The affidavit of parentage only applies if you were born after 1986, if you were born before that and your father legitimated you prior to that date you already have us citizenship.

see section 7 FAM 1133.4-2 Birth Out of Wedlock to American Father under "old" INA(remember this is just the case if you were legitimated before 1986 and according to the laws of your country).

Thank you so much for your answers, yes I know about the physical presence, he lived 50 years there, so it not a problem in fact, I was able to find the documents I needed, in my country there is no legitimation, children born in wedlock or out of it, is the same thing(inheritance, surnames, etc), so I don't have a problem with that also, the father just signs a paper acknowledging fatherhood. I have also his driver license from back in 1985, so that would show that he was int he same country than my moms when I was born. I dont know what else to show.

Hello, my situation is like this, I was born to an US citizen(by birth) back in 1985, out of wedlock, my dad died when I was a child, so he never filled the CRBA and never applied for a passport for me, after 30 years, I realized that maybe I acquired US citizenship at birth, so I consult to the embassy here, and they told me to bring the same documentation required for the CRBA to the passport interview, so my questions is what kind of biological relationship can I bring to the interview, I don't know if my case is strong enough I have his divorce certificate from the US(1983), after that he moved to CR and start a relationship with my mom but I don't know how to prove it, both were single at the moment, but I don't have photos from pregnancy or cards from him to my mom, after a few years, he signed to my mom a power of attorney over finances and also signed a few documents to give her control over his bank accounts, and he called her his wife on those documents even that they were not married, I received my home as an inheritance from my dad also, and my mom also, but I don't know what other proof they can require, can someone give me advice here?
