    Thanks for your answer.

    We are not worried in terms of wether we fit the financial requirement = my husband salary will cover what is requested + we have personal assets as well.

    The question is more : how do we prove it / what kind of evidence do we need to show, knowing that my husband doesn't have US pay slips yet?

    Is a letter of employment from his employer mentioning the salary enough?

    Do we have to bring bank statements showing our financial assets? Something else?

    My husband is american, we married in France 10 years ago, have 3 kids - and been living in France ever since.

    My husband had a job opportunity in the US,so we decided to move there.

    We started the process in september 2015, we now have our interview at the Paris US Embassy planned for June 15th.

    The document states we should bring I-864 as well as "supporting evidence proving that you and members of your family who immigrate to the U.S. are not likely to become public charges in the United States."

    And in the letter they also mention : "Bring updated Federal income tax information to the interview".

    Taking into account that my husband hasn't worked in the US over the last 10 years (and hasn't paid taxes, even though he has filed the declarations)

    => what kind of evidence should we bring?

    A letter of employment? Bank statements with the total amount of our financial assets?

    We are now in the final stages, with our interview scheduled for June 15th.


    On the instructions for Immigrant Visa Applicants Applying at US Embassy Paris, they mention we should go here https://ais.usvisa-info.com/en-fr/iv to register our address. They mention "please note that you do not need to register your appointment date and time given to you by NVC".


    Yet on the home page the proposed choice to be able to register online is :

    "I have received a Consular interview appointment date from the National Visa Center (NVC), Kentucky Consular Center (KCC), or the Consular Section and I have been instructed to register my appointment on this site."


    Should I nevertheless proceed?

    I am the wife of an american citizen, married 10 years ago, have 3 kids, have been living in France until a recent opportunity of work for my husband in the USA.

    We started therefore an IR-130 for myself and our 3 kids back in september.

    We're at the NVC stage - 3 of our 4 files were "officially received" early January, one of my sons was received "officially" early february.

    We had a setback on my file mi-feb with a missing signature on our AOS. We are still within the 30 to 45 days, hoping that this time it will be ok.

    And we just received a checklist from the NVC for my son's file (the one who had a 1 month delay vs the rest of us), asking for a birth certificate and a passport photocopy - both elements that were sent in the file as requested.

    We don't understand,

    Has anyone had a similar experience? Is there anything we can do? Or do we have to consider they somehow lost elements from his file - and send again (and add another 30 to 45 days to the process again)

    We received last Thursday (Feb 11th) the following mail from NVC after sending the whole package back in december (with a receipt date of Jan-4th).

    We reviewed your I-864, I-864EZ, I-864W or I-864A Affidavit of Support form and supporting financial documents. We found that you didn't provide all the necessary supporting documents or you had incomplete information or you missed some questions on the Affidavit of Support form(s).

    Apparently so the 2 following things are missing in our AOS :

    [x] In Part 8. Sponsor's Contract, please correct the following...

    [x] Item 6.a. You must sign the form and your signature must be original.

    [x] You must submit the following financial evidence:

    [x] Your {2014} W-2 forms(s).

    Based on a previous post on the forum last Friday (thanks to all who answered!!!) – and exchange with our lawyer.

    1. Our lawyer screwed up badly, as he should have advised us to send the original form => nothing we can do here, except sending back the signed form
    2. Regarding the W-2 form : my husband wasn’t working in the US in 2014 (or even before = has been working in France almost his whole life).

    Here’s what our lawyer told us : “With respect to W-2 forms, I explained to the NVC officer why there were no such forms. She agreed with me and asked that I put it in writing for the file. I’ll draft a short explanatory note and have (another senior lawyer) check it Monday.”

    Except it’s Tuesday, and they still haven’t sent us this note…

    My husband doesn’t want to call the NVC to ask the NVC about the W-2 form. He is afraid we will open a “pandora box”.

    At the same time, I feel totally dependent on lawyers that I don’t trust anymore.

    At the time being, we sent at least 5 mails since his last mail, tried to call him, without success or answer…

    => Any advice on how to write this “explanatory note” ourselves to the NVC?

    => Can something else go wrong?

    Thank you all for your answers.

    Lawyer got hold of NVC, who confirmed we need to send the original signature, and a letter of explanation regarding the W2. Lawyer didn't even say sorry about the mistake... I'm so mad we trusted them on this!

    Anyways, we will send the documents, but I have still subject of worries :

    - we have our 3 kids cases also being processed at the NVC right now, which means we are going to have exactly the same problem with the AOS. Is there any way we can anticipate this, or de we have to wait to receive the official instructions from NVC? (With the 1 month additional delay built-in...)

    I'm particularly worried because 1 of the file (1 of my sons) got back-tracked : we sent our files in december, 3 of us got a receipt date of jan 4th, and he got a receipt date of feb 9th. NVC told us he would be back on track with the family once our case will be reviewed, but now I'm even more worried with this setback.

    => signature must be original, we have to re-send.

    [x] You must submit the following financial evidence:

    [x] Your {2014} W-2 forms(s).

    => as we don't have a W-2 form, we'll have to provide some evidence that at least he has paid (or declared) income in the US in 2014.

    I suppose we should call NVC for them to precise what they need -and to avoid another back and forth in one month? (as in the mail they ask for the W-2 and obviously won't receive it...)

    And yes, super disappointed about the lawyers... What's the point of hiring them if they can't anticipate this kind of problems!!!

    To give a little more context :

    my husband is both french and american. (His parents are american and he was born in France).

    We married 10 years ago (in France), have had 3 kids, and always lived in France.

    Last summer, a job opportunity opened up for him in the US.

    We decided to move all to the US - and had no idea it would be such a hassle!

    We started the process in september, and he's been living in the US since this January.

    When we filed the AOS, he didn't have a US contract yet. He has been working in France almost all his working life (except from 1999 till 2000, he worked 1 year in NYC).

    I know he has been doing some tax back-filling with the help of the lawyers as well, as he was not paying taxes in the US and hadn't declared income for quite a long time.

    Not sure if that helps?

    So basically what you're saying is that the missing original signature IS a valid request / that can't be challenged with the NVC, and we have to send it as soon as possible (and wait another month). No hope of negotiation?

    I'm really pissed at the lawyers then...

    The problem is that these missing elements are partially wrong :

    • The form is signed
    • The W-2form is irrelevant because my husband was not working in the US back then.

    So basically, our understanding is that we would need to resend the AOS with the original signature (because we had it sent by our lawyers,so they printed our scans of the AOS) – which means another additional month of waiting before they review the case as NVC specifies in this letter : “After you email or mail the requested information, allow us 30 days to review your response.”

    Our lawyers are trying to reach the NVC to discuss this, because they told us that in most countries (except France) the AOS is sent by email anyway…

    Producing the original AOS at the Embassy interview should be plenty. (or so our lawyers say)

    I’m trying to get additional feedback from you :

    • Did our lawyers screw up (ie we should have sent the document with the original signature)?
    • Is there a chance to open up the discussion with the NVC?

    Additionally, we received this letter from the NVC only for my file. We also have our 3 kids through the same process – and haven’t received anything (yet) on their cases…

    Would that be an additional worry (their cases are back-tracked, and we will receive similar letters with the additional month as well…)?

    Or could this be reassuring? (their cases are fine, and so should mine be, it’s a mistake from the NVC?)
