  1. I just wanted to give everyone a little bit of hope. :)

    My husband's I-485, I-131, and I-765 were given a receipt notice of October 31, 2006. We ended up getting a RFE and it took us one month to get everything together. (Some where while we were getting the RFE info together he had the Biometrics in mid-November) Our notice of action was dated December 14, 2006 with the RFE docs.

    We just found out that the I-131 was approved January 12, 2007 and the I-765 was approved January 18, 2007.

    So it took just over a month to get everything approved. (By the way, the I-131 and I-765 are at the MSC and the I-485 is in California.)

  2. Being transferred to California for your AOS is actually considered a good thing since virtually everyone who is transferred is approved without an interview! Since you have already received an RFE for additional information before your file was transferred, your file is probably now complete and is considered straight forward for processing. While the time taken to approve it varies it is more common for the approval to come within several weeks of being transferred rather than several months. Has your husband had his biometrics appointment yet to take a photograph and all his fingerprints? If so, you could receive it quite soon. If not, then he will need to do biometrics first. As others have mentioned, your husband can work once he gets the EAD or the AOS greencard. It is quite possible that the AOS will be approved before the EAD and the AP, especially with a transfer to California. The same thing with travel - once he gets the AP or the AOS greencard he can leave the country and safely return. So, reassure him that he doesn't have to worry - things are definitely moving in the right direction.

    Thank you so much hun! My husband has had his Biometrics exam back in November. The approximate order of events:

    October 24 - Sent 485, 765, 131

    October 31 - Receved 797Cs for 485, 765, 131

    November 9 - Received the strange RFE - we think it had something do with needing additional verification of my income & tax returned

    November 16 - Biometrics exam

    Thanksgiving time - Sent info for RFE

    December 14 - Informed our file was being transfered to California

    Do you think things are moving along or they are playing with us!?

    I really hope we get good news. You guys have no idea how much I want to go to France with my NEW husband!! His sister just had a baby... the food is sooooooo good... and Paris. Need I say more?

  3. Originally we sent our file to the Chicago Lockbox, then it was went to Missouri, now it's in California? Does anyone know how much this is going to delay the processing?

    We sent the 485, 765 and 131 October 24, 2006. The USCIS sent us a strange letter basically wanting more information about the taxes I filed in 2005. I sent that...

    It looks like the 765 & 131 haven't been touched since November 3. (Are they in Chicago or Missouri??)

    Does anyone know what is going on? My husband is freaking out because he needs to start working.

  4. I'm American and my fiance is French. I filed the I-129F in January. The NO1 is dated February 2, 2006. The NO2 is dated April 18, 2006. Our file was sent from the National Visa Center to the American Embassy in Paris on May 5, 2006.

    Late May I was getting concerned because my fiance still hadn't received packet three. The Embassy faxed me a few days later saying, "We haven't received your file."

    Actually they DID receive our file..... and it was received back at the National Visa Center May 25, 2006.

    I tried tracking our file, but it was clearly lost because of the new IMBRA law.

    I contacted my senator's office and "apparently" the file was sent back to Paris June 23, 2006.

    STILL NO WORD ON PROCESSING....

    IS THERE ANYTHING I/WE CAN DO? This is ridiculous!

    We had to cancel our August 17, 2006 wedding. His family will be here in a month, but he won't. HELP HELP HELP!!

    This seems to be a helpful resource for many people looking for help regarding the K1 visa.

    I don't want to make things too complicated, so I will keep it brief.

    I am American. My fiance is French.

    USCIS sent us our 797C Notice of Action dated February 2, 2006.

    USCIS sent us our 797 Notice of Action dated April 18, 2006

    The National Visa Processing Center approved and sent our file to the American Embassy in Paris on May 5, 2006.

    Somewhere between May 5 and May 25, 2006 the American Embassy DID receive our file.

    But, on May 25 2006 the National Visa Processing Center received our file from the Embassy... During which time (May 5 to May 25) I was worried the Embassy didn't receive my petition, so I faxed them. They informed me that they didn't receive my petition.... but they DID receive it!!

    USCIS-Nebraska hasn't contact me at all about this situation. I feel helpless and don't understand what to do. I went to USCIS in Milwaukee and they too have no idea where my file is. NOBODY KNOWS.

    What should I do?

    HELP!!!

    (I did contact my state representatives, but no word on any of their findings.)

  7. I filed the form I-129F and was received February 2, 2006. It was approved by USCIS (Nebraska) April 20, 2006. The National Visa Processing Center approve my file May 4, 2006.

    We are currently waiting for packet three, however, my fiance has yet to receive it. I faxed the American Embassy (Paris) to inquirer further about the situation. They wrote:

    "In reply to your inquiry about the status of your fiancé's approved I-129F petition, the Department of Homeland Security, US Citizenship and Immigration Services is conducting a new procedure on all K1 visa petitions. Therefore, we have not received it yet."

    Apparently the Embassy returned our file to USCIS (according to the National Visa Processing Center) May 25, 2006.

    Do you know anything about this particular situation? Is it possible our file was lost?
