  1. Hmmm useful information. I didn't make this clear but we leave for England tomorrow and I am wondering if there is any benefit to me taking care of this whilst there if only to save some money. I know when I was applying for my passport the consulate in DC wanted a lot more than if I renewed the passport whilst in the UK. Thanks for the information though. Just out of interest as a uk citizen do you know whether you can also hold usa citizenship? Do you plan to apply for citizenship?

  2. Hello I have a 15 month old who is traveling back to the UK with my American wife. She was born in the US and holds a US passport. I would like to register her birth in the UK so she can take advantage of dual citizenship. Does anyone know how to go about doing this i.e. is it any different from registering any birth in the UK? Or is she even able to have dual citizenship? Does she have any rights as a child of a uk citizen? Is there a benefit to doing this?

  3. Not sure if this is the right place for it but I am going to be applying to remove the conditions on my residency at the end of the year. My wife has fallen pregnant which we are both really happy about. I have a few questions:

    - will my child have dual citizenship?

    - Should I be putting the child on my passport and my wifes?

    - does the fact that I am still conditional present any problems in this case?

    I love this site it was my savior when I started to struggle on this journey and is now my only source for information. Thanks for your help in advance.

  4. Here is my current progress in the immigration process. A couple of weeks ago we had our interview for the greencard and everything went well except the FBI background check wasn't completed so the guy said even though everything was fine he couldn't actually approve us until the background check came through as clear. I have my EAD in hand and started work today and there was a question on one of the forms i had to fill in which asks the following and i am not 100% sure of which one i should check:

    "I attest,under penalty if perjury that i am ( check one of the following):

    • A citizen or national if the united states ( I am confident i am not this one)
    • A lawful permanent resident (Alien #) A__________________
    • A alien authorised to work until __/__/__ (Alien # or admission #) (I think i fall in this category until my greencard comes through

    Please reply ASAP as i need to get this form back into work tomorrow

  5. I posted this some days ago and despite having 44 views noone replied and i'm getting nervous now hence the repost.

    Ok we have our interview date now

    1. I heard that for the establishment of my eligilbilty for lawful permanent residence you basically present your k-1 visa and your entrance card. Is this all I need to establish my eligibility? I know i need all the other stuff too but is this all i need to cover this?

    2. I know we also have to prove my wife's citizenship too. Now we have her birth certificate but her passport still has her maiden name on it...is this a problem? Are there any other documents she can bring?

    3. Being the great thinkers they are at immigration they have given me the middle initial N on my EAD. I do not have a middle initial they had taken the N/A in the middle name box on my form to mean my middle initial would be N (Everyone i tell laughs at this story so feel free). My question is is this likely to cause me problems? I called the hotline the told me to send the card back with an explanation and a new EAD form and they would correct it. I don't really want to send it back and they will be taking it off me at the interview next month anyway. Any advice?

    4. On the topic of names my name is D'Arcy yet noone here seems to be able to put that in their system with the apostrophe. I was issued a SS card when i worked at a summer camp a while back which had an apostophe in but when i had to get a new card when i got married they told me the ' would crash the system. I was fine with this until i noticed that I had a SS with the ' on it. Even my drivers license doesn't have the '. All my UK docs do have an apostrophe though. Does anyone think this will cause me problems? It does kind of annoy me that my name is being officially being changed by no fault of my own.

  7. Hi good news we have an interview date but just a few questions.

    1. I have read that the documents used to establish my lawful permanent residence status are basically my K-1 visa and also the arrival departure card. Is this all i need to prove that?

    2. We need to establish my wife's citizenship in the interview I presumed that this would be done using her passport but this still has her maiden name on. Will this cause a problem?

    3. Being the great thinkers they are at immigration they have given me the middle initial of N on my EAD card. I don't have a middle name but they must've taken my N/A in the middle name box on my form to mean my middle initial is N (Everbody laughs at this story so feel free). I have called the helpline they tell me to send it back with and explanation and another EAD application form to have this rectified. Any advice on whether this middle initial is important or should I just invent myself a middle name?

    4. Staying on the theme of correct names my name is spelt D'Arcy the problem being the apostrophe. Nobody here seems to have a computer system that can process my name in this way. I had a SS card issued when i worked at a summer camp with the apostrophe but this time around my card was issued without because the lady told me it would crash their system. I was fine with this until i checked my original ss card and it did have a ' in the name. Even my new driving license will not have this apostrophe. All my UK docs have this apostophe in it so will this 'cause any problems also? This does annoy me because I don't want to effectively change my name here.

    With no timeline, it is difficult to ascertain what exactly you are asking.

    Are you referencing an AOS interview? Please be more specific.

    I have been asked in along with Mrs D for an initial interview and the paperwork says to bring in "All documentation establishing your eligibility for lawful permanent residency" Can someone please tell me what documentation this consists of? I have no idea as the other stuff they list seem fairly comprehensive so i don't know what this includes.

    Also any advice things to look out for at this point?

    Sorry about that too caught up in my own sitution to think not everyone would know what i am talking about. I am talking about an interview with regards to a adjustment of status. Thanks for your help on identifying my mistake William 33

  10. Here's a breakdown of the experience as brief as possible:

    • submitted for change of status and EAD
    • waiting long time stuff sent out to incorrect address we wait 45 days for the info to be resent and turn up tunrs out to be a request for more proof my wife can support me dispite submitting all they asked for with inital app. Also biometrics appointment for two months ago.
    • Biometrics taken same day as i call in to rearrange my appointment (nice surprise) also sent all evidence that my wife can support me AGAIN backed up by my inlaws stuff to say they can support me.

    We also contacted our congressman to help expediate the process within the very frustrating period of time mentioned above. ANYWAY...today I have a letter asking us in for an initial interview. There is still no sign of the EAD though. I have four questions:

    1. where does this put us in the application process from what i read on this website I am one step away from holding a greencard? The thing i don't get is this piece of paper says it is an initial interview so does this mean there is more to come? Sorry that is two questions

    2. Can anyone offer any advice about what to expect or things to look out for? In my experience so far i am thinking of collecting all the stuff it asks for and the stuff it says you don't need to bring if it has already been submitted (affadavidt etc...) the only problem is i will have to pay again for the medical stuff. Am i just being a pesimist jaded by my experience so far or am i right on the money?

    3. how long before i can become a citizen? and can a uk citizen hold dual citizenship?

    4. A little premature but what is the situation once we have kids are they british or American and can they hold dual citizenship?

  11. Here is a brief overview of the situation:

    • Submitted forms for AOS and EAD received notices confriming receipt
    • Two pieces of paperwork sent out to us in July returned as undeliverable because USCIS got our address wrong noone is able to tell us what was sent requested paperwork to be remailed.
    • Wait 30 days (lose out on two job opportunities because of lack of paperwork) still no paperwork.
    • Call again to request paperwork be resent eventually arrives 45 days later now September. Turns out to be a RFE concerning I-485 and Biometrics appointment (The same date and time they originally gave me for July we are now in Sept)
    • Was told i could get temporary EAD on helpline by immigration officer called into local office they told me no the clock had stopped ticking way back in July when the paperwork was returned and wouldn't start again until i had snet evidence in.
    • Surprisingly called into the Biometics office to rearrange my appointment was told to come back that afternoon and everyone there was so pleasant very much a contradication to the cold A'hole i had delat with in the morning at the local immigration office

    Ok i had to get all that in because it is so so frustrating and i needed to vent and thought it may be useful to someone if i shared. Here is my problem the evidence they requested is so general it almost reads like we never submitted anything at all with relation to my wife being able to support me. We have a letter F. a check box and a number 11 and it has half a page worth of bumf and the opening line is the general jist of the letter "We are unable to determine if you r houshold income meets or exceeds 125% of the federal poverty line."

    I know that we submitted everything they asked for with our initial app and I know our income is fine. Either way I have started re-collecting it all in again and will be submitting a back up of my inlaws affidavidt of support. I have five questions:

    1. has anybody else had a similar experience can you share 'cause this is soul destroying stuff.

    2. Do i have any recourse because we have been held up for so long because of their mistake i.e. can we get our application bumped up the list to where it should be at this stage.

    3. Can anybody shed any light on why they need this info again or give us any tips/help on what we should be careful of when re-submitting all this stuff.

    4. What can i do about my EAD application they are now saying i am not eligible for interim EAD for another 90 days?

    5. Can someone please confirm that i am submitting the correct documents the list of what I have is below:

    -The RFE letter with barcode.

    -Explanation as why we didn't anwer this request sooner.

    -wife's affidavidt of support.

    -Wife's notice of appointment.

    -Letter confirming my wife's employment form employer.

    -4 of most recent payslips (4 months worth).

    -Everything including W-2s she submitted for tax purposes for the last 3 years.

    -Inlaws affidavidt of support.

    -Copy of father inlaw's passport.

    -inlaws' tax return and W2 for last year.

    If this is complete and i have everything i am at a loss as to what went wrong 'cause apart from the backup inlaws paperwork we submitted all this stuff first time around. I suspect it may have gone missing with the RFE saying it was a request for initial evidence. I just don't undestand they let you come over here on the basis of one affidavidt set up life and then need another one.

  12. Ok thanks to both of you for you help. It does make me feel a little better knowing i needed the biometrics done before i would be authorised to work. Am I right in thinking an NOA is the paperwork confirming receipt of the application? I have checked the reference section for what NOA means and if this is correct I have two NOAs one for the change of status and one for the permission to work. My question is do you think that the paperwork that was returned to USCIS as undeliverable was an appointment for the biometrics possibly? I have checked the dates also and the acual filing date is 22nd of June so i guess i still have around 28 days before the 90 days timeline is up.

  13. K firstly i am so disappointed I had a nice foot in the door type job lined up and they really wanted me but said because of my situation...no permission to work i didn't get the job :crying: . Here is my situation: i have had something sent to me both to do with my change of status and the permission to work but they were returned as undeliverable even though we have had other stuff from uscis. USCIS say i have to wait 30 days before they can do anything i can see nothing has been updated on the case online part of their website and there are 3 days left before the thrity days are up which inconvienantly takes me to saturday. I have just got off the phone to be told if i don't receive anything by saturday i have to call back and wait another 30 days for whatever this is to be resent.

    1. Do i have any recourse over this if i don't get anything within the 1st thirty days?

    2. Is there anyway i can find out what it is they sent me?

    3.Given that i was sent something regarding my change of status and permission to work and both were returned any ideas whether it would be a request for more info or actually notification that something was sorted out?

    I think i may cry if i finally get it and it's permission to work 'cause i would've got my job.
