  1. For a returned I-130 there are only three possible outcomes:

    (i) USCIS re-affirm the petition by themselves and send it back to the NVC without any involvement from you whatsoever.

    (ii) USCIS issue a NOIR, you do nothing/your response doesn't convince them, and the petition actually does get revoked.

    (iii) USCIS issue a NOIR, your response changes their mind, and the case is re-affirmed and returns to the NVC once more.

    To answer some of your question:

    • I called USCIS and asked he status of the case since about 20 months, and I was told that their records indicate my series of inquiries made but nothing was done till it was closed on sep 13.
    • I have contacted my senator and congressman to find about the status/progress in August but none of the two office told me that my I-130 was closed. My senator office told me that the case was being transferred. The congressman said she has not hear anything from USCIS since the last time.
    • USCIS told me the case was closed on September 13, 2016. No letter received or sent according to their records
    • OMBUSMAN is not aware that the case was closed also, I contacted them in April of this year. I did not hear anything from them till early this month however, I called them to find out the status of the inquiry. I was then told that they haven't hear from USCIS office. Promising to contact the office again. That was last week, August the 22nd.

  2. The process of a returned CR/IR visa can take 12-18 months.

    In some cases a petition is re affirmed without a NOID/NOIR and send back to the embassy.

    You probably are not asking the right questions of your senator's aid/liaison.

    Be very specific in what you want them to find out, which should be:

    1. Where exactly is your case now

    2. Why has the NOID/NOIR not been send.

    Contact the Ombudsman also. https://www.dhs.gov/case-assistance

    That's it, don't overwhelm the senator's aid and expect them to solve the problem trying to expedite your case.

    Expedite for what reason ?

    I am not trying to overwhelm them. I was just trying to get the fact iabout the status of the p=petition. IThe interview was Nov 7, 2014 and the USCIS received the petition back in Feb 2015 and till this moment their has not been a letter of any kind. It just get my worried and scare.

  3. Expedite no. Your only thing left to do is contact the Ombudsman. The interview was February 2015. Then this month or next you should be hearing from USCIS. its taking about 18 months from interview. I know a few people denied January 2015 and they just got their NOIR letters in August. Have to just hang in there .

    No, the interview was Nov 2014.USCIS received back in February 2015.And I have already contacted CISomdusman about 4 months ago, nothing yet also.

  5. I would probably try the CIS Ombudsman next; it's the only real choice you have remaining.

    Thank you , One of the detail I forget to mention was that I also contacted CIS Ombus but I have not heard from them since I was toldto give them 60days which is been more than 60 day. maybe I need to contact them again to find out where things are. Thank you!

    I would try your Senator again. With the election looming, and you now knowing what exact questions to ask, they may be more helpful.

  6. Hello everyone,

    I have filed I-130 for my husband and my step daughter in 2013. It was approved in U.S.A however , returned to USCIS under 221g February 20, 2015. Since then I have not received any notice other than a transfer notice in November 5th 2015 that it was transferred to another USCIS center to expedite the processing. I have called and called, all what I being told was to give 180 days upon 180 day and 60 days upon 60 days. Still no NOIR or anything. I have involved my congress man and senator since the beginning of the returned visa . Still no progress. Does anyone have any suggestions on what I can do to expedite this or do I need to wait? If ye, how long do I need to wait?
