  1. Hey guys, just curious if I am researching this correctly and would appreciate your correction or verification!

     

    My husband has his I-485 pending (fingerprint received is the status online) When I went to the USCIS Processing times for National Benefits Center I didn't see a line item for I-485 so then I went the field office section and looked up ours (Greer SC in our case) Is this the correct processing window we should be watching? 

     

    Also, does that date on the processing times supposed to compare to our 'Fingerprint received' date? 

     

    He has his EAD/AP card but I just want to be sure our case is still moving. I think it's odd they didn't schedule an interview yet and hope we could be lucky enough to just receive approval! :)

I noticed it by accident as i opened a SR that morning and then the case was approved and i wanted to see if the SR had been assigned. 

    Ah, yes, mine did that same thing. 1/11 I have New Card was produced or ordered, then it switched to Case was approved. 

     

    Does that mean they mailed it? I thought it had another status that I was waiting for that said 'Card was mailed to me'? 

  3. Hi there, I checked some of the EAD timelines and see most people who have received their approval, receive their card in the mail 7-10 days after.

     

    Our case still says 'Approved' from the 11th and we are wondering how long until it changes to 'Card was mailed' .... Or, is there anyone on this thread who received their card before the system updated to 'card was mailed'?

    When they send an RFE for any of those cases that you filed concurrently then it restarts the clock at when they received that RFE response from you! I counted from that 12/5 date in your timeline. Here is the link below that explains this rule.

    I hope they speed up and start processing all of our cases sooner!

    Congrats!!!! Happy to see a fellow UK filer get approved, hopefully we are soon after. I wonder if they categorize them by countries for those around the same date?!

     

    I checked your timeline and saw a large difference in your date filed and NOA1 and then realized we all count days from different start points. 

     

    I'm counting mine from October 17th, even though my NOA1 was October 19th, the uscis case website says they received it on the 17th.

    Has anybody on this forum spoken with an Immigration Officer on when the 90-day clock starts? I wonder if we are supposed to exclude weekend/government holidays, etc. .... Can you tell I'm bored of waiting?! :)

    Sadly, I think a lot of us are in the same boat. My guess is that Thanksgiving/Christmas/NYE all slowed down the processing of our cases with people taking time off. If you scroll back in this Filer Forum Thread a bit, you will see some approvals (in the late 80's or even 90-day mark that they received notice of approval) My hope is that we all get approved within their normal 90-day 'processing timeframe'

     

    My husband and I are at day 85 and think I will call USCIS after we have passed the 90-day mark.

I should have had it in hand already. Because then I have to go get a social security card and driver's license which is going to take time again to come in the mail. 

    Hi EmpressBab, my husband came here on the K1 Fiance visa and after we got married we went to get his Social Security Card and Drivers License soon after. We are also still waiting to hear back for his i-765, i-131,and i-485. They needed his I-9 arrival card (which we obtained a new copy online) and our marriage certificate. And a few other documents we needed to provide that we looked up online. 

     

    We live in the state of South Carolina (not sure if it is different in other states) ....but I would try to get your SSN/Drivers license while you wait for your work authorization!

     

    I agree, this wait is driving me crazy too.... I am definitely not a patient person lol :)

  9. Can someone please tell me the 90-day rule for a service request on your EAD? I have seen people counting days from when they mailed it off, when the case date is received, or their actual NOA1 date. For instance, the website says my case was received October 17th, but the mailed copy NOA1 date says October 19th. Which day do I start the count from? I plan to call on day 90 for assistance if I have not received an approval by then.

    The far right column shows dates processing based on your NOA1 of your form you are tracking

    Praying we all get our EAD's approved soon!! This Christmas/NYE time and holidays may slow us down I fear.

    My husband said that the USCIS officer at his biometrics appt. at the Greer Field Office told him his EAD card would be mailed to him within 4-5 weeks. We are definitely past that. However, since he did early walk-in on 11/4 instead of the originally scheduled appt. on 11/15 then we are counting 4-5 weeks from that planned date. Which means we should get approval notice between 12/13-12/20 .....fingers crossed!

  11. Hi all! While my husband and I are anxiously waiting for an EAD/AP I thought I would ask how long the green card we receive is valid for? I have read 1, 2, or 10 years?! We filed the I-485, I-131, and 1-765 all together when we got married. I read that after 3 years of him being here we could apply for Naturalization (N-400) but am curious if we will have to renew a green card before that? Just curious.

    You do have to remain in the US while you wait for your AOS to process. However, you need to wait an average of 3 months for your AP to process which would allow you to begin international travel again. There is a processing timeline on the USCIS website that shows this average. My husband is from England and we paid an hourly service to speak to an immigration lawyer about working remote in IT for his foreign employer and she advised against it. It is a grey area but when you file taxes and declare your pay, then it could affect you later on with your overall process to citizenship if the immigration officers chose to pursue it. She expects that in time someone would be made an example of and it would end up in a court case to declare this grey area. My lawyer advised us to be safe rather than sorry.

    We got married within weeks of his arrival and submitted the following forms: I-485 (AOS), I-765 (EAD work), and I-131 (Advanced Parole)

    The AP will allow you to leave and re-enter the US while your AOS is pending. The expected wait time for the EAD and AP cards are 3 months that you will have to remain in the US without working. I have heard that if you get a job offer than you can call to expedite your EAD but you have to meet the qualifications they set forth, i.e. would cause you extreme financial loss, etc.

  13. Hi everyone! My fiance and I hit another milestone with the NVC having shipped our visa over to the London embassy on July 22!!! The man at the NVC said that the London embassy will email me when they receive the packet with instructions.
