I would suggest considering a K-1 fiance(e) visa if you are not married yet. The main reason for that is the time difference in approval for a fiance(e) visa vs a spouse visa (6 Mo to 1 Yr). Also, my understanding of a spouse visa requires you to be already married before you can start the petition process.
As to suspicion of the situation, you have proof of divorce of your previous relationship. You should have no problems with the process.

Glad I found this! I had the same question, except that my fiancée lives in Brasília (another consulate location). I actually hired a lawyer at the recommendation of a friend who married someone here from Nicaragua, and he put Brasília. I believe I mentioned Rio was probably what should have been answered, but him and his secretary basically told me, "don't worry about it." Thanks!

One issue I have with the process is that VJ says that petitions with an NOA1 of March 9th are being processed...
I have an NOA1 date of March 1st, no RFE (yet), and still no NOA2. I assume that the problem lies in the algorithm that VJ uses. Their data shows that they should have petitions completed sooner than they are, but over time it will probably smooth itself out as later and later NOA2 dates come through.
