  1. With any criminal problems or past with immigration it's always best to consult a law expect first. He should be fine but you never know. Immigration is so strict these days. I was denied my citizenship just because of an old address that was still on my w2. I filled under the three year marriage rule. With a criminal past dont just assume that immigration will just forgive just like that.

  2. Today i learn something new, i had never heard of "first cousin once removed" until i read your thread loll...i have always refere to my second cousins as just cousins. At first i taught wow do u really want to marry your cousin hmmm and to make it worst you are so much older than her and also a diaspora, than I realize its actually your second cousin which is not too bad eventhough I probably wont do it my self. To answer your question Haiti is a very tough counsulate to get thru and once they realize you guys are family by blood its almost a garantee of a denial so like others have say you have to build a strong relationship with plenty of proofs. you have a tough process ahead of you so good luck!

  3. I just receive my denial letter and to my surprise it is not about taxes like i taught but w2's. On my wife W2 it still has her mothers address instead of our current adress because of that they are saying we dont live together, omg are they serrious? On our taxes is say's the current address. My wife never updated the address because she work as independent contracter, they never mail her w2 she just have an accounting print it out at the end of the year. And the old address is her parents address witch she still has some letters that Go's there sometime's. Does any body think i can appeal this because we can prove we live together. We have bank staments, loan staments, insurance statements, our lanlord can write us a letter as the house is my father's...please help!!!

  4. If you google for main causes of N400 denial, you'll find back taxes being one of the major one. For you it was normal to apply on the last day, wait for the bills from IRS and pay later. For the officer, it was a serious issue. He wanted to see either all back taxes paid or have an agreement with IRS to pay in installments. He didn't see that and denied your application. While you have your justification that you have to right to wait till Apr 18 to file for tax return even though you knew you owe IRS, he also has the justification that even after knowing the upcoming interview date, filing that late and not producing the required documents are just the excuses.

    You might definitely wanna wait for the denial letter for the specific reasons.

    i dont think you know the full story but anyways what you said is probably the way that officer saw it. By the way he did not ask to see instalment agreements or any proves that i have already send them the first payment of the tax debt we have. He just ask if i had back taxes which i said no to and that my wife apply for an instalment agreement already which we probably wont use really because we will pay everything this month. He just took all the tax return papers and send me on my way. What we did for 2015 taxes is not any diferent from when i came here in 2011 till now. Personally i taught not paying or refusing to pay was the problem me. Anyways lesson learn, if thats the reason the io denied me without even giving me a chance to explain is fine, i will just apply again under the five year rule again than and have all my payment prove's hindy this time and hope for the best.

    because i want to hit the ground running. I wasnt expecting this denial, so i am shock. I just wanted to see if anyone had a similar situation like mine. No records but possible tax issues only. Thats why i ask loll. I still didnt get the letter yet and i am just hoping it was sent by mistake loll
  6. Did they claim you didn't register for Selective Service at the interview? If so, were you able to show proof you did?

    that officer was full blow focusing on back taxes. I am beggining to think is it because i had win some money from the lottery(like 15 grand) in august. All though i didnt pay the tax on it right away i did claim all of it on my taxes and have to pay the taxes now. We file our taxes late like the last day which was the 18 of april this year and the account file an extension/instalment for us to pay them. Thats why i am confuse about this denial?
  7. It could be something else other than your taxes. Because it is the tax issue, you will be hearing from IRS soon.

    So be patient and wait for the official reason for denial.

    maybe so, and i am not worried about the irs because for the last 5 years i have been paying them as soon i got the bill from them. I wait to get the bill because i want that for my own proof and safe keeping.
  8. Wait for the denial letter so that you can figure out what you're thinking about appealing.

    You're right that usually you would get an RFE to prove that you had a payment plan in place.

    However, there are other reasons (both related to and unrelated to the tax issue) that could have resulted in the denial.

  9. You should wait for the official letter to see why it was denied instead of guessing.

    . I am guessing because i am stress and shock because other for taxes there was no issues, and why just denied people like that, i taught i would of get a RFE if anything was missing or i didnt pay yet
  10. You mean pay the 2015 tax debt and apply again? Even when i applied under the 3year rule witch would be 2012-2014. If they denied me for that would be just a bummer wow, they didnt give me a RFE to even show that we have an instalment with the goverment but just shoot for denial and keep my 700$ hmmm. I wanted to appeal and would ask anyone if they think i even have a chance of winning. I would just hate to start over from scrath all over again?

  11. I came to the usa in march 2010 with a k1 visa, i got my temporary card in august 2011 and two years later my 10 year green card. In february 2016 i applied for citizenship under the 3 year rule, had my interview in april and the office told me a decision could not be made at this time. I pass the civic test. Now i check my case status online and to my surprise it said they denied it. I could say i dont have any red flags, my marriage is still intack and i have no criminal records at all. I have no back taxes for 2011 thru 2014. I filled our taxes late this year, like the last day which was the 18 of april, my wife has not pay those taxes yet as we are waiting for them to send us a bill. I did win some lottery in august 2015 that i didnt pay tax on but did claim in as income on my taxes where they added those taxes on the amount i own. During the interview the office was focuse on back taxes and selective services, i did apply for selective services as soon as i got here in 2010 when i apply for my social. So my question is would they denied me just because my wife and i didnt pay our 2015 taxes yet. We are planing on paying everything this month by the way like we have been doing for the last 4years. Please help!!!!!!

  12. is a death certificate require in other for my father to immigrate? My mother wish was my fathers wife pass away in 2013 in Haiti. When i called NVC last week to found out if they had receive my civil documents i sent them the person i was talking to inform me they will need my mother's certificate of death , is that accurate? I taught they would need my fathers birth certificate and my and that was it.
