    I just get a RFE - notification... I don't know the content of it yet, but I sent them the same thing as you " "Certidão de Casamento com Averbação de Divórcio" translated and notarized. So probably I'm gonna have the same problem as you. What did you do? Because this is the only divorce document that I have.

    Hi Stella,

    Since i sended inside the package and i didn't figure what went wrong the first time I though it could be the stamps on the first "Certidão de Casamento com Averbação de Divórcio" because they were not too legible or it could be that it was an old document from 2012.

    So I went back to the notory (cartorio) and ask for a second copy. they give me another with a more updated date. I took a copy of that (simple black and white copy). I also ask for 2 notorized translation of this new original "Certidão de Casamento com Averbação de Divórcio".

    I ask for 2 translations because u will need later for the AOS with the Original "Certidão de Casamento com Averbação de Divórcio"

    So i sended :

    One original translation for the new "Certidão de Casamento com Averbação de Divórcio"

    One simple copy of the updated second copy of "Certidão de Casamento com Averbação de Divórcio"

    what i did was i highlighted the observation in the copy of the "Certidão de Casamento com Averbação de Divórcio" and in the translation. and i also printed this thing below in this site. Highlited and sended with the translation and copy of new Certificate. They received on June 24th and now i'm waiting for the NOa2.

In order to have an annotated certificate, an applicant needs to go to a notary (cartorio) and request a second copy – recently issued - of the birth and/or marriage certificate. If the birth or civil document does not have an annotation, it does not necessarily mean that there have been no births, divorces, or deaths.

    Divorce certificates are available as an amendment that is annotated on the previous marriage certificate.

  4. Hm, it shouldn't be a problem if ir was properly translated and notarized... mine went well and, as yours, it's a "Certidão de Casamento com Averbação de Divórcio"

    Estou em duvida, fui no cartorio ontem e pedi uma segunda via, agora não sei se mando a original ou uma cópia autenticada junto com a tradução original.

  5. Try re-sending what you already did along with the laws showing that what you provided is the legal divorce document for your country.

    I was looking for other cases like mine and one of them resend the document highlighted with a lawyer statement saying that accordingly by the law nº XXXXX that is a true and official divorce in our country.

    So a I'm going to do the same. Going to resend the copy of the marriage certificate highlighted in that part that says i'm divorced, plus the official translation by a notarized person (not a copy) and the lawyer statement saying the accordingly with our brazilian civil Law nº 1.124 it's a official document proving my divorce and of course the official translation of that statement too.

    It will give me a lot of trouble but since i only have "one shot" i can't afford doing any mistakes and have our petition denied and restart all over again.

    I also have almost the same problem. My divorce docket was signed electronically so there is no hand written signature. do you guys think this may be a problem?

    I'm a March filler and we got and RFE on June 7th but they requested a Divorce decree signed by a judge or magistrate.



    Here is the biggest problem.. in Brazil there is no divorce decree certificate for consensual divorces made after 2007. The official divorce document for consensual divorce (when both wants the divorce) is the Marriage Certificate endorsed, which means that at the end of Marriage Certificate there is an observation where is validated divorce and which also says that my name has returned to the maiden name. I sent a copy of this certificate together with a certified translation of the document formalizing my divorce inside the package

    This document is issued in the Registry along with a lawyer. According to the Civil Procedure Code - Law No. 5869 of January 11, 1973.


    Establishing the Code of Civil Procedure:

    Article. 1,124. Approved the consensual divorce, to endorse the judgment in the civil registry is not necessary court order signed by a judge.

    Article. 1124-A. The consensual separation and consensual divorce, with no minor or disabled children of the couple and compliance with the legal requirements regarding deadlines, may be made by public deed, which shall include the provisions on the description and the sharing of common goods and alimony (if any), and also to agree to a spouse back to using her maiden name or maintenance of the adopted name when it gave the wedding. (Included by Law No. 11,441, 2007).

    § 1 Scripture does not depend on judicial approval (no need for a decision by a judge) and is clever title for the civil registry and land registry. (Included by Law No. 11,441, 2007).


    So, there is no Divorce decree signed by a judge in my case. What should I do ?

    I have a question and i hope someone can help me with it. After fiancee visa is issued on passport, my tourist visa will be cancelled? My fiance asked an officer at Miami airport who said that i can still use the tourist visa for travel even if i have the fiancee visa because they are two different visas, independent of each other.

    Does it mean that after i have the fiancee visa is on my passport i can travel to the stated and use my tourist visa, return to my country and later (before the fiancee visa expires) go back and use the fiancee visa?

    I thought that my tourist would be cancelled at the POE. Is this information correct or maybe the officer misunderstood the question?

    Your tourist visa it's cancelled in the minute u cross the USA customs with the K1 visa.

    The officer in Miami or any airport you entry will stamp your B1/B2 visa with "Cancelled by procedures" something like that...this means you didn't do anything wrong for having it cancelled it just intern procedures.

    I know this because my friend who just got married with an american she told me that. Which means that if something bad happens and lets say u dont get married in 90 days ur K1 expires u will be out of status in USA and yes if u leave USA before the 90 days expires and decided to come to USA later as a tourist you will have to get another tourist visa. Fill the form.. pay the fee..all over again.

    If you think about it does makes sense, because if u applied for a K1 visa u will later become a citizen and not a tourist after marriage.

  9. So, I received my NOA2! Yay! However, I am super confused as to what I am doing now. I just visited my fiancee again in Brazil, Sao Paulo to be exact, and I left her a copy of the I-129f packet.

    Now I know I need to send her the Affidavit of Support.. I just started a job in sales, where it is purely commission, So I have no way of proving a steady income, so I asked my grandfather to sponsor her. How do I go about this? The guides I have read have little to no information or are very vague..

    I don't necessarily know how I will fill the I-134 form out, having no proof of income. Maybe tax records from last years jobs?

    And how much does my grandfather have to claim he will support her with? Is it minimum wage a month? Or a certain lump sum up front?

    Also, what else do I have to do to get my part all out of the way so that she can schedule the interview over there in Brazil?

    There was also something I read about Police reports that I never read in the guidelines...?

    Hey congratulations! I'm from Brazil and my fiance is American.

    When did u got the NOA1?

    Me and my Fiance we are waiting NOA2 since we sended in March 10th. We got NOA1 in March17th. So we are waiting 60 days already ... :(
