  1. Good Afternoon,

     

    My wife's green card expires on 05MAY2019 and in early January we received a letter from USCIS saying to send her application in to remove the conditions on her green card.

     

    We sent the package to USCIS and they received it on 30JAN2019 and we received the package today in the mail with a letter saying it was sent prior to the ninety day grace period. We are now within the ninety day grace period and my wife and I are bordering on panicking. I saw a green sheet in the package saying to put that page first when we send the package back.

     

    Is she in danger of her application being rejected because it was received during the ninety day grace period instead of the beginning of the grace period?

     

    I found a customer service phone number on the documentation and I will be calling on Monday when I get home from work; any first hand experiences from people who went through this are much appreciated.

  2. Good Morning Ladies and Gentlemen,

     

    At the end of 2016 my wife and I submitted her AOS package (I-485, I-765, and I-131). Last month she had her biometrics appointment. Earlier today I was looking at something and saw a Form I-130 with a $535 filing fee. 

     

    I thought I was thorough in my research for all the forms and fees and somehow I never saw this form listed. My questions are as follows:

    • Is the I-130 truly required for K1 Visa holders Adjustment of Status?
    • If this form is required, will it stop her other forms from being processed?
    • Is it too late to submit this form?

     

    I think I am more upset than my wife, because she is anxious to start working, because she does not like sitting around the house all day. I'm sure she is upset, because we will have to get creative to come up with the extra $535.

    My wife has all her forms filled out, with the exception of her I-131. We do not have any trips planned and she was thinking of doing this form, G-d forbid something happens to her family back in Vietnam.

    Can this form be submitted incomplete with the note we do not have trips planned but want the ability for her to return to the US, if she needs to make an emergency trip to Vietnam?

    I'm typing up the final copies of my wife's Adjustment of Status form. I'm not sure which date to enter on the "Expires on mm/dd/yyyy" question at the top of the first page. Her visa has two dates, expiration of petition and expiration of visa. I am guessing we put in the expiration of visa, but I want to verify it with the folks here.

  5. Good Afternoon,

    My wife is here on a K1 Visa from Vietnam. We were married before the ninety days. We are working on the Adjustment of Status and other documents.

    I have several questions:

    • My wife served in the Vietnamese Army for one month while in college. She tells me all her classmates had to do this. She said she received no weapons training. I confirmed this at the range a few weeks ago. Does this need to be reported on I-485 Part 3C (p3), question 15a (p4), question 18 (p5)?
    • She received a medical exam just prior to her visa being approved, but she elected to receive her vaccinations in the States. She just got added to my health insurance and has an medical exam scheduled for early December. Do we need to wait for her vaccinations before we can send in the I485?
    • We were married well before the ninety days and she is asking me if we need to worry about the petition expiration date and the visa expiration date that are on her visa. I honestly do not know what the answer to these questions are. I figure we are safe because we are planning on submitting the package before the ninety days expire and we have a marriage certificate.

    Any assistance you can provide is greatly appreciated!
