    They did scan the docs and send them to Richmond. I think the problem is we submitted the wrong 797. We sent the one for the K1 visa, not the AOS. I think we'll just go back and bring them the latest NOA and hope that works. From what I've read here, it should, so that's a start! If not, we're a month into waiting for his EAD, so it shouldn't be too much longer until we have that. Thanks for your help!! I'll definitely touch base if we need more help with Richmond!

    I filled it out real quick and it says the accept an unexpired employment authorization document as proof of legal stay. Good luck!

    Thanks! yeah, we did that before and brought along his passport with his visa and I-94 (which the documents list states can be expired or unexpired). The ladies at the desk accepted it and were surprised when the system wouldn't allow them to process it. We had to wait for a call from the capital in Richmond and they said they needed a 797. We took the NOA1 we had and they said that didn't work, so we thought we just had to wait for his green card. Guess we will try again once we have his EAD. They saved everything and said his tests would be good for 6 months, and he should have his EAD well before that!

    Yes ma'am. Little back story; They called my verification finally got through (with the NOA1) so I could come in and either get a permit or do a drivers test the next day. Nonetheless I chose the drivers test the next day and came in. I showed them my EAD right away and she was like, "Oh, that's all we needed! Would have saved both of us a lot of hassle huh!" I had my license within a half an hour. No stuck in verification, nothing.

    That's a relief to know! I was worried we'd have to wait for his green card and was scrambling, trying to think how he'd get to work! I drive all day for my job and have varied hours, so it's not like he could take me to work or I could take him, lol. Thank you!

But it's not unusual for the DMV not to issue a driver's license after an I-94 is expired (based on your timeline this is the case) but before you receive your EAD. The issue is you don't have any legal status. You have authorized stay while AOS is pending (so you can't be deported just for being in the US), but no actual legal status.

     

    Hopefully somebody from VA can chime in and confirm VA's DMV's policies. Best wishes!

    But you were able to get your license once you got your EAD?

    I don't think you can use the I-797 or I-797C  from your K1 because that's a complete different case.

    From what we were told, they want one that has a date. We have I-797's for both his EAD and his AOS, but they don't have a validity date or something on them. We really just need to make sure he can get a driver's license while we wait for his green card so he can work with his EAD, but it's sounding like he can't get on. Not in Virginia, anyway.

  7. Does anyone have any info on how to get a driver's license while waiting for EAD/green card? We've filed everything we need to and my husband took and passed all the tests, but the DMV said he needed a valid 797. We have plenty of them, but none give dates, which they were wanting. The only dates on the 797's are when the packets, etc. were received. Do we just try out luck and bring the NOA we received when his K1 was approved. We live in Virginia, and I can't find anything on the DMV website about this. I checked a million times before we were and was sure we had all the necessary paperwork, but it seems we didn't. Just didn't know if anyone else had any experience with it.

    I've read through and read about the immunizations and I think I'm clear on what I need to send, but just want to make sure.

     

    My husband had his medical done in London by a USCIS approved civil surgeon. At the time he was told he needed an additional 3 vaccinations, but he opted to get them done by his GP because it was going to be $200 cheaper there than in London. He got them done, had them recorded, brought them with him. We pulled the required sections needed to get them transcribed, but it seems like NONE of the civil surgeons we talked to knew what to do. They all wanted to do a full medical AGAIN, despite us showing them the instructions on the 693 that because he came over on a K1 visa, and his medical was done within the year by an approved physician, he didn't another. We finally found one willing to transcribe his immunizations. They did so, then gave us a copy and sealed a copy in an envelope and told us to send that envelope to INS, and not to open it. I know we just need 4 sections filled out, so is it okay to just send those, or do I send the entire form that only has those sections filled that is in the sealed envelope?

    We found plenty in our area, thank you! And yes, we do have his records. They sent his records along with the additional vaccinations he needed, so we just need those transcribed onto the form.

I'm helping my husband fill out the G-325A for our AOS packet and where it states "Former Husbands or Wives" do I need to list if I (the American citizen) have had a former marriage or is that for my British husband? He's never been married before, but I have and I'm a little confused as to what information is needed. I looked on the form instructions, but didn't see anything mentioned.

    If before, and they are marked on your DS3025 as completed, send a photocopy of that document in with your AOS application. This does not guarantee that you will not receive an RFE, asking for a new transcription. It should in theory, and many have been successful - but it does rely on factors out of your control: such as knowledge of the officer reviewing your case, the USCIS not losing the document, or the officer actually bothering to look into your medical. Be aware that it can happen.

     

    If after, then you will need to go to a civil surgeon in your area that will do a vaccination transcription (only) onto form I-693 to be recertified. The semi completed form will be placed into a sealed envelope and you can send that in with your AOS. Refer to the I-693 instructions on how to complete the form for K1 adjusting applicants.

    AH. He got them done after Knightsbridge. I'll start looking for our local civil surgeon! Thank you so much!

    as for vaccines, take a look on the ds3025 he received back from his medical, if it's marked complete, good, he will need to send a copy of that with the aos papers. If it's not marked complete, he'll have to go to an uscis approved civil surgeon to have his vaccinations transcribed to the i693.

    I am sorry if the below questions are found in other places here I cant figure out how the search function works!


    Anyway. My fiance is here (yay!) and we were married two weeks ago (yay again!).  Here are my questions:

     

    His visa stamp says it expires April 18, 2017. But we should be okay as long as we've filed the AOS before then, right? 

     

    He had his medical done in the UK, as well as his completed vaccinations. He did not, however, get the vaccinations done at the same time as his medical. He went to a local travel clinic to get them done rather than make a third trip to London. My question is, how will this affect our paperwork? He has all of the vaccinations and has documentation, but I don't know how or if that will affect us.

  14. Okay, this may be a dumb question, but here goes. I am helping my fiance fill out the I-485, I am the US citizen. When it comes to the portion where we need to fill out his current spouse's information, which would be me, do I list my new married name or my maiden name?

    So I have what may be a dumb question. My fiance is here (yay!) and we are going tomorrow to the social security office to apply for his card. However, the guides say we need to bring the I-94 with us, but neither one of us know what an I-94 is. When I looked online, it said it was a form for a non-immigrant, yet the K1 is an immigrant visa, correct? So I'm just a little confused as to what we need to bring with us.

  16. Most of the countries send packet 3 either to you or your fiance's email.

    Your fiance/e should also received the hard copy of NOA2 as you will eventually need it once you get to US for AOS. You can also email your embassy for your packet 3.

    I have the NOA2 hard copy as I am the US petitioner. I'm just keeping that with me, unless he needs it for the embassy interview? Thank you SO MUCH for your help!

    It should say "Ready" by now.

    Yes, just checked that and it says "Ready." So I'm assuming that means we need to wait for the embassy to send him a packet? I'm sorry; I've dug through guides and such and even been on the embassy website and it's all just a little confusing. I read somewhere that the London embassy will send him a packet with instructions on how to schedule his interview along with forms and others that say no, no packet, do it all online, and I have no idea which one is correct, lol.

    We received our NOA2 about 4 weeks ago, but never heard from the NVC. Upon emailing them 2 weeks ago, I was told to contact the embassy in London where my fiancé will be interviewing. To do that, I needed a case number, so I called the NVC and obtained our case number. I still have not received a letter from them and my fiancé has not heard from London. Is this normal?? I've read the guides and know there's not much we can do (aside from him getting his police check done) until he receives a packet from the London embassy, but has anyone else not received a letter from the NVC, yet was able to obtain a case number?

  19. Should have mentioned I'd read the guides, sorry! He was here for a visit when we got the approval, so everything he needed was sent back with him. I'd read in other forums that people had gotten their medical done before hearing from the embassy, but wasn't sure if that was embassy specific. I see now where London sends paperwork/links for him to set that up in the letter they send him, so I guess now we can just wait. Some more, lol ;)

  20. My fiance and I received our NOA2 nearly 3 weeks ago. He's going to be coming from London. I know that our packet will be sent to the NVC and from there to London, but should he go ahead and schedule his medical now, or do we need to wait until London gets our packet? We naturally want him here as soon as possible, so if there is anything we can do to make it flow more smoothly once London gets our info, the better.

  21. We received our NOA2 about two weeks ago. My fiance is currently visiting me here in the states and is leaving on Sunday. I am trying to get the packet assembled before he leaves so he can just take it with him. I have copies of our original packet made, but do not have extra passport photos to attach - do I need to get more photos made to attach to the packet, or is it okay to not have them? He will be going through the London embassy, if that's any help.

    My fiance and I got our NOA2 two weeks ago and I am busy getting everything together to send to him. As I was reading the guides and checklists and forums, I ran across some confusing information about the K1 visa and was hoping someone could clarify.

    The flow chart says that once the K1 is granted, the beneficiary must be in the states within 6 months. However, I also read on USCIS website that we have 90 days to get married once the visa is granted. So what's the deal? Do we have 6 months or 90 days? OR do the 90 start once he's immigrated here via the K1?
