  1. OK... that kinda helps. I spoke with UCSIS concerning the RFE and was told that because the EAD is a different application. But expediting it would speed it up.

    I guess if I can arrange for them to send the job acceptance directly to the USCIS that would help for expedition?

    I worked for the employer in the UK and this was the next best thing to a transfer. They wont give it to toehrs, but surviving further with no income is gonna be difficult.

  2. Hi,

    I am waiting for my EAD and in the meantime, I have been notified of a job offer. My EAD was applied for over 65 days ago but there is nothing as yet. In the meantime, I know I can expedite the process by showing the job offer, but the company are holding it back until I have the EAD.

    Is there a legal reason why HR stopped me having the job offer in advance? Obviously I have been without pay for over three months and I am wishing to secure the best position as soon as possible.

  3. Quick question. I moved to the USA with a K1 Visa and I have applied for Adjustment of Status and an EAD. It looks like I have a delay on the Adjustment of Status and they want more information, but I have had a job offer in between which I know that I cannot accept until I have the EAD. Are they processed separately? Will the EAD still follow the 90 days as suggested in the processing times?

  4. ut it has to be re-employment. I am not allowed to work for three months... not for the UK apparently as that is against the law. But you are right. AoS does take longer. Is the I-864 required for the AoS interview? That is when they want to know you are employed and settled into the country. You then get a greencard with conditions... continuous employment. But... if we get the work permit sorted and then apply for AoS... that could work? I also know there are two ways to get a work permit, one way is with your AoS and there is another.

    Just in case... I guess we would need to look at getting a sponsor as well then?

    My fiancé has been a house wife and only just got back into work... not earning enough yet.

  5. The good news is that my company has interviewed me from the USA and would like to re-employ me when I get my work permit. Feels like a chicken and egg scenario, but I imagine that I will have a clear job offer before I apply for my greencard. It is the adjustment of status which takes 90 days. By that point it should be all good. I have looked at the form to fill in and it is very simple in the fact that she declares how she will support me (she will provide the roof etc and I will feed myself).

    Thank you for all comments and especially Nick-Nick. I am glad they go over it in an interview. I will earn more in America (average wage $86k per year) so I really should not be worried.

    Checked another page on their site and it says this:

    Proof of Financial Support and Affidavit of Support Forms

    During the visa interview, applicants will be required to present evidence to the consular officer that they will not become a public charge in the United States. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e)..

    The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage.. (https://travel.state.gov/content/visas/en/immigrate/family/fiance-k-1.html#8)

    Can you see my confusion with the form?

  7. I am financially prepared for the lack of income. I have savings ready to support for the three months and I searched and found an answering which did not refer to it being related to the petitioners income.

    There was nobody listed as a joint sponsor as it was not seen as an issue. So what do we do?

    My assets become hers as well anyway... do I just assign my funding to her?

  8. I have a question. I am moving to the US from the UK on a k1 visa and will be the bred winner for the home.

    What should I do for the I-864 affidavit of support? The form looks to be based on the petitioner or sponsors only. I was told that I need to show proof of earnings to show that I can support the family according to percentages listed. Very confused now. Is there a different form I need?

  9. Here is my confusion.... I appreciate USCIS having a window of 5 months. I have also read that they work on the applications as they arrive in Chronological order.

    This website is fantastic. Where the USCIS are not transparent on their timings, this website gives indications of who has received their DAO2.

    It does pose questions as to why some are taking longer than others, even when the country is low risk.

    I will take this websites advise and call them. I have a job offer and so I am eager to hasten the application in any way.

    I will report back and let you know of the result. It has been 73 days so far so nothing ventured nothing gained.

    Thank you for your responses.

    I have completed my timeline thus far and it does suggest that I contact them directly:

    "Based on timeline data, your I129f may be adjudicated between April 19, 2016 and April 23, 2016*.

    If this date range has passed or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline."

    I thought they work through applications as they come, but it seems more problematic maybe?

    Either-way... We will contact them directly.

    Thank you again for your support. It is not easy trying to guess where things are and when you are trying to organise work and wedding.
