    also i have a question regarding the G 325A, the residence for the last 5 years and the employment for the past 5 years. the example on the guide shows the address when he was a child or a newborn. do you have to put that even though it's only asking the residence for last 5 years?

    i have a question regarding my fiance information, her address was too long, so i was thinking if i can write down the address to fit it in the tab?

    also on question 15. is guam part of the U.S? the question is "has your fiance ever been in the United States?" because she used to work in guam and the following 15a-h do i have to do that too?

  3. Was your fiance born in Guam? Or was she just visiting there? Guam is a U.S. Territory, so I would think the answer would be yes, if she's not a Guam native. Other opinions?

    oh sorry i forgot to mention, she was in Guam for working purposes only, she had business visa not the temporary worker. she's back in her foreign country now.

  5. In any case, once you file for AOS, USCIS sends her a NOA1 she will start a new period of authorized stay until the application is adjudicated.

    okay good to know, thanks so much for the answer. the thing is after we get married in December, she will need to go back to Guam to work bcoz of her contract with her employer, i'm just worried about the process. i don't want her to go back to her country coz the contract expires. . i want her to stay here in mainland with me.

    well like i said i'm planning to marry her on December, so she only have 5 months left after that. That's why i want to know if she can stay here when her H2B expires or she needs to go back to her country to wait.

    So my girl has H2B Visa she works in Guam and the visa will expire on May 2017. I'm planning to fly her here in the mainland and get married on December, i am wondering if i file the I-130 and the AOS together. Once her H2B Visa expires can she stay here in the USA while the paper is on process? or she will have to go back to her country to wait? also do i send it to dallas dropbox or CSC since I'm from California?

  8. STEP1: buy her a ticket to CA, apply marriage license and get married. Her being a holder of H2B saves you a lot of anxiety :) on processing K1 VIsa :idea:

    How's it going? Just my opinion based on my observation(s), you want to make a big deal out of a small process. I say a "small process" based on the lengthy process(es) for most USA petitions....

    Your gal is in a USA territory, for your purpose(s) she is in the USA. So, once you guys get married in Guam there is the AOS, adjustment of status petition/fees and so on... I do hope everything works out for you guys.

    H2B has no restrictions on where a person can travel to in the USA. She has already been admitted to the USA. She can travel to anywhere in the USA. She can marry you anywhere in the USA. Then she can adjust her status.

    They might take a look. But her visa is not expired, right? So she has nothing to worry about.

    it will expired in couple of months. but the employer will do the paper works for her for renewal.

  11. To be clear, she can leave and reenter the US if she wants, so she could take any flight she chooses (either via Hawaii or via Japan) but if she wants to avoid going through immigration on her way to the US mainland, she should choose the United flight via Hawaii.

    I'm from San Diego, when she did the united via hawaii going to mainland. what is the best airport option i can pick her up and her not going through immigration. LAX or San Diego?

  12. You can marry her in California.

    Boiler was telling you her Visa has no travel restrictions. So marry her wherever you want then file to adjust her status.

    You do not need the K1 she is already in the US.

    So get her to California if that is where you want to marry.

    Then start the process to adjust her status.

    oh okay. so even though she has the H2 Visa she can still fly in the mainland? i'm kinda scared what if when she gets here the immigration ask papers like greencard from her or something. Sorry i'm kinda new to this situation. thanks for the help
