  1. Greetings VJrs,

    My wife and I filed her AOS, EAD and AP applications a little over a year ago and while the EAD and AP were approved in about three months, we are still waiting for I-485 (green card) approval pending FBI name check.

    We will be travelling to Colombia to visit her family in May 08 and, since her original AP will expire 1-31-08, we need to re-apply for the travel document in case her green card doesn't come through by that time (hey, miracles do happen). :rolleyes:

    Do I need to pay the filing fee again, as in the original? I seem to remember that there is no extra filing fee to *renew* the AP travel document, but I can't seem to find this information in the new filing fee schedule.

    My wife came here to the U.S. on a K-1 visa and we filed for AOS, work authorization and advance parole together in Nov. 06.

    She received the work authorization and advance parole in Feb. 07.

    We have a straightforward case (no problems that I know of anyway), and after a service enquiry and Infopass appointment, were told that we are just waiting on FBI namecheck. :whistle:

    We haven't received any RFEs (yet), so we're just waiting...

    My wife and I plan to travel to Colombia to visit her family in May 08, but her advance parole (I-512L) expires 1-31-08.

    Of course, it would be wonderful if she gets her green card before that time, but who knows if that will happen or not.

    So, what do I need to do, apply for advance parole again? Another Infopass? Would a call to the 800 number be any help at all?

  3. I know there's nothing to do at this point except wait. :whistle: I just wanted to see if there's anyone else out there who filed for AOS in Nov. 06 and is still waiting.

    I noticed the processing dates on the USCIS website shows that they are processing I-485s from Jan. 13, 07. (Did I get left behind?!)

    I also found that all of the couples that have similar timelines have already been approved (except one).

    At what point should I request an Infopass appointment to see if everything is Ok?

    I'm wondering also if RFEs usually come within the first few months of filing or are they just as likely to come eight months after filing. I'm hoping not to get an RFE of course; I'm just curious, at eight months since filing, is it LIKELY that I would have already gotten an RFE, or is it still a good possiblilty I could get one?

    Thanks for any enlightenment/encouragement while I wait.

    Could someone please tell me how you know when your case has been "touched"?

    Do you always receive an e-mail, or does this just mean that the date in the "last updated" column on the USCIS website Case Status Online is changed?

    I searched VJ but couldn't find a description of this. Where on VJ can I find a definition of "touched"?

    I'll try to make this a concise as possible. I'm new to this site and I'm sure I've missed a lot of info that is available on this site. I just haven't had much time to research this site.

    My wife came to the U.S. on a K-1 visa on April 30. We married a month and a half later on June 14. A short time later (about a week) we applied for and received her SSN/card. I plan to send off the application for AOS in the next couple of weeks.

    Her English is still a work in progress, although she is coming along very well (she's from Medellin, Colombia). It will prob. be a while before she will be able to pass a driver's license exam, but I did want to get her a state ID (GA). I called the driver's license services for GA and was told that I needed the SSN, passport, I-94, and her birth cert. (translated). No problem.

    So, we went to the driver's license office with all the required docs, but the officer noted that the expiration date on the I-94 was the same day we were there (July 31, I think). He told me that he could issue her an ID, but that it would expire the next day, since the I-94 expired that day. This made abolutely no sense to me and I tried politely to reason with him. Now, I was told by USCIS that once the fiancee enters the country and marries within the 3 months, the I-94 expiration date is no longer relevant. I was also told earlier by two separate USCIS reps that once the fiancee is married there is no real time limit (sorry that's not the right word) for applying for AOS.

    The officer at the driver's license office told me that there is a new rule (GA only?) that they have to put in the I-94 expiration date on first-time applications for driver's licenses or IDs, so I would have to wait until I had her Green Card.

    I know that having an ID/driver's lic. is not the most important thing right now and that it doesn't really have anything to do with the visa/residency process, but I thought it would be useful to have and I know of a lot of other people here from other countries have gotten their state IDs or driver's licenses with no problem.

    Am I missing something?

    Any insight/suggestions would be greatly appreciated,

    My wife arrived in the U.S. from Colombia on April 30 of this year on a K-1 Visa.

    We were married a month and a half later, and have just now received her Social Security card in the mail.

    I'm working on getting the paperwork together to mail off the AOS packet, and hope to send it off in the next 2 or 3 weeks.

    I called USCIS a few weeks ago because I was a little concerned about being late on the AOS app., but I couldn't find any reference to a deadline in any of the instructions that I have. The USCIS rep. told me that once the fiance(e) arrives in the U.S. he/she has three months to get married, but beyond that there is no deadline for sending off the AOS application.

    I'm sure there would be consequences if one waited too long to do the AOS, but was the rep. correct in telling me this?
