  1. He did ask for a translator. First in his native language, then in Russian which is also standard here. Other employees can and do speak in all three languages, however he got the unlucky window of an English only speaker. 

     

    We had all three years of w2s, 1040s, and transcripts. Her income alone has always been a little over the 125% line. For 2016 her income went up a lot though, and we provided her current contract through July of 2017 and year end pay stub showing her gross for 2016. The agent ignored those papers completly. 

     

    I did go ahead and ask for clarification by email as well.. waiting on the response. 

     

  2. Looking for any advice or thoughts on our situation: 

     

    My husband had the nterview today and was given a 221g requesting a new Co-Sponsor. 

    They didn't let me join him, and he doesn't speak English, so we don't know why yet and was just told send an email. 

     

    I live abroad with him, so my income 0. My mom filed the I-864 for us, her income for 2016 was $48,800. However, she filed joint taxes and her husband shows a business loss. We did not have her husband sign an I-864a because of his business's financial situation. My mothers financials and assets are completely separated. The house is solely my mothers, cars, everything. They don't even have a joint bank account, let alone any debt together.  

     

    At the interview, when asked about my step father, my husband somehow said (in broken English) that my mom is the co-sponsor not my step dad. And handed over the documents I gathered, including end of year end pay stub, updated employment contract, and a note of explanation. But the agent pulled out the 1040's, handed everything else back without even glancing over the content.

     

    This is a bit unfair in my eyes considering, there was not a translator available to him and the agent disregarded the evidence completely and focused only on 1040's of past years instead of evaluating the co-Sponsors current income. 

     

     

     

     

     

     

  3. I had the same problem while filing overseas. I did call and give my parents address, and they have my paperwork without any delays.

    Also, at the NVC when I called to get my case number and give my email address as per advice on this board, they already had it on file.

    As far as contacting them, I used a Skype phone number. Perhaps you can find a similar solution.

  4. Hello, I would like to make sure I understand what exactly is necessary for the AOS forms, can you double check me?

    My mother and I are sponsoring, she makes enough money, I do not.

    My step father does not want to file an I864A.

    I need:

    A complete i864 - signed in blue

    A letter stating why I didn't file 2015 taxes due to lack of income

    2013 & 2014 tax transcripts

    She needs:

    A complete i864 - signed in blue

    A letter from her employer stating her current position and hourly wage

    2013, 2014, 2015 tax transcripts

    Copy of her birth certificate

    Also, at the NVC stage, is everything submitted by email or mail? Can we choose?

  5. Dear Friends, please and thank you for considering my situation and any advice you can offer.

    I live abroad, so I am not required to pay taxes, and my mother will co-sponsor my husband.

    Because my step-father is having business losses, I don't want to have him file a I-864a - right?

    .

    My mothers income is much higher than her 2015 AGI, but due to my step fathers business losses, their AGI got reduced $17.1k.

    Her taxes for 2015 is showing her retirement income at $18.5k, plus another $17.3k in earned wages from her and her husband.

    Is she able to still be a co-sponser? Her current pay is $15 per hour, and is working full time.

    As I understand, please correct if I am wrong that she needs to show $25,200 because her household will be counted as 3, with herself, stepdad, and my husband.

    Other than copies of her 1040, what evidence do we need?

    I am applying from Georgia and the don't do DCF so I am just keeping my fingers crossed we move home as a family. :thumbs:

    I was just thinking if we were getting close maybe there would be a way to hurry up the NVC stage or something, but they process everything fairly quickly. Best bet is making sure everything is ready to go then and to submit as soon as possible.

    Everything at the NVC stage is done by email right? or will I need to use post? My biggest concern is that sending and getting mail here is a nightmare, and least 30 days each way.

  7. I am now preparing for the NVC stage while waiting for the NOA2.. Hopefully it will be approved soon NOA1 was March,15 2016.

    Here is my concern, my husband and I are both living abroad now, and I am registered back in the states at University for January 2017 classes.

    If I don't get back in time then I will be putting off my degree completion for an additional 12months because the 2 classes are only offered once a year.

    Will that be a legitamite reason to expedite our case? Or should I just be praying that it all goes through by then? :D

    We have a young baby together, and I don't want to be a 'single mom' through all of this. As you can imagine, it will make moving/ working/ studying a million times harder without him.

  8. Thanks guys! Your advice is so helpful as I am preparing for the NVC steps ahead of time to make sure its all correct.

    I still prefer my mother to be a joint sponsor however if it can be only one.

    Her income then for 2013 and 2015 cover the 125% line.

    For 2014 however the difference is about $3000. As I understand then, we need to have just $15k in liquid assets. Is that correct? Or do we not even need to cover it because it is not current?

  9. Just a few questions regarding the AOS which maybe you guys can clear up:

    My parents have claimed me as a dependent child the years that I have not worked and traveled abroad. This means my filing status has been single - claim 0.

    1)For 2014 though I was married in October, should we amend that tax year so that it reflects Married Filed Separate? Or is it likely to be overlooked? (There is no change in the tax benefit, any modification would be solely for the immigration process.)

    2)Should the poverty guideline then include me in the household because until recently I was included? (For 2015 I was not claimed as dependent, and I will not be in the future.)

    3)Should we use an additional co-sponsor to 'strengthen' our case even if my parents current years (2016) income surpasses the poverty guidelines? Is using assets to supplement stronger more helpful?

    In 2014 and 2015, my parents income was between the 100% and 125% lines. They have a house with net value of around $50k after the mortgage is deducted and $20k cash in the bank. My godmother also offered to co sponsor my husband and her income alone would be over the 125%.
