  1. Hi guys, I need your help. I'm currently 4 months into my conditional residence. My husband physically abused me last November, and he has been cheating on me since. We also have fights about daily about the most mundane of things. I'm thinking of leaving him, but I'm scared of what would happen with my residency.

    1) I know I can go the divorce -> waiver route, but I'm scared that my evidence for good faith marriage won't be enough. I mostly have some pictures, and bank accounts to our names.

    2) If both of us just agree to live separately, would this be a viable option for when the time comes to apply to remove the conditions?

  2. Thanks for the replies. I took pictures of the grazes that I had, I was just wondering about going to the doctor to assess that my injuries weren't self-inflicted: if they do that and i disclose that I was abused they would take action against my spouse, right?

My boss is taking me to see one of his friends who is a counselor to see what kind of help I can be provided with. I'm just scared of losing my status when this all blows over. What kind of further evidence would suffice? He has also verbally threatened me thrice before.

  3. Hi guys. I received my conditional green card last Sept 23, and today, Oct 24, my husband physically abused me. We had an argument and it escalated physically. I want to leave him, but I'm scared that my residency would be revoked if I did so. That, and all of our possessions are co-mingled (also financial ones) so I'm scared that I would be penniless. I don't want to involve the police as much as possible, but I do want to leave him. Should I go for the I-360 route? I'm not sure if that applies to me anymore since I already received my green card.

Any advice as to what processes to take would be appreciated.

  4. Hi guys,

On Sept 23, 2016, my husband and I received email notifications from USCIS that both our 485 and 130 were approved, and that they've ordered a new card. However, today, Sept 27, I received email notifications that they "received withdrawal request for form I-130" so they did, and then another one saying that they denied the 485. My husband and I never submitted this withdrawal request, so we're both panicking right now.

Any help would be greatly appreciated. Thank you.

  5. Hey guys! My husband is petitioning for me. He is a US citizen, and we met over a year ago while I was traveling in the US. We got married last November 2015, and now we're preparing everything for the petition. We are now living together. However, I'm quite overwhelmed by the amount of paperwork and the forms, and I was wondering if you could help me out.

I have basically filled out the Form I-130, I-485, 2 G235As, and I-864. Now I'm confused as to a few things:

    1. Should I file a I-765? Or would I automatically get a work permit once i get a SSN? Additionally, I saw somewhere that you can file 765 concurrently with the 485, and that there's no additional fees anymore when you do so (aside from the original filing fee for the 485). I can't find the website anymore, though. So I might just be imagining things.

    2. We have a lot of pictures detailing the relationship, I was wondering how many pictures, text logs and all that stuff do we need to make the "bona fide" marriage? Is it better to have sworn affidavits? Do I need to submit these from the get-go, or is it better to wait until the interview?

2.a We're planning on submitting a tax return with both our names on it (we filed jointly) plus a bank statement showing my name on the account. Would that be enough?

    3. Should I file for I 131 as well? I have overstayed my B1 visa a month after we got married. I have asked my lawyer and she said it doesn't really matter anymore, because it's not about visas when we get married.

    4. If we're filing the AOS and I130 concurrently, would it be better to pack them in two separate folders, and then put them in one manila envelope?

Sorry for the barrage of questions, I'm getting overwhelmed here. I appreciate your input. Thank you!
