Good news from Manila....Churchita's K-1 visa was approved on Thursday, January 11, and she received the visas (K-1 for her and K-2 for her daughter) on Tuesday, January 16...we picked them up at the USE. I was there for her interview and I believe that definitely helped. Now we are in Chicago...just got her on 1/19/07. The interview at USE was challenging, and so was the POE experience at O'Hare in Chicago. But...we made it through everything and now we just have to plan our wedding date and then begin the AOS process.

Churchita's first experience with winter in Chicago was not a good one...she immediately slipped on some ice in front of our house and fell face forward...but she's ok. It just scared her and embarrassed her, too.

Thanks everyone for being so supportive, especially Trey and Roxy, who also were approved the same day as Churchita was.

To everyone who is still in the K-1 process...hang in there and be patient. Your time is coming, even though the waiting drives us crazy sometimes.

Please update my listing...Churchita received her packet 4 on 11/28/06. She's doing her medical at St. Luke's this week, December 5-6. I will be flying over to be with her for her interview on January 11, leaving the US on January 7. I've made airline reservations for all 3 of us (myself, Churchita, and her daughter Avril) to fly back to Chicago on January 19. We are hoping that we can pick up the visa at the USE on January 12 or the following week. By the way, for all those who are having interviews around January 11...don't forget that the USE will be closed Monday, January 15, in observance of Martin Luther King, Jr's birthday. Since it's a federal holiday in the US, the Embassy will be closed, too, along with all of the other federal offices.

I think I read somewhere on here the interview schedule gets updated every 3rd Tuesday of the month. Is this right? Like if our appointment date was not released last month then hopefully it will be released this month on the 3rd Tuesday of the month.

Once the USE in Manila receives your actual physical file from the NVC, you (Filipina fiance) will receive a "pre-interview letter," telling you that they have received your file and that the waiting time for an interview will be approximately 120 days from the date they received your file. Actually, the Immigrant Visa Unit is now saying that the waiting time is 120-150 days. My fiance and I are still waiting for an interview date, which we hope will be in January but it might be as late as February (our physical file was "documentarily qualified" on September 11). You are correct about the USE in Manila releasing the appointment schedule in the middle of each month, but they only release one month's schedule at a time. January's schedule will be released the middle of this month (November). From your timeline, it looks like Manila has not yet received your file from the NVC...so, unfortunately, you still have a lot of waiting to do. Join the club...that's what we do best around here is WAIT. It's really difficult being away from the one we love, but we have to trust that the future is in God's hands and that, when the time is right, everything will fall into place.

No, January appointments have not been given out yet. According to the Embassy, appointment schedules are always released the middle of each month. The December appointment schedule was released the middle of October, so the January schedule will be released the middle of November.

For those of us anticipating a January interview in Manila for the fiance visa, we may have more waiting to do. I called the USE in Manila last night (October 18) and the lady told me that the waiting period for a K-1 interview has now increased from 120 days (from the date they received the physical file from the NVC) to 150 days. That information contradicts the pre-interview letter that my fiance, Churchita, got from the USE, which said that the waiting period would be 120 days from the date they received the electronic file from the NVC (August 31). She said that the December appointments have all been taken, so anyone who is still hoping for a December appointment can forget it now. Also, she confirmed that they only release the appointment schedules once-a-month and that they would be releasing the January interview schedule in the middle of November. So, what all of this means is that we have MORE WAITING to do. She said the December schedule, of course, is affected by the holidays.

They say "patience is a virtue." If that is the case, then I am becoming more virtuous by the second. All we can do is pray and hope that we all get our interviews sooner than later. WAITING IS SO HARD!!!

Hey, thanks everybody, for all of your help. Churchita got a new NBI clearance yesterday and it is for travel abroad, with the notation "No record on file." I hope this is sufficient now. We are still waiting patiently for her interview to be scheduled. USE in Manila received all of our files on 9/11/06. We were hoping to have her over here for Christmas, but maybe it will be January. Anyway, thanks again.

Could someone who has been through the K-1 interview in Manila give us some guidance, please? My fiance has already received her NBI Clearance and the notation says "No Criminal Record." BUT...the K-1 instructions included in the packet which the USE sends out read, "An official letter of explanation from the NBI is required if an NBI Clearance has any of the following notations: 'No Criminal Record,' 'No Criminal Conviction,' 'No Pending Case,' or 'With Derogatory Record.'" Since my fiance's NBI Clearance does have the notation "No Criminal Conviction," we are in the process of trying to secure this letter of explanation, but the NBI in Cebu has told her that the NBI in Manila is where she has to get this letter from. Is that true, or can the NBI in Cebu issue that letter? We are equally puzzled as to why the USE would need a letter of explanation anyway, since "No Criminal Conviction" would seem to be self-explanatory. So we need the counsel of someone who has already gone through the interview in Manila. Is this letter necessary and does my fiance have to go to Manila to get it?

I was engaged in a long conversation with NVC tonight. The advice from there is, expect to wait 2 weeks minimum for case receipt.

Of course, at first I got the "party line" 2-4 weeks. However, with further "drilling" I was advised that it is 2 weeks minimum right now.

Bottom line, expect a minimum 2 week wait for any action after approval.

Did you expect less, following this backlog? I guess I was hopeful on that. Wrong!!

No, 2 weeks for the NVC to receive it and assign a case number. Mine was approved by CSC on 8/10/06 and NVC received it and assigned it a case number on 8/24/06. -- TimR

Two weeks exactly...that's how long it took from the time CSC approved our fiance visa petition on August 10, 2006 to its receipt by the NVC. I just called the NVC this evening, August 24, and they gave me the case number...HOOORAY! And they said they would be sending it on to Manila in 2-4 weeks. Progress is being made...thank God!

Yeah, I hear you. I'm getting very frustrated, too. My fiance visa petition was approved by the CSC on 8/10/06, I received the NOA2 in the mail on 8/14/06, but NVC still has no record of it, as of 8/22/06. I thought the Department of State was supposed to be so much faster than USCIS, but that is not proving to be the case. What's even more frustrating is that no one will tell you anything and no one will do anything for you. The NVC will not call the CSC for you, and when you call the USCIS customer service number, they will not call CSC for you. They even told me that they did not have a phone number for the CSC. Now how ridiculous can they get???

So now, I am stuck, not knowing if CSC sent it on to the NVC or if it is still sitting on someone's desk in California, or maybe it is sitting on someone's desk in New Hampshire. Why do they want to keep us in the dark???

Guess what was in my email inbox today??? That's right...our NOA2...OUR CASE GOT APPROVED on August 10, 2006. Our NOA1 was May 1, 2006, so it is obvious now that CSC is not going by the original receipt date. They received our RFE on July 13, 2006, so I believe the RFE received date is the one they're using now. Originally, Nebraska had told us that the processing time would be 80-110 days. Well, they weren't far off with those numbers, because CSC approved us on Day 102. Thank you CSC for finally getting your act together!

And for all of you who had NOA1's before May 1st, HANG IN THERE! CSC is working, even though it doesn't seem quite fair the way they are handling things. YOUR NOA2'S ARE COMING!

I was trying to access the case status page all evening and it wasn't letting me log in, I checked it a few minutes ago to see that I was touched today! Hopefully this is a good sign! I didn't notice any other Thursday touches.... am I the only one?

I was touched, too, on 8/10/06. They have touched me quite a bit recently...7/31/06 (after sitting there with nothing for several days after they notified me of RFE receipt on 7/13/06), 8/1/06, 8/7/06, and now 8/10/06. Their RFE email said preliminary processing had been completed, so I wonder what all the touches since mean. Hope it's good news and that NOA2 is on its way. We're now at Day 103 since NOA1 (5/1/06). -- TimR

Originally when I received NOA1 from the Nebraska Service Center, prior to my petition being transferred to California, the processing timeframe was 80-110 days. It is now almost 90 days and I see no recent movement on my petition. Please advise when this will be approved and sent on to the NVC.

Good news, folks. I just got my IMBRA RFE today in the mail from CSC. They also sent me emails and updated my status. And...believe it or not...I got a personal reply from one of the customer service people at CSC, telling me when my RFE had been mailed, in response to my inquiry.

Things are looking up a little bit. Let's all keep the faith!

Several posts have mentioned that people have emailed the service centers regarding status updates, etc. Where do you find these email addresses for the service centers? I need to get the California Service Center email address. Can anyone help me? Thanks.

First off, Hello to everyone I am new to your forum and this is my first post. I just submitted our 129F petition last week to the Ca. center. They will probably be sending back to me or request information concerning the new law. First is Cherry Blossoms fall under International Mail Order Bride Site? Second, back 20 years ago I had a really bad year. I recieved a DUI the day my grandmother past away then a few weeks later I walked in on my live in girl (not wife) and a fight broke out. I ended up going thru a diverision program which I think was to keep this out of my record.

Tomorrow I am going to our local police to get them to run a crimnal back ground check on me. If this does not show up do I have to report it? If it does what is going to happen? That was twenty years ag. I am not even close to being that man. Will they deny our petition for a mistake made 20 years ago? That really is not fair. I know the Lord has forgiven me but now I have to see if Home Land Security will.

My understanding of IMBRA and how it affects those of us filing a I-129F Petition for Alien Fiance is that the USCIS wants alien fiances to be aware of who they are intending to marry. Some petitioners might have chosen to not reveal any prior criminal convictions to their fiance, specifically violent offenses, and USCIS intends to reveal such offenses to the foreign fiance upon interviewing at the appropriate US Embassy. I do not see this new law and revision to the I-129F as being an attempt by Congress to block American citizens with convictions in their backgrounds from marrying their foreign fiances (at least, I hope I am right, because I do have a conviction in my background). I would suggest you go to the USCIS web site (www.uscis.gov) and read the public notice of this change to the fiance visa process (the link is located on their home page), and also look at the newly-revised I-129F petition...it lists the offenses which you must report and provide certified documentation on.
