    USCIS Immigrant Fee Payment Date:  April 10 2023

    Entered POE: May 19 2023

    Card in production: June 17 2023

    Card in production ** again ** July 14 2023

     

    We are traveling tomorrow for medical emergency.

    Does he needs to be at home to get the physical green card ?

    Can someone else can receive it for him ?

    Does USPS - deliver in the mail box without any complication ?  

     

    Did anyone experience with two Card in production dates?

    Do you know - when does the one year starts ? 

    • The date the visa was approved. In that case he has until April 10 to come back 
    • The date the of Port of entry . in that case he has may 20 to come back

    I am worried how long it may take to take care of his medical emergency. 

    Also - when the green card arrives, if I take it to him back home , does it help ? 

    I mean he can use the green card to come back ? That gives him couple extra months

    Hello guys , 

     

    Anyone around San Francisco area (San Jose ) waiting for green card ? Or has port of entry around may 19 ? so that I can get an idea how long it may take or 

    we are in an unusual case. 

     

    It's for my dad. We are still waiting for the physical card.  No luck so far.

    He just had a medical emergency and we had to go to the ER. 

    And, the traveler insurance we have doesn't cover almost nothing. So wondering if its better to go back home where he can get proper medical care. 

     

    I have been trying to call USCIS for infopass but there is no luck. 

    The automated AI agent circles around and hangs up on its own.

    I removed the condition on my two years conditional green cards with abuse / extreme cruelty waiver.

    I got my conditional green card in nov 2013. I believe I am eligible for citizenship now as its three years now. Tell me if I am right on this. Please

    I am not divorced yet. and not in contacts with my USC spouse.

    The documents I submitted during ROC was ..

    - personal statement - 20 pages describing abuse

    - psychological evaluation stating I have symptoms of PTSD

    - counselor letter showing 9 visits during the time frame of abuses

    - message exchanged between me and counselor during abuse period

    - letter from two school official who are aware of the abuse and who saw my situation during those period

    - letter from three friends with whom I shared the abuse

    Now that I want to file for N400.

    What documents I need to submit ?

    Do I need to resubmit all the abuse related documents again ? I submitted the original copies during ROC. Can I submit the copies now ?

    I hope that your story of the abuse is MUCH more than what you are writing here because I do not see any abuse, kicking you out from his house is not abuse, it's "an unpleasant situation", telling you that he is the only person that can file for your green card is not abuse, it's just his opinion.You said that you entered using a tourist visa, you stayed in his house and he didn't give you enough food, this is not enough to have a VAWA case.

    If you were not diagnosed with major depression and /os post-traumatic disorder your chance to have your case approved is very small.You probably will get an RFE requiring proof of the abuse,and if you get the RFE you must attend at least 5 therapy sessions and have a psychological evaluation done, and if the evaluation is not specified that you are suffering depression and/or anxiety/post traumatic disorder then USCIS will not approve your case.As I said you might be abused, but usually, when people are abused they mention what happened here and we have an idea if the person was abused or not and reading your posts I couldn't find any circumstance of abuse.

    If your brother was abused in the U.S and left to the Philippines then he has to prove to USCIS the connection between the abuse and the reason why he left the U.S, if his life was in risk here etc..

    Hi all

    I just wanted to update my thread for those who might come across it looking up info on the topic...

    I did become a US citizen, based on 3 years of permanent residency even though I was divorced from my abuser...So yes, if you have an approved I-751 based on cruelty and abuse, you ARE eligible to naturalize as if you were still married after 3 years of permanent residency.

    The interviewer may tell you otherwise, just inform him/her of the above memo and it resolves the situation. Many USCIS officers are not aware, although they mean well...

    can you please share your package contents ?

    Do I still need to submit all the proofs of the abuse again which I submitted two months ago ?

    I already gave them the originals ..

    Citizenship after Green Card with Abuse Waiver

    Hello Friends,

    i got my conditional green card on Nov, 2013. The condition was removed on Sep 2016 using abuse waiver.

    I am not divorce or legally separated yet but haven't been living with my abusive USC spouse for last two years.

    I understand I Can apply for Citizen ship N 400 right now .. Can someone confirm me and provide me a guideline on what documents I need to submit for citizenship ?

    I was in the same boat as you friend is.

    the list of document I submitted before RFE ( originally )

    - police report ( case was not pursued since I didn't cooperated with the DA and wanted to save my USC spouse)

    - 2 sentence report from my counselor saying I discussed marital problem and abuse to my counselor

    - a personal statement

    I got RFE and I did a major revision of my personal statement ( which I believe is one of the most important piece here)

    Other things I submitted was ..

    - a psychological evaluation from a new counselor who stated that I am suffering from PTSD

    - two letters from school officials stating my condition during the abuse period

    - three letters from friend with whom I have shared abuse

    I got approved two days after they received the RFE response from me.

    I am not divorced yet or not even legally separated. technically I am n ot with my USC spouse for more than two years.

    and during this time I worked really hard to stabilize my mental and emotional and physical well being . .. this is the most important thing.

    God bless your friend or whatever. its hard and really hard but this will all be over.

    Can you track the card by using online case status? If it's delivered and not there, perhaps you can do infopass and see if the IO can request it to be sent again to new address, or I-90 for a lost card.

    Yes I called USCIS and they asked me to wait 30 days to doing infopass or I-90.

    Its weird .. .lets see if I can get hold on my card. I just want to go home and see my parents who are not physically well . it has been so long and I am glad that they are still alive.

    Does anyone know if I can get a stamp on my passport on approved green card ?

    i submitted

    - police report where USC spouse was arrest for a misdemeanor and a felony. I didn't pursue the case. the police found a cut mark in my face

    - another instance she choked me and her finger nail went inside my neck. i took a picture of my neck and i submitted it

    - a short summary of my counselor where it states i was abused physically and mentally and my privacy was violated multiple times.

    - a self written letter stating all the abuses or torture

    I am not filing based on waiver of abuse and I still got an RFE so it may not be because of your circumstances. What evidence did you submit the first time? Maybe someone on here can help you with ideas of what else you might be able to send them.

    How to know if My case has been transferred to VSC ( Vermont ) ?

    I have filed an waiver on extreme cruelty. Based on many posts here, I got the understanding that these type of ROC cases are transferred to VSC?

    I haven't received any papers or text or email about that since my bio metrics was done in december 22nd, 2015.

    I applied ROC I751 with waiver about 5 months 17 days ago.
