I have two questions. The packet 4 instructions state "applicants who have previous chest x-rays must bring the RESULTS with them to SLMCEC for comparative analysis" Does this mean the actual film ?

Form ds-156 line (box) 28 asks "who will pay for this trip? " The VJ guide has "Myself" What if the sponsor is paying ?

the long wait is over.... GOD IS SOOOOOOOOOOO GOOD!!!! I RECEIVED MY K3 VISA TODAY!!! I called my husband and told him the good news!!! now we both can't wait to spend our Christmas together in New York!

To all who are patiently waiting.... keep praying and keep your faith high! Your time will come sooner than you think....

.As I posted before . One of the pieces of evidence i sent to my lawyer was a letter in which I addressed my fiance as "wife" I know it was stupid now. Of course they sent it as part of the evidence packet to USCIS.

The person who handles the paperwork for the so called lawyer and sends these things out told me that she believes that often only the basic paperwork( Forms. dated passport pics , photos together) actually get forwarded to the embassy. That sure sounds comforting if true. Does anyone have any knowledge as to how true this may be.

I also wonder how much time the embassy staff has to examine eah application. One would think they dont really have time to read all the letters. Unfortunately mine starts with " Mrs My last name" and ends with 'your husband".

We did make a commitment and I definately view these things in what i want to call a "promise future tense?"

Anyways i plan on preparing an affidavit stating we are not married and explaining my use of the "banned " terms if and only if it is brought up.

Anyways any input on the paperwork forwarded to the embassy or the time the embassy staff has to review it. Did anyone already interviewed fet to see what paperwork they have ?

Wow!! Such great news on approved petitions and new scheduled interviews as well. It looks like the USE has finally found new resources or set a new priority on K1 interviews because, where they WERE falling farther behind every month, they are now making good headway on the long queue of petitions.

As of right now all bets are off on predictions while they continue to release additional interview slots BEFORE their upcoming announcement of February slots. And that's a GOOD thing!! We have all moved nicely up the list since the January slots were announced. Mari and I were thinking March (MNL2006-789xxx) but now, February is looking pretty good. This has been a great development for all of us!

Have vic&el4ever, davidjack, or binow checked in case they have a scheduled date? It would be helpful to hear from them either way.

Yes i have that site save and each time i check it, it says: Case Number Not Found on Appointment List Any idea why it is trying so long too get a letter from them or our we on a nomal timeline?

Ok while we are on the subject. Sheryl has a problem with her BC. Imagine that. Her name is spelled correctly. Her Dad's name was mispelled when she was born and the LR crossed through his name and hand corrected it. We have certified letters from the LR stating that this was done in good faith yada yada. She went to NSO in Cagayan De Oro. She asked for a correction. They said they would process it and to check back in about 2 weeks since they would send the request to NSO Manila. She checked back and was told that NSO saw no need to correct it since it was not her name that was mispelled and that the hand corrected copy is the official record with NSO. Furthermore we included a copy of her BC in the petition we sent to USCIS along with the certified letters from the LR. I'm guessing at this point we just go with the one she has and hope for the best. But I would really appreciate any ideas or suggestions.

DeaniWait, I agree with NSO that there is no need to correct your fiancee’s BC since it's not her name that needs correction. A change in her BC now would appear suspicious to the embassy and could cause AR. The father’s misspelled name is not important to the embassy at this point in time. I would go with the BC that you have now.

My case is different... my BC had clerical error in the date.. I applied for late registration last jan 10, 2006, but they typed it wrong instead of jan 10, 2006. they typed it jan 10, 2005... but now it is corrected already, 6 was hand wriitten and in security paper by NSO.. To all VJ member ...What Did you think is this may cause a problem during my interview and put me in AR? you comments and suggestion will be highly appreciated!!! God Bless!

A hand-written correction is part of your BC so that usually does not raise a red flag but late registration (especially very late registration) raises a red flag. Make sure you have your baptismal certificate, school transcripts, diploma, or photos of you growing up. Embassy may or may not ask for them but keep them handy at interview. If you are lucky, you may breeze through interview without consul questioning your BC.

Ok i have a few question i actually filed for my K1 and this is the problem my fiancee' last name is from his mom cause the was never married his biological dad. so his using his mom's last name and the middle name on his BC states only initial (one letter, no description) Example: Name:Jose Middle Name: D. Last Name: Medina . So when i applied for K1 i included his middle name cause it's states on his BC. Now, when he went and get his passport, the lady that works at the passport place stated to him that they cannot include the middle name because that's his mom's middle not his..We are so confused . But it was stated on his BC...So now we have no idea what to do???

Are we gonna have a problem in the interview? Coz right now his passport doesn't stated anything except his first and last name.then they put - (dashes and leave it black so it's visible. We never thought this is gonna be a big deal but i guess it is...

I’m not a lawyer but I would go with “Jose D. Medina” as that is what his BC states. For his passport, I would request for amendment to put the “D” as his middlename. I assume that DFA refused to include the middle name because your fiance probably requested to spell out the full “D” (“Delgado?”, DeLeon?”, etc.) which DFA is justified to refuse because his BC does not state so. Just request initial “D” and DFA has no reason to refuse that. If BC and passport have the same name, then no more problem with embassy questioning it.

Thanks for the info. Reviewing the posts, BC, MC, etc seems to be the biggest issue. There are too many flavors. And surprisingly how many mistakes or differences are on the same document.

Yup, too many flavors and each is a different case. What applies to one does not apply to all.

Hello All I have a question as I am obsessing ove paperwork details. I believe we need to have a copy of the original I-129f (complete with all of our evidence) sent to USCIS. I have a lawyer who seems basically worthless. Anyways he sent me a copy of the paperwork. It has lots of copies that cant really be seen at all. I originally sent color copies of things like passport stamps and letter to my fiance.

Is this really important to bring a copy to the interview ? Should I just find the originals and make good copies of anything that is not readable ? i also refer to my fiance as my wife in some letters. Is this a no no ? Any suggestions would be appreciated.

The I-129F is not required at interview time but I made sure I had a copy with me as some of the interview questions are based on what is written on the I-129F and G-325. Your lawyer is wise to send you copies so your wife can review what is typed there. She may be asked questions like your birthdate, where you work, how long you’ve worked there, what’s your mom’s name, where do your parents live, etc. those kinds of things ~ to test how well she knows you.

Please remove any letters where you refer to your fiance as your wife. Documentary requirement is already difficult as it is so it is not wise to make the consul suspect that you have already married your fiance (even if you actually have not and did not). I am sure you will have a hard time unproving that she is not your wife. Avoid anything that would give embassy reason to put you in AR. “Wife” is not a term of endearment for a fiancee to embassy ears ~ to them, it’s a red flag.

I just found out My fiance now has chicken pox. I hope this doesnt become an issue now ? Nothings easy sometimes it seems

No issue about having chicken pox. The good thing about her having chicken pox now is she probably saved herself one “ouch” for varicella shot at medical time. Your fiancee has to bring proof or show proof (the scars left) that she has had chicken pox.

Garya505, yes, we've heard of ladies going to interview without photos attached to their visa applications and I-134. Others had photos but no paste to stick it with. Here at VJ, we remind all to even bring paste and ballpen hahaha.

OOPS Now Im worried. I was just making copies of all of the evidence my lawyer sent with the I-129f and i have a letter reffering to my fiance as my wife. Shouldnt USCIS caught this ? My lawyer is so inept.

I wonder where this 50 % percent denial rate that was quoted comes from ?

hi dave and flory, well i don;t think you'll be needing the original I-129F that you have submitted to the USCIS... what you need is just the copy of it and all other copies of evidences you have submitted to them... just in case they ask of it... but in my case, they did not. Try to ask your lawyer if you can have the original copies of all communications he got from the USCIS/NVC... and once you have them, you can send them to your fiancee so she can be prepared with every single docs she might be needing for the interview. They don't ask for it at the Embassy, but jsut in case, you should be ready... when I had my interview last December 5, I had everything with me... copies of all pages of the passport of my hubby, docs from USCIS/NVC, eveidences of relationship includng photos, emails (man I prnted out 300 of them), money transfer receipts, letters, phone bills (your phone bills)... just bring anything that you think might be of help to extablish and prove that the relationship is genune. And no, i don;t think it's a no no f you refer to your fiancee as your wife in your letters or communicatins... it's just terms of endearment and the consul will undersntad that. hoping for the best for the both of you...

I have a question about Visa Forms that are to be completed. We have completed every form thus far, as well as almost have everything together for the interview. Is the DS156 and DS157 the only documents required to be completed in Packet 4?

Also, does anyone recommend going to the medical exam earlier than the scheduled date? If so, how much earlier?

I read about several documents needed to prove the relationship. Is a marriage certificate showing we were married in the Philippines along with photos of us at our wedding enough?

Personally I recommend going for the medical exam early. That way if there is minor problem you might have a chance to resolve it in time for the interview. We plan to do it about 1 month before the interview.

The only reason to do it one week before the interview is if your fiance(e) does not live in the Manila area and would like to make just one trip.

As far as the Affidavit of supprt , bank letter and employment letters are concerned, which forms require notarization ?

PW, it is not that those of us in AR did not have our documents ready it is that the consul wanted to verify one of our documents with the nso. Every time I see someone post like this I just cringe. A document check can and will happen randomly to cases. In talking to the embassy every day Lorrain admitted to me that the embassy lost some paperwork they ordered before our interview which leaves me scratching my head. They tell us to gather up cenomars, bc, mc, nbi but then they go ahead and order duplicates to check and throw people into AR and a lot of times they don't order up duplicates until after the embassy. They batch those requests which can take 4 to 6 weeks. A bit of advice, if your fiance/wife gets AR have her ask if she can carry a copy from NSO to the embassy, this may take time off of a document review related AR.

Update our timeline please: Interview 11/28/2006

Take note of the reasons for AR ~ birth certificate, Cenomar, divorce decree ~ so let us make sure our documents are in order.

I want to make sure we have our paperwork in order. We will attend our interview in February i hope.(mnl2006770)My fiance will be 22 in late February. We have a parental letter of consent from March of last year. Should we get a newer one ? Should it be a letter of advice instead since she will now be 22 by the time we get married ? Some of her other docs are aging now also from 6-11 months at the time of our upcoming interview. She attended the CFO 9 months ago also. What should we do about the older documents ? I believe the embassy list one year as the age of docs ?

Well, our number is only 21 days behind the last one to get a Dec interview date.(ours is 2006783xxxx) I am really hoping that means a late Jan- early Feb interview date for us.

I am also now concerned about my fiances NSO BC. Her Fathers middle name is misspelled(an "A" vs an "O" in the middle of his name.) WE dont supply parents middle names on the G-325 so maybe this wont matter. Also My Fiances first name is hand printed while everything else is typed. i wonder if either of these will become issues ?

we also have the same query with Dave and Flory, regarding the visa..you picked up your visa at the USE, right? how did you do it? you didn't go through delbros?You got approved October 4 and picked it up Oct. 6. And that was fast, you picked it up after 2 days.

According to Delbros, they will not allow you to pick it up the visa from them. Therefore you must make the request to pick up the visa from the Consular Officer who (if they are nice ) will give you a pick up slip to return to the Embassy and obtain your visa.

Does anyone know how many days wait it is to pick up the visa at the US embassy though ?

To forgyj, my documents did not have documentary stamps but I made sure my original documents had the required dry seal and if they were certified to be true copies, they were signed and likewise sealed by the office that certified it. I am certain that you have a Certificate of Registration for the declaration of nullity of your marriage based on Presumption of Death, otherwise the NSO would not have issued you an annotated MC. The Certificate of Registration is a government and NSO requirement prior to annotation of the MC.

The registration is required according to Section 7 of Republic Act No. 3753 http://www.chanrobles.com/republicactno3753.htm

"Sec. 7. Registration of marriages. — x x x

In cases of divorce and annulment of marriage, it shall be the duty of the successful petitioner for divorce or annulment of marriage to send a copy of the final decree of the court to that local civil registrar of the municipality where the dissolved or annulled marriage was solemnized"

Please excuse me if I am posting my questions in the wrong area/format. Im curious about picking up the visa at the USE Manila after approval. i see that a few posts show picking it up 2 days after approval but the embassy info seems to suggest that it takes a week. Can anyone shed some light on this ? i sure would like to bring my fiance home after we attend the interview. I also have a crazy question. Why cant you get married at the embassy ? It is U.S. territory.

I have a similar question. If I move to the Philippines for say 3 years and am married to a Filipina the whole time what would be required of me financially to come back to the U.S. with my wife ? How much assests would be required ? How would employment figure in ? Would employment offers be acceptable for myself and/or my wife ? I am only asking this as my backup plan if our fiance visa is not approved at the embassy level. I am intersted in moving there but at some point I would possibly like to be able to bring my family here.

My current situation is as follows: I filed for my wife's immigrant visa via a Direct Consular Filing (visa class CR-1) at the USCIS. The USCIS (US Citizen and Immigration Service) approved the petition I-130. After the USCIS approved the petition they forwarded it to the embassy. We then received the packet 3 in the mail from the embassy in Bangkok . The packet 3 includes a blank copy of the affidavit of support and other information about collecting the remaining necessary documents. The Affidavit of Support does not need to be submitted until the interview date. (Note: I was able to file via DCF because I have a Thai work permit. Direct Consular Filing reduces the time for receiving a marriage visa significantally.)

My question is two fold:

1st Question: If I travel back to the US and find employment within several months will verification of my new employment be sufficient to meet the Affidavit of Support requirements. (I'm assuming my salary will be well over the poverty line) Also, I will have a permanent residence.

2nd Question: Can I continue with the Visa process under Direct Consular Filing? At this point we have almost everything ready. My wife needs to obtain a clearance from the police and a physical from an approved hospital.

Note: I do not have enough income in Thailand or assets to meet poverty guidelines and I don't want burden family with joint sponsorship.

The theory is that if you have an alchohol/drug offense, you likely have abused alchohol/drugs. There is a well-documented correlation between domestic violence and alchohol and drug abuse.

There's also a correlation between domestic violence and low IQ. Should we start giving people IQ tests?
