  1. Hello Everyone,

    I am in the process of applying for a passport for my minor, adopted child. She is presently a permanent resident, and qualifies for citizenship having met all the requirements. The passport instructions state that we need to submit proof of physical and legal custody. What type of evidence should I submit to support this? I feel like the final adoption certificate satisfies the legal custody portion of this, but how do I show evidence of physical custody for a minor child?

  2. Hi Riblet,

    I entered on a K3, applied for the AOS and EAD and have been out of the U.S. twice since that time. I haven't wrapped up all my personal affairs as yet in the Bahamas, and figured it would be good to apply for the AOS and EAD to reduce the time I will spend sitting at home doing nothing once I relocate permanently. As the K3 visa is a multiple entry visa, your husband shouldn't have a problem. He will, however, as I did, have to come back to do his biometrics.

    From reading information on this and other sites, including the USCIS site, you can encounter issues by entering the US on a tourist visa and getting married. Usually, to marry in the US, you need to file an I-129F which, once approved, allows your fiance to apply for the K1 (fiance) Visa. You will then enter and have 90 days within which you should get married. Then your wife can stay and adjust status in the US.

    Another option: If you get married outside the US, your wife will not be able to return with you to the US to live. You will need to file an I130, get the first notice, and use this to file a I129F to allow your wife to apply for the K3 visa at the consulate in the country where you were married. Once approved, this allows her to move to the US and adjust status.

    I'm not sure what challenges you will encounter now that she has overstayed her time in the US, but once she can prove ties to her country, she should be able to visit you during the process using the tourist visa.

    Perhaps you can consult an immigration lawyer to see if you have any other options. Good luck whatever route you choose.

    Each person has to take responsibility for controlling themselves and addressing "weaknesses" especially when it affects the people we love. Whether we encourage it or not, if it's in them, at some point it will rear itself. We can't control others...it's stressful and burdensome, and frankly not worth it for your peace if mind.

  6. It starts with being secure with yourself and trusting the other person. If someone has it in them to be unfaithful, you can't stop it....where there's a will there's a way!

    As for the drinking, I believe that if someone knows they could do something they will regret because they get drunk, making the choice to drink that much shows that they have some maturing to do. I say, let them go to the reunion, maybe it will be a good time to see what they're really made of.

  7. Hi Everyone,

    I've recently gotten my K3 visa approved, and will be filing for AOS later this month. I had a medical exam done for the K3 and from reading, it seems like I won't need to do the full medical which is good for one year. I didn't do the vaccination portion, as it was not required. My question is, do I download the supplement and have the Doctor complete it to forward with the I485 or do I wait until the form is generated and sent to me to be completed?

  8. I have a couple of questions about the AOS process just to be sure I know what my options are versus consular processing of the green card:

    1. Once I485 is sent to Chicago, how do you know where you will go for the biometric appt (which local office)?
    2. The package that you're given once the K3 Visa was approved, once you enter the US, where is this sent?
    3. Would Chicago (or wherever the AOS is processed) get a copy of the medical done in your home country? or do you have to get a copy from the Doctor and submit it with your app?
    4. Do you download a copy of the form used for the immunization record, and have your Doctor complete this, or is it generated and sent to you when needed?
