    Thank you so much agripa! I'll be calling NVC asap. But if I'll speak to an operator and ask him/her if I can talk with the supervisor will they allow it? I'm in so much despair right now, since im still studying for my boards on the 21st and with this additional checklist they sent. I really appreciate your advice, thank you for enlightening :-)

    Thank you so much! :-) I hope that's the only case, but since they also stated that me and my dad wasn't able to meet the minimum requirement to sponsor for my husband then that means we should find another and have him/her fill up the I864 and bring it to the interview?

    We were able to provide nvc with all the AOS they needed from me, my dad and my mom. What confuses me is that how come my dad wasn't able to meet the poverty guideline since his income is even above the poverty level. And why would he fill up the I864A instead of the I864.

     

    Yes, we already have another sponsor jusy in case they're not satisfied with my fathers income. 

     

    Is it fine to call NVC with regards to this? So that I could clarify what they are really asking for.

    Me and my dad filled up the I864 while my mom filled up the I864A since she's a member of the household. I don't know why nvc asks for my dad to fill up the I864A since he's the sponsor. Am I right that I864A is only filled up if you're a household member (like in the case of my mom) right?

    As I mentioned earlier, there are a set of conditions under which you do not have to file taxes. You need to consult a tax lawyer (I'm no expert here) and have him specify exactly which tax law exempts you from having to file an income tax return. You would then do as the NVC asks and specify this reason in a letter to them. You would then also tell them in a letter that you had NO job at all over the past year, and as such have no W2. But I would say it's very important if possible to have a tax attorney or tax accountant help you clearly identify which tax laws exempt your from having to file a tax return. 

     

    My dad and I filled up the I864 and the nvc said that my dad needs to fill up a new I864A and have it signed and gave it to my husband for him to bring it on his interview. What I mean with the probable new sponsor is that, if ever we'll be asked to have another sponsor since they believe my father dont make it to the minimum poverty guideline do I still need to inform nvc that were going to have a new sponsor? Or well wait after the interview and for the decision of the consul for us to find a sponsor who meets the poverty guideline.

    There are a limited set of circumstances in which you don't need to file for taxes. You can find a list of these reasons laid out nicely in this article. Please read it and see if you do qualify. If you don't qualify, then you will have to retroactively file taxes (even though you may not have made anything). 

     

    Weird thing is that my fathers income is above 40,000 plus with my moms income, they both make around 60. And I dont know why NVC says my dad doesnt meet the requirement. Also, do my dad still need to fill up the I864A as what is instructed by the NVC? And if ever I'll find another sponsor do I have to inform nvc of this? Since they said my husband needs to bring the documents during his interview and we weren't able to file an I864A for the probable new sponsor.

     

     

    Also, I do not have an income and Im a dependent from my parents. So where can I get the W2 and all the tax return since I don't file taxes.

I should have had my case complete by now if I had not sent that second packet of non requested paperwork *sigh*.

    I am hoping they will overlook the second set of paperwork and just focus on the documents that THEY ACTUALLY requested from me on the checklist.

    I experienced the same thing. Nvc had our case last 9/28/16 and its past 6wks now. Our case was reviewed by a supervisor hoping we'll have our case complete soon.

    I am still dependent on my parents since I still do not have work. Does that mean we're a household size of 5?

  11. Thank you! This has to be the most commonly misunderstood part of the NVC process. People see "proof of relationship" and think they have to send 4 years of chat messages and a bundle of photos. But as you have pointed out (and I also regularly point out) it forms part of the AOS package and relates to household members of sponsors/joint sponsors.

    Proof of relationship If you completed Form I-864A, submit evidence that proves your relationship to the sponsor (the person who filed Form I-864). You can prove your relationship by submitting a photocopy of one of the documents below:

    Birth certificate;

    Marriage certificate;

    Adoption certificate;

    The petitioner or joint sponsors most recent Federal Income Tax Returns, if you are listed as a dependent; or

    A signed, written statement describing the relationship.

    Note that it says "proof of relationship". Chat logs, photos, tickets, receipts for restaurants, hotels and rings are not "proof" of relationship, they are evidence. Big difference. When USCIS and NVC talk about proof, they mean official documents such as birth certificates and marriage certificates. When they talk about evidence they mean communication, photos, receipts, etc.

    So here's my story, I went back here in the US last April 2016 before I went back here I got married to my husband who is a Filipino living in the Philippines. We were in a relationship since college since we both took up Nursing. Now he already passed the NCLEX and a registered nurse in the United States while I'm still reviewing for the NCLEX since I failed.

    My concern is that, my sister who is also in the Philippines had her petition (F2B) approved. since I do not have work yet my parents decided they will be my joint sponsor. I just would like to know who should my parents include as dependent or the total number of household. Should we have a household size of 5 (me, my mom and dad, my husband whom I filed a petition, and my sister who got her case granted) or a household size of 4 (me, my parents and my wife) only and another separate household size of 4 for my sister? And would my parents income be sufficient for the 3 of us (me, my husband and sister) since we're all dependent to them except for my husband who can probably work as a nurse when he get here in the US. My dads income is above the poverty line of 5 household and my mom is willing to co-sponsor.

    Thank you in advance to those who can help enlighten me with our case ?

However, just to be more elaborate, if you look at the Document cover sheet that is asking for proof of relationship, it is asking for proof of relationship under the "Financial documents." Therefore, it is not asking for the relationship between you and the spouse, but asking for the proof of relationship if you, say, have a joint sponsor who is an immediate relative and has filled the I-864A. In that case you would need to provide the proof of relationship between you and the joint sponsor (only if he is filling I-864A and not I-864).

  14. At USCIS stage, no questions or trouble at all. They approved me in 5 months. At NVC stage, when applying for AOS I still had to fill out an I-864 which looked sad since the past 4 years I wasn't living in NJ.

    My parents were our co-sponsers. I was still in the Philippines while preparing the AOS and I was so confused!

    I regret not looking and asking through VJ!! I had both my parents fill out I-864 and made them both fill out the I-864A just in case :dancing:

    If you already sent your I-130 packet, I recommend you prepare your AOS already ...

  15. HEY! i just graduated from college in the Philippines as well when i filed for the i130!

    When i got to the NVC stage I applied for NCLEX. and reviewing... somewhat.

    While you are waiting for the USCIS to approve you I recommend you get your IV and especially your AOS ready.

    You fill out an I-184 and your family willing to co-sponsor. Also have them fill out an I-864A.

    Same with our case, we graduated last year and took the local board and started reviewing for the nclex. I just hope we could make it, in passing the NCLEX so that everything would run smoothly. Were there no other questions with regards to your petition knowing you don't have work? Thank you!

  16. I would say attach a letter explaining why you're unemployed. I believe you're reviewing for the board exam to be a nurse and when you find a job, you both should be good. I guess you should be fine

    Thank you so much caykay1! :) I already attach a letter explaining why we are both unemployed. And yes, we are both reviewing for our state board exam and also planning to take it months from now. I just hope everything would go according to what is planned. So that once pass the NCLEX and work as a nurse, there's no big problem at all.

  17. You will be fine with your parents as cosponsors if it comes to that.

    However, I assume you are planning of finding a job soon? There will be some months after filing before you need to supply the affidavits of support - plenty of time to secure a job.

    Yes i am planning to work as a nurse in a hospital as soon as i pass the state board exam. I'm just a little bit worried if ever I wouldn't be able to pass yet when the affidavit of support is needed.
