed 2 petitions within the 2 year mark, but mine was for the same person. Our first petition was denied and I submitted an entirely new packet and was approved but I did get an RFE for not having the waiver in the original submission. Once I sent it in, the file moved on.

     

    I had heard about the waiver, but I am worried that if later I want to do another one and not be approved for having a previous one.

    I have a curiosity, maybe you guys can clarify ... I ended the relationship with my ex-fiancé and I requested the cancellation of my visa K1 after approval ... Then he sent a letter by email to the embassy requesting the cancellation of the case. I did not schedule an interview and now we receive a letter saying the vality time has expired and they will not revalidated, and all USCIS action cloncluded cause we send letters. My case is filed with the date of the letter !! I want to know if in the future I can apply again with another petitioner for a same K1 visa and what approximate time should I have to wait to reapply???

  4. I wanted to chime in because as a fellow DR filing VJ-er in DR yes I sent everything including the kitchen sink. I understand that in other countries they see this as a problem, but I know for DR many people send money and its a bit of the norm there. It is important to understand that you must be genuine. DR is a country very high is visa fraud and over 50% of the visas are denied due to fraud. So the only way to prove that you are a bona fide relationship is to one be a real relationship and two have as much documentation as possible and having money receipts is a good thing for the country of DR. :dancing::dancing::dancing::dancing:

    Exactly, here in DR everyone who applies for a visa includes money receipts. For us here is no problem, even when we go to interview we carry a letter with all the money that has been sent.

  5. You will need to reapply and send an imbra waiver for multiple petitions approved with in two years...

    Although it's for you he still needs to send the imbra waiver.

  6. Since your question is in the main K1 Visa Process Forum, and not in the Caribbean Regional Forum, the cautionary statement had to be made. There have been postings from people interviewing at embassies/consulates in other countries where the CO denied the fiance(e) due to the perceived appearance of familly support, requiring the couple to start over with the spouse visa process. Those postings can be found using the forum's advanced search function.

  7. Tell your friend to be very careful should they choose to disclose the above mentioned gifts, money, etc. It is a bit of a two-edged sword. The CO at the interviewing embassy could determine that these gifts, etc., are for family maintenance and support (as in already married), and therefore not eligible for a K1 Fiance(e) visa, but rather a spouse visa.

    Here in DR it is normal for the fiance to send money. In fact, my approval had all this evidence!!

  8. Further to the other replies here, make sure she has good proof of relationship for interview. It is a red flag to have been the beneficiary of one k1, and then to apply for another just a year afterwards ie it may look like she is more interested in her partner's nationality, than personality, etc. So be ready to provide lots of proof that relationship is real and genuine (multiple meetings, meetings with each others families, etc).

To finish off the old K1 approved petition, withdrawal letters should have been sent to both the interviewing embassy and to the respective USCIS Service Center, containing all of the pertinent information, i.e., DOS case file number, USCIS receipt number. This should typically be done by the petitioner.

  10. As far as I understand, "she" is the beneficiary.

    From what I have understood here on VJ, the petitioner is the one who must write and withdraw the petition... someone correct me if I'm wrong?

    Though, if enough time has passed it may have naturally expired at USCIS/NVC... but there have been stories on here about even 1-2 years later a beneficiary going for an interview for a K-1 and being denied because to their surprise their first K-1 petition was still active in the system...

    The petitioner sent a letter and his ID to the embassy to cancel the petition. After they got the letter from both, they returned the package to NVC. She called the NVC and a girl suggested sending a new letter to the NVC to expedite the cancellation!!

  11. Hello, I want to help a friend who is in a situation similar to mine, I hope you guys know what to do ...

    A year ago her ex made a K1 petition which she canceled after going to interview, now she have a new couple in USA and he wants to make her another K1 petition. She made the cancellation at the embassy of Santo Domingo, the embassy returned the package to the NVC and they also asked her for a letter and she sent it , but they havent answered the email.

    Would she have problems?

  12. My ex fiance n I ended the relationship, we had a K1 Visa approved (June 2016) and did not go to the interview. I canceled the process before paying the interview (Sept 2016), we send two letters to the embassy to cancel the process. The embassy in Santo Domingo returned the package to the NVC (Oct 2016) ...

    We're talking to get back together again and we want to know if it affects us put a second petition ... Can we stop the cancellation at NVC or must pay again and send another package to USCIS??
