  1. Hi Everyone! I hope you’re all having a wonderful day :) 

     

    We mailed the I-751 package on Friday April 25, 2020 and USPS tracking said it was delivered on Monday April 27, 2020 in Arizona. We received the notifications text and according to the USCIS case status, we’re supposed to contact them if we haven’t received our NOA by May 27, 2020. Today is June 1, 2020 (5 days past May 27th.)

    I understand if there is a delay due to Covid-19

    but I am starting to get worried.

     

    Should I call and ask for information on why I haven’t received/if they sent one or should I wait a few more days?

    -copy of some expenses and my husbands direct deposit into our joint account 

    -copy of a joint personal loan

    -original sworn affidavit from my parents stating living arrangements (I was recommended this by another user since we don’t have a lease)

    -copy of flight booking information and receipt from a family trip 6 months ago

    -copy of our pet’s certificate of vaccines showing pet ownership 

    -copies of letters sent to my husband and I showing same address (I read in another thread that some people recommended sending letters with both names sent to my parents address since we don’t have any bills under our name except for our car insurance)

     

     

    Should I send a letter stating I don’t have insurance with my husband because I already have insurance through my moms employer until I am 25? And a copy of her insurance card with my name on it? My husband and child have insurance through my husbands employer. 
     

    That’s pretty much all I am sending as evidence. I am not sure if that’s good but compared to others I seem to have a short list 😟 that’s why I wanted to add an affidavit for my parents stating we live with them.

    Good to know, Thanks! :D  I saw other threads where they had the parent's SSN's. date of birth, place of birth and date when they became Resident's or US Citizens but I figured I would add their SSN :)

     

    Does it HAVE to be notarized? My parent's get out of work after the bank closes and due to COVID-19 our bank closes earlier than usual plus we can no longer walk inside, we need to go through the drive up 😕 

  4. Hi Guys! So I had a delay on sending our joint I-751 petition but we're getting ready to send it out on Monday (in 2 days :o ) As suggested on my previous post, I made a sworn affidavit for my parents stating that we live with them and we will be living with them until we save up some money for our own place. I am not sure if this is good, I was given links with very good information on how to make the affidavit but I am pretty nervous since I tried to make it 1 page but I am not sure if I did good or if I should make changes. I would appreciate it if someone could give me some feedback.

     I replaced my information with fake names, addresses and dates. But that is exactly how I have it arranged. Please let me know how I did and if I should add, remove or change a few things. Thank You in advance ^_^

    This website has the answers to your questions, as well as a sample.  It was easy to Google for this.

     

    Your parents can do a joint affidavit. 

     

    Their affidavit should focus on your living arrangements.  The info you posted about contributing $200 per month is something they can add to the affidavit, as well as the fact that they are helping you save for a place of your own.

    I tried looking for some on google but they were all affidavits from friends 😅 but thank you for the link. I looked at it and it has very helpful information :)

     

    Also, do I need to add their social security, phone number, copies of their driver’s

    license, etc? (Question 2)

  6. EDIT: The reason we are living with my parents is because we are saving up for a house or an apartment. (Not sure if I should add that to affidavit from parents.) And the reason we are giving my parents $200 is because my Dad co-signed my husband when we financed our first car. But my Dad and husband’s names are under the car loan. My name isn’t included but we have proof of withdrawing an extra $260-$300 (cash) a month for the car payment. Not sure if I should add that as a “supporting document” that my Dad also helped us finance a car? 

  7. Hi guys! Hubby and I are working on the I-751 packet for my husband. I posted a question 2-3 days ago and as you can see on #3 at the picture I have attached, I was told to have my parents get an affidavit attesting to our living arrangements since my husband, child and I live with my parents but I have a few questions.

     

    1) Do both my parents need to make their own letter or can it have both their names on one letter?

     

    2) I’ve looked at older threads and examples and they all provided the parents address, social security number, Date of birth, place of birth, when they became residents or citizens, copies of parents and beneficiary/spouse drivers license, letters mailed to parents and beneficiary/spouse with the same address, and parents phone number. They also stated to send receipts of bills we pay but we don’t pay bills. We only give my parents $200 a month to use on any bills they want.
    •Is the response the person gave me on my previous post gave me enough information to write a sworn affidavit or do I need to add all of my parents information like the older threads/examples I saw?

     

    I would really like an update or an example letter please :)

     

    3) Does it need to be notarized?

    3)  Pictures are not required.  I'm sorry you had to cancel the party!  But...because you don't have a lease, I strongly urge you to get your parents to complete an affidavit attesting to your living arrangements.  They just need to state that you live with them, have lived with them for xxx time, that you will be living with them for xxx time in the future, and a truthful reason why (such as:  we want to be close to our grandchildren, we are letting them live with us until they save enough money for a place of their own, we are older and they are helping us around the house - whatever is true).  If you contribute to household expenses, they can add that in, too.

  9. Hi Guys! My husband’s Conditional GC expires the first week of July 2020 and the 90 days before it expires starts today so we’re getting ready to file form I-751 (removal of conditions) but I have a few questions.
     

    1) I am having a hard time with the cover letter. I was starting to work on the cover letter and looked at other cover letters but I noticed some people had their cover letter as “Texas lockbox” or “California service center” but I checked the USCIS website for the address and it is:

    The cover letters I saw are from 2015-2019 and I haven’t seen any recent ones from 2020 and I’d like to know if there is a specific lockbox or service center I need to add (I live in Oregon) or do I just use the “po box 21200 Phoenix, AZ 85036 in my cover

    letter?

     

    2) For the money order: do I get $680 (filing fee is $595 + biometric fee is $85 which = $680) and as the memo “I-751 filing fee + biometric fee” or do I need to get a separate money order for the filing fee and the biometric fee?

     

    3) I wanted to send pictures as proof of relationship after our marriage 2 years ago to present date and our child’s birthday is next week but due to COVID19 we had to cancel our child’s birthday party (that means no family picture 😧 ) and we’re not going out (only to the grocery store) therefore I can’t print out pictures at my nearest Walmart. Should I include a letter stating why I won’t be sending pictures, is it okay if I don’t send pictures or do I need to send pictures? I don’t want to get any RFE’s for not sending pictures 😧 I have other documents as proof of relationship like joint bank account, car title/insurance policy with both of our names, a personal loan with both of our names, plane tickets from a recent out of the country trip, our child’s birth certificate and baptism certificate, etc. Only thing we don’t have is our own home/apartment since we live with my parents.

  10. Hi! So before I asked my questions, I would like to tell give you a few details so my question will make more sense :)

     

    -My husband came here through the K-1 Visa, we got married 1-2 weeks later, our child was born 2 weeks after that and a year later (last year) he got is conditional green card approved.

     

    -My parents were our sponsors when I sent the Fiance Visa Petition as well as the AOS (since my income wasn’t enough my parents had to be the co-sponsors.)

     

    My question is: Can my child and I get Medicaid even if my parents are our co- sponsors? And Can my child and I get Medicaid without it affecting my husbands Removal of conditions for his conditional green card?

     

    I know a Resident can’t get any type of government help till 5 years after he’s become a resident. My parents are our sponsors and as sponsors they have to care for us financially until we are financially stable. We live with my parents right now and my husband has a job and we Filed our taxes as married but since my husband got his job, we don’t depend on my parents financially anymore. I just don’t want to get Medicaid and then they somehow end up making my parents pay back the $ cus they’re financially supporting us even though they’re not anymore. Is this all possible or am I just really nervous and stressed that I am overthinking? My husband’s insurance doesn’t cover much for him & our child so we want to get Medicaid for my son so it can at least cover my sons appointments.

    Since he has a valid EAD, you are permitted to include his income in your household. No I-864A is necessary (see part 6, #22, and the instructions, which should be checked):

    "One or more of the people listed in Item Numbers 8.,11.,14., and 17. do not need to complete Form I-864A because he or she is the intending immigrant and has no accompanying dependents"

     

    You do not have to include him, though. If you are using a joint sponsor, then there's not really a benefit in doing so.

Although I could check off Part 6, # 22 so he won’t have to fill out Form I-864 but we have a 1 year old and it says “....do not need to complete Form I-864 because he or she is the intending immigrant and has no accompanying dependents” Do you think the immigration officer will question me on why I didn’t add my husband’s income? 

  12. Hi Guys! So my husband’s interview for his Green Card is next Tuesday 😮 We’re double checking our documents & making sure we’re ready but I have this weird feeling with the Affidavit of support (form I-864) so my parents are sponsoring my husband but since I am the main sponsor, I am filling out form I-864. On Part 6, number 7 it says “my current anual income is $______” do I add 0 since I am currently unemployed? Also under #7 it says “Income you are using from any other person who was counted in your household size, including in certain conditions, the intending immigrant.” I read the Instructions for Form I-864 but I am still confused. My husband just started working 3 weeks ago, a few days after recieving his EAD so would I add his name & current income under #7? If I do, he would have to fill out Form I-864A right? (Even if I do add his income, my parents would still have to sponsor him & fill out Form I-864 since my husband recently started working)

  13. Hi Guys! So, my parents were the sponsor for the K1 visa & they will still be the Sponsors for AOS. My husband’s Interview for his GC is in 3 weeks. So we’re making sure we’re getting everything ready. For the K1 visa, when we were working on the affidavit of support, If I remember correctly, my Mom and Dad filled out Form I-864 but since my dad was also the 2nd sponsor, he filled out Form I-864EZ. Will he have to fill out Form I-864EZ again? Or just do Form I-864?

  14. Hey Guys so I have a question! 

     

    I didn’t do my taxes this year (January 2017) because I didn’t make enough income. I only worked for maybe 2-3 weeks in the Summer & according to my W2 It came out to a total of 2k. My husband didn’t have his EAD yet and I am trying to do my taxes now on Turbo Tax since he has his Interview for his Green Card next month & he now has a SSN. He just got his EAD a few days ago & he starts his new job tomorrow. I will be filing jointly since we are married so I need to fill out some of his information. For Occupation would I put “Unemployed” since he didn’t have his EAD yet or stay at home dad since we had a baby last year? I just don’t want to do it wrong. I am thinking “unemployed” but I wanted to ask on here first in case someone had the same experience & if you could tell

    me what you put as occupation.

    Yup, Almost a year. We sent Form I-765 (EAD) & Form I-485 (AOS) at the same time in June 2017. We called USCIS around late September & they said to wait a month & call again and so we called again (for 3 months straight, September, October, November) but we didn’t call in December until January and they said there was a delay & to call back in February if we didn’t hear of anything. We gave up so we would just check the USCIS Case Status online.
