    And yes you do need one in hand, leaving the USA without one is considered abandoning AOS. This happened to a fellow last December.

    I already did an Info Pass appointment at the local field office and tried to get an emergency AP. Unfortunately, they said illness for extended family (grandmother) was not a valid basis for granting emergency AP. Only direct family illness was valid.

    Any other ideas besides waiting and hoping it gets approved soon?

    Thanks for the reply. I thought what she said did not sound right. I guess we'll just have to wait and hope for the best.

    Advance Parole

    Most aliens who have pending applications for immigration benefits or for changes in nonimmigrant status need Advance Parole to re-enter the U.S. after traveling abroad.
    Aliens applying for advance parole on the basis of a pending application for adjustment of status must be approved for advance parole prior to leaving the United States in order to avoid the termination of their pending application for adjustment.

    Anyone have any thoughts?

  4. Hi everyone!

    My wife's grandmother is sick and she wants to go back home ASAP. We received her NOA for her AOS and AP on March 6th so I know her AP may be approved in the next few weeks. However, we made an appointment with the local office here to see if we could get an emergency approval, but they said they could not grant her an AP for extended family illness.

    Anyway, one thing they did say did surprise me. The lady there said my wife could leave the US and once the AP was approved, I could send it to her and she could use it to get back in. She just said the only risky factor was the document could get lost in the mail, but besides that, there was nothing wrong with doing it that way.

    Is there any definitive answer on whether or not you need the AP approval or document in hand when you leave the US? Has anyone ever left the country and then had the AP document mailed to them after approval and had no problems re-entering the US?

    I will call the USCIS service center to see if I can get clarification, but was wondering what everyone here knew.

  5. I don't know if this is the appropriate place to post this question, but I couldn't find a forum that fit this question....

    My fiance is coming to visit me in the US. However, her B1/B2 tourist visa expires in late June of this year. When she visited me one month ago (and every other time she came the last few years), they approved her for a 6 month stay, which is clearly AFTER her tourist visa expires. Based on this, I am under the impression that as long as the visa has not expired at the time you enter the US, it is ok. Even if the visa expires while in the US, you are ok as long as you do not overstay the time period you were approved for when you first entered the US.

    Is this assumption correct? I've searched around and could not find a definitive answer to this question.

  6. Hi everyone,

    I'm happy to report that my K-1 petition was approved on May 3rd!

    However, it is now May 11th and I have yet to receive my NOA2 via regular mail. There was only a 3 day gap between my NOA1 notice online to receiving in via mail. I'm only concerned because I think I'm supposed to send a copy of my paper NOA2 to my fiance for her interview.

    I'm wondering if others that got their approval around the same time are in a similar situation. If so, please let me know so I don't worry. Also, does anyone know if it is possible to get another paper NOA2 issued if there was a problem and the original was lost?

  7. Hi everyone,

    I'm hoping someone can give me a quick answer for my situation...

    I'm currently waiting for approval for a K1 visa I filed in January for my fiance. I filed this because I assumed my fiance would move to the US and we would get married and live there.

    However, my situation has changed and it looks like we will live in South Korea together for at least the next few years. After that, I would like to be able to enter the US with her as a permanent resident. We will get married in Korea, but we can choose whether or not to make that marriage legal and official. So basically we can choose where to get legally married, the US or Korea.

    My goal is to choose the process that will allow my fiancee to achieve permanent status the quickest and easiest way, given that we'll be living overseas the next few years. Also important is the ability for her to be able to travel back and forth from the US and Korea without advance parole.

    I know I'm probably leaving out some important details, but I'd appreciate it if some of the experts can give me their thoughts on what process would be best for me.

  8. Hey all.

    I filed my I-129F petition at the Vermont Service Center January 2007. I got NOA 1 saying they recieved it January 17, 2007 and received NOA 2 stating approval January 25, 2007. I just got the letter from NVC saying they received the petition from VSC and will be sending to Manila Embassy within the next week. I was really surprised it was approved so fast.
