Hi,
Hoping someone can shed light on a question I have.
I am aware assets (stocks, savings, etc.) can be used to "bridge the gap" between the USC's income and the required income threshold... as per below. And I believe it is 3 x's, not 5 x's for a spouse.
"In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However, if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference."
My question:
Can the USC's income be $0? (unemployed) at the time of submission of the I864, and bridge the gap completely using savings (ie, meet the 3 x poverty income line just using savings)? Or does there have to be some form of employment income, regardless of how small it is, to be able to use assets / savings as part of the affidavit of support?

Hi,
Does anyone have a link to policy about how long someone can stay out of the US on a single trip abroad on AP, assuming Advanced parole was granted before leaving, and planning on returning before it expires.
I'm aware the AP can be used multiple times up until expiry, but cannot find solid info as to how long a single trip can be.
Is it purely up to the CBP officer at POE to determine if you have abandoned? Or is there a trigger point, say 6 months, that requires CBP to assess your eligibility to be paroled back into America.

Hi,
Hoping someone can shed some light on my query.
I arrived in the US on my K1, got married and have applied for the EAD/AP/AOS. AP and EAD combo card has been issued but the AOS is still pending (I have done my bios).
I have received a job offer back in Australia though and My wife and I are looking to head back there for a year or two, then return to America to settle down in 2018/2019.
I have 2 main questions...
1 - Can I abandon my AOS by informing the USCIS of what we are looking to do and not be penalised for doing this? Essentially I am wanting to make sure this will not affect any future applications we make together (CR1).
2 - Can my wife petition for me from abroad (Australia) for the CR1 visa. She will keep a permanent address in the US, stay on the voter roll, maintain bank accounts and share portfolios, and we will be treating this move to Australia as a temporary one.

Migrated to the States on the K1, did everything on time, got married after 3 weeks of being in the States and filed the AOS/EAD/AP within the next week.
I have my advanced parole in hand, valid until January 2018.
I have three questions I was hoping you could help with. I have called the USCIS and searched their website as well as the CBP's website but cannot locate the info I need.
1- How would I know if my AP card is good for multiple entries? It says under conditions "none".
2- How long can I stay out of the country on the AP card for? I don't have any plans to stay out for any length of time yet, but just want to know everything about it.
3- What happens if my AOS (I 485) is approved(possibly without interview) while I am out of the country on the AP? Any issues getting back in on the AP?

Is anyone else experiencing a slower process for their Advanced Parole / Employment Authorization combo card than that is what is being seen from other Visa Journey users.
I submitted both at the same time 100 days ago and have now lodged a Service Request for the USCIS to look into it.

I realize now that Melbourne does not do the interviews (I was not aware of this when filling out the I129F) and I believe only Sydney does them. I am hoping what I put in there is sufficient for them to realize it would be at Sydney?

Yes, as long as you are living legally in Australia, you can interview there. I assume that's what you put on your i129f also?

Yes. It was mentioned a few times in the i129F initial applicaton. My Australian address was used as my permanent address on the forms and on the ESTA (supplied this to show my previous travels to the USA).

Hoping someone can put my mind at ease.
I am South African (Passport holder by Birth) / British (Passport holder by Descent) citizen. I have lived in Australia (Permanent Resident) for the past 3 years, 3 months.
My fiance and I are in the process of applying for the K1 visa. Just last week we got our NOA2. So expecting to hopefully attend an interview in the next couple of months!
My question is (I'm sure I can, but just want some re-assurance), is it okay to be applying from Australia as a Permanent Resident and be able to attend the interview here in Sydney?
I don't have to apply/ attend the interview in England / South Africa?
If anyone in a similar scenario to me could also answer and let me know that would be fantastic.

Just a quick one.
My NOA2 has been approved and the I129f is on it's way to the NVC for processing.
Question is, when does/ who issues the alien (case) number?
Does the NVC issue it to me before it gets sent to my consulate (Sydney) or does it only get issued once it arrives at the Consulate?

Hi,
I went for my medical, and the Dr noted my blood pressure was "a little elevated". (135/86). He asked if I was stressed / nervous. which I was / am. (stressed about the visa and nervous generally being at a Dr's room for injections).
Does this elevated blood pressure reading affect the medical outcome and eligibility for the K1 visa?

Hoping you can help.
I am applying for my K1 from Australia. I immigrated here recently and have had recent chest X-rays for the immigration department here and do not have TB, but I did have the BCG vaccine as an infant.
How does this come into play with the medical? I have heard it can produce a false positive?
Is it generally played out by getting a skin test first and if that shows signs (which the BCG may) of TB then I go for the X-ray and if that is clear then the medical is passed?

Hi all,
Tried looking for this subject but I cannot find the answer I am looking for.
My fiance and I(I am the beneficiary) applied for the K1 Visa in April. Awaiting NOA2 at the moment (probably a month off still).
I am in Australia (Permanent Resident), but I am wanting to explore the possibility of going home (South Africa) and spending time with family before moving to America.
Am I able to transfer my case so that the NVC re-directs my I129f (when it is approved) to the South African embassy, or is this too messy to try and attempt?
What sort of delays would I expect?

Am I able to attend a medical exam in Australia with one of the approved physicians before receiving the NVC case number, or is that absolutely needed for the medical?
Reason I am asking is that I am about 30 days off of getting the NVC case number but I have a few days off work in the next week that I would like to use for the medical exam. I am aware the medical is valid for 6 months.
Any help would be greatly appreciated.

Essentially I am wanting to attend an interview ASAP after they have my case at the consulate and I am wanting to have all the required docs ready (medicals, police clearances, etc.).
Trying to save myself a month or two really and get over to my fiance.

Hi,
Wanting some clarification on the medical and the validity period of it.
My question is:
Say the medical is granted a validity period of 6 months, does this mean I have to attend the interview and enter the USA within those 6 months?
My understanding is for the K1 visa, the visa, if granted after the interview, is given an expiry date that matches the 6 months expiry date of the medical...ie If I attended the medical 1 June 2016, had interview 1 August 2016, then the visa would have an expiry date of 1 Dec 2016?

We received the NOA1 hardcopy.
It says to "please verify the information above", The names, DOB's address, etc.
It is all correct.
Do we need to call the UCSIS to confirm this or do we only contact them if there were changes to be made or mistakes to be corrected?

Hi guys,
Straightforward question.
We have applied for a K1 Visa. Still early days (got the NOA1 2 weeks ago). Am I generally okay to visit my USA based fiance on the ESTA (British passport) in America for a 2 week vacation while the K1 is in process?
If yes, would I take with any other supporting documents to show at the POE other than my ESTA and my return ticket (thinking maybe a letter from my employee, etc, showing reasons to return home until the K1 visa is approved).
