  1. I am a US Citizen filing I-130 for my spouse. I came to the U.S. on visit visa and I am a U.S. Citizen now through naturalization. Under the "Information about your relative," question 13 asks "Has your relative ever been in the U.S.? The answer is Yes because I reside in the U.S.

    Then, question 14 asks for how I arrived - that will be visit visa and asks for arrival/departure record I-94: I can provide that too.

    Then, it asks authorized stay expired, or will expire, as shown on Form I-94 or I-95.

    I am confused about whether the above questions are applicable to me as a U.S. Citizen?

    Any guidance would be really appreciated.

  2. I need help with Question 13, and 14 of the I-130 form. I was a permanent resident, then received my citizenship through naturalization few years ago.

    For Qt 13, "If you are a US Citizen, complete the following:..." I marked Citizenship through Naturalization.

    For Qt 14, "If you are a lawful permanent resident alien, complete the following: Date and place of admission for or adjustment to lawful permanent residence and class of admission." Do I need to enter my permanent residency information also?

    Do I have to answer both 13 and 14? or do I have to answer just 13 and leave 14 blank?

  3. Thank you both for your comments. I just came back but as I started this process I realized I made some mistakes.

    As for the english Nikah Nama - does it have to be remade in the presence of those same people who signed as witnesses? Can I just make the english translation and send it with the urdu version?

    Right now my wifes ID card is being made and then she will apply for a pakistani passport. Can I start this process with just the i-130 form ,her pictures, marriage certificate + english/urdu nikah nama, and all of my stuff? then by the time i have to send the other packet i will have all the other documents made and ready ( next 2-3 months)

    They want bonafide marriage details now but I think he nikah nama has it explained that she has ownership in the house my father own and hence she is entitled my share. That's all I have.

    She also has the sign the G-4xxx form right?

    In my opinion, all you need is a translation of the nikah nama in English, no witnesses or signatures needed on the translated version because it is simply a translation and was not a part of the actual nikah. I would send a copy of both Urdu nikah nama and its English translation.

    Only one partner must be an Indian citizen.

    Only one party must have a UAE residence visa, but if only one party is an Indian citizen, he or she must be the UAE residence visa holder.

    Bride and groom can be any religion. Although if bride is Muslim and groom is not, check with Dubai Courts if marriage will be recognized in the UAE.

    Three witnesses are required, all must be resident in the UAE and two must be Indian citizens (or possibly all three if both bride and groom are Indian citizens).

    Allow up to two months - a one month waiting period required after publication of "Notice of Intended Marriage".

    See consulate (or embassy) for further details of documents and attestation required prior to marriage solemnization at the Indian mission.

    News reports in 2008 said that the Indian consulate was requiring attested letters of consent from parents of the couple (or death certificate if mother or father dead). But consulate website information does not specify this requirement, and says parents are not notified (last checked Mar 2015).

    You mentioned that at least 2 of the witnesses must be Indian Citizens. However, in the link above, it says that 3 witnesses are required for the marriage registration. All three must be UAE residents. But it doesn't say that any of the witnesses must be Indian citizens. Am I missing something?

  5. I am a US Citizen and my fiance is an Indian Citizen working in Dubai, both of us are Muslims. We plan to get married in Dubai and then apply for CR-1 visa. I have researched about getting married in Dubai and found out that the US Consulate in Dubai does not conduct marriages. Therefore, we will need to go to a court in Dubai for marriage. I wanted to know if anyone here is a US citizen who went to Dubai to get married and filed CR-1? and if they could guide me through the process?

    These are some of the requirements that I found online that I would need:

    Full birth certificates

    Ten year passports and photocopies

    UAE medical fitness certificate and blood test undertaken at Ministry of Health affiliated medical centers - do I get this from USA before going to Dubai?

    Sworn affidavit that you are free to marry - Where do I get this from?
