  1. I really feel bad for my friend Katy, but I don't know what can I do to help her, please help!

My friend is a nice lady, she came to the States to marry her husband 2 years ago, they had no problem in their marriage until she came back to Thailand to see her daughter and family. Her husband wrote her a email to tell her that he want to divorce, and he will send all her package back to Thailand to her, told her no borther to come back. He wrote and picked every small things to tell her why did he want to divorce. My friend didn't accept it, they can't talk about divorce in the phone or just write a email! And she did nothing wrong! Before she came back to Thailand, they had no problem.

So she changed her flight ticket to came back to the States, she didn't have a driver license, so she called him to pick her up in the airport.( even just a friend, if people need help, you will do it, right), but he refused! I had to pick up my friend, and took her home. When she got home, she found every single of her stuff was packed and put in another room. She tried to work things out, but he didn't talk to her and just completely ignore her, and he didn't want to file that remove conditional green card for her of course! Even she need a ride to go out to get food, he didn't take her. She didn't eat for 2 whole days because he didn't take her to get food! I can't image a woman in this age would still have to deal with this emotional torture!

I think this can be domestic voilence, and I also think this guy planned all these. Maybe he already has another woman! What he wanted to do is to metal abuse her until she couldn't stand and go home. What kinds of people would do this, bring a woman from another country, then mental abuse her and try to abandon her! I know she should leave him, but I think she also deserved her green card!

Please help her and give her some advice, thank you!

  2. It's been a long time since I last posted anything on Visa Journey. I remember going into the consulate interview and being gratful that we had been granted my green card and very happy. I got a job and started to becoming a paying taxes. Then - we became not so happy. My US husband filed for divorce 119 days after I moved in. I lost my new job and had to move in with freinds. Ex- hubby has been charged with a domestic violence charge (misdemeaner) and attemped burglery (felony) as he thought it was okay to force into my room that I now call home.

I spoke to my immigration lawyer and he says I'm ok and that my I-751 can still be filed with a waiver without ex-huband. Can anyone tell me if you on removing the conditions and requesting your 10 year PRC do you still have an interview in attend for this approval or do they just look at the paper documents as submitted and make the decession based on that.

  3. Good Moringing... in answer to your question I too filed my Canadain taxes. I went to H & R Block. Cost was $80.00 CDN included taxes. What they do is the following: They have to by law show that you are married and you have a spouse. You will NOT apply for any spousual credits. This would increase your refund ... but if you do this it's a no no no - you would be defrauding the CRA. You CAN NOT say that you are separated and don't let them convice you otherwise. This will screw up your immigration procedure and if they check info about your spousce it will look like you are only trying to get into the country for a green card. I filed on March 01 and recieved refund on March 16 even with there computer shutdown this year. You will also need to provide them whit the name and address of your husband/wife that they can cross referenecwe. Your US citizen husband will do the same... however athere refunds take 6 - 8 weeks.

  4. Morning Everyone

Well tomorrow is the day. I have a 9:00 am appointment to meet with the lawyer and a 10:00 am at the US consulate. Ugggh I haven't slept in weeks (ever since I received our confirmation letter). Sometimes I feel out of control (I'm a control freak). As we are never told the complete list of events that are about to happen. Just when we think we have it all figured out something new pops its head up. My heart goes out to all those that are not able to see their husbands/wifes and have to do this procedure on your own. It lest my husband lives 22 miles away (stopped by an invisible border crossing) and I can legally go see him on weekends. I was able to purchase a cell phone from the US and we can talk for hours during the weekdays. This helps somewhat. Last night I was in a panic I couldn't find my passport (thought someone had stolen it - but I just used it two days earlier. My head is just spinning). And I have to lie to my boss so that he doesn't know that I'm taking the day off tomorrow for the interview. I've found that employors like to dismiss you before you have time to sell your home and permantely move to your new country. I can't wait to get that stamp or whatever it is in my passport. (Duell citizenship in two countries). Just one more step completed in the long list of things to do.Does anyone know the procedure at the Vancouver BC consulate office... you info would be appreciated.

  5. Wow can't believe that the LETTER arrived today our interview date is March 21/07. Not sure what to expect as its in Vancouver BC Canada. I've learned over the past months not to get my hopes up to high as things seem to change at the last minute & the results are not as I think they should be.

I thought the envelope was going to be some fancy formal letter and it wasn't even signed. Looked like a generic preformed letter guess it saddens me that they are still using my piror name and not my married name. The lawyer seems to tell me it's Okay but I still feel sick that its always wrong. maybe I'm just thinking to much.

  6. Yodrak thanks for your reply. The difference is .... I assumed that processing starts when packages arives in Missouri. If the cheque was cashed in Chiacgo and then mailed to Missouri ( a whole new state) this would slow down processing. It never occured that these are sent via over night by FedX. Anyhow thanks for your remark. If I knew all the answers I wouldn't have to ask

    macburt,

I believe that depositing the checks is one of the functions performed by the Chicago Lockbox. But I fail to see the "big difference" that you mention.

The Chicago Lockbox is the incoming mailroom and sorting station for cases processed by the NBC. Once the mail has been opened and the case files have been assembled in Chicago, all of the files are shipped to Lees Summit for processing. What difference does it make which location deposits the checks?

    Yodrak

.... does anyone know if the cheque for the I-129F is cashed at the Chicago lockbox in IL or would it be cashed at the National Benefits Center (NBC) in Missouri at the NBC center?? Since these locations are in two different states this makes a big difference. Because the package would now have to be sent to another state Missouri.

Oh is is so hard to figure out. Someon please help me

Thank you for your kind answer... I very much appreicate this

With the advent of delivery services such as Fed-Ex, UPS, DHL and the like, it can absolutely positively be there (to MSC) overnight.....
  7. We have sent the I130 last week, I wonder how often I can cross the border to see my wife, I work and live in canada and my wife is in US (50 miles away from me).

Is there a limit to how often I cross to see her-in other words will the immigration personnel let me cross everyday or will it become a potential problem for me and the application process (I assume I can't stay with her even if I prove I'm actively employed in Canada).

    2nd question

Our intent is for me to continue working Canada while living in US, with this in mind will we be able to use my income as part of the support requirements??

    Thanks for any help-

    Hi Rob & Clara

I too have a I-130 & I-129F pending. I cross the border every weekend to see my husband who lives 22 kms away. As long as I prove & maintain my Canadian residence proof of my hydro, pay stubs, mortgage papers etc and the magic words Is you are going to VISIT her wife/husband you will be okay to cross the border. However, just last night I was stopped at Sumas POE and they ran my I-797 in the computer they kept me for 40 mins waiting. Because I came down on a Thursday and not the usual Friday evening. They questioned me on the extra day I was using for my VISIT my husband. You must maintain 51% in Canada until your Visa is approved.

As for the second part of your question- no you will not be able to use your support for requirements. support is deemed by the US citizen that he/she can support you and you are not a charge on the US state.

  8. After a long wait we have just checked to see that our cheque for the I-129F has been cashed at our bank. Our question is: Now that our I-130 & I-129F have both been viewed and both cheques cashed does anyone know if the cheque for the I-129F is cashed at the Chicago lockbox in IL or would it be cashed at the National Benefits Center (NBC) in Missouri at the NBC center?? Since these locations are in two different states this makes a big difference. Because the package would now have to be sent to another state Missouri.

  10. Hi Dead PoolX

Replying to your question... I am a Canadian who married an American August 20, 2006. On the advice of my lawyer he told us to marry. So I took a week holdidays and crossed the boarder on a Friday night.... and at the time of crossing they asked the standard questions how long are you visting, what are u bringing etc....

I told them I was visting my boyfreind and that I would be staying one week on holidays. I was not married at the time of crossing. We married two days later. (Remember you tell the truth at the boarder and only answer the questions they ask you.. don't be foolish and give more details or flawnt it in their face.... boarder guards don't like that)

I Showed my passport and entered into the country.

It is not legally to marry an american. As long as you are not trying to STAY WITH THEM before your PR card and visa are ready. You can continue to cross the boarder.. the key words in crossing the boarder is "I'M VISITING my husband for the weekend !!!!

I have to show that "I have not left canada and I HAVE ties to the country. I carry my mortgage, paystub, hydro bill, and my lawyer contract.I cross the boarder very weekend to see my husband.

Hope this helps you.... and congrats on the wedding. if I can help any more email me back

  11. Hi Everyone...Welcome to us!!!

After much consideratin we married on August 20/06. Then off to the lawyer on August 23/06 to file our K-3 Visa and our I-130 and I-129F both at the same time. Doing this ...we stop the I-130 so that we can be interviewed in Seattle and Vancouver BC Canada. We should recieve our receipt within 30 days and our interview within 120 days for the next step.

We are told that I need a medical and fingerprints piror to the formal interview.

this is just the start of our process.... more to follow
