  1. please how long does your mother inlaw stays before approval?

    Hello Omeka

Sorry I am not following your question. Her petition was already approved and she is now in the US. However, we just moved to another city and I need to notify USCIS or NVC of the new address to ensure they mail the green card at her present/new location. I just don't know the procedure as far as changing address

  2. Hi all

My wife filed a petition for her mother (my in law) eight months ago. Everything went well and my in law just came to the States couple of days ago. However, we moved to a different city couple of weeks ago (Prior to her arrival in the states). How to go about changing old address from her petition to newer address? I am affraid USCIS mail her "Green Card" to old address where we no longer live. Please help ASAP

    Thank you in advance!!

  3. Hi All

I just paid the AOS fee yesterday for my mother-in-law's petition (My wife is the petitioner). We checked online and status on the transaction shows as "PAID". I am assuming we can now go ahead and submit AOS package. Here is what I have gathered for AOS packet. PLEASE KINDLY LET ME KNOW IF I AM MISING ANYTHING

I-864 filled out by wife since she is the petitioner and sponser

I-864a filled out by me since I am a co-sponsor

    Last three years tax transcript

copy of my US citizenship cert to prove my citizenship as a co-sponsor

Copy of my driver's license to prove my residency as a household member

    employment letter

    most recent pay stubs

Barcode cover sheet that indicates aos fee was paid

Am I missing anything ? Please kindly advise before I send AOS Package. Thanks in advance!

  4. Hello Al

I just received an email from NVC today. They provided me with a case#, invoice# and email also contained choice of agent form

I have already email NVC regarding the choice of agent. Do I go ahead and pay AOS fee since we now have the invoice number? When should I send AOS Package ? I am really confused. Please help.. Thanks in advance!

  5. Hi guys

I called NVC and was able to retrieve the NVC case number for my mother in law (My wife is the petitioner). We then had my mother in law sent DS3032 via email requesting my wife/petitioner to be choice of agent. What is our next step ? I assume we now wait until they accept DS3032 and generate AOS Bill. How will we know when AOS bill is generated ? Where do we pay AOS Bill ? I am little lost. Please kindly help

  6. You're Very Welcome!

    B

I forgot to ask you one more questions (Other members on the board are most welcome to answer and thanks in advance)

Since we filed tax Jointly, Do I need to include most recent tax year amount as well as past two tax year amount on wife's i-864 form ? Or Do I put zero on her form and show those amount on i-864a that I fill out as a cosponsor ?

  7. NOA2 dated April 9th 2012. Still awaiting on NVC case number. I called NVC yesterday and was unable to locate receipt number within 30 seconds so agent hangs up on me! I called back and was on 20+ minutes hold time as usual. I get a second agent and asked to be transferred to their supervisor. They could not locate him/her. I am frustrated with NVC. someone need to stand up and take firm action against this unit! What a mess..

  8. You need to get a CERTIFIED COPY of your birth certificate from the Registrar General's Department (here's a link to the Forms page on their website). When you're sending in your DS-230 packet to NVC, include that certified copy of your birth certificate PLUS a photocopy. If you don't already have your birth certificate, apply for as many copies as you can afford NOW. The RGD is very, very, VERY slow and inefficient!

    Island Lady

I like your timeline. Mine is six years old and completely off :) Working on a different case now!

  9. Greetings Brown Horse,

    1) Here you are not correct. If your wife filed the petition with USCIS, then she, in fact, is the primary sponsor because she started the process by filing the petition, regardless if she had a job or not. Therefore, you are NOT the sole and primary sponsor. She is the primary sponsor and you are a co-sponsor.

    2) Re: I-864 Question No.8: because of the fact I mentioned in 1) above. Here, your wife needs to check BOTH 'YES' boxes.

Re: I-864 Question No.25: While you may have prepared the tax forms and sent them yourself, it is in fact filed as a JOINT tax return and therefore you have filed a tax return together, and so, she has in fact 'filed a tax return'. No. 25 DOES apply to her as well, regardless if she had a job/income or not. So, this information needs to be provided.

Your I-864A will provide the additional proof of required financial backing (your income) that will backup and support her sponsorship for her mother.

ON A DIFFERENT MATTER: Can you please update/correct your vital information i.e. 1) you have no country listed for the immigrant 2) Your visa type shows as IR-1/CR-1 (which is a immigrant spouse of a US citizen). An immigrant visa for a parent of a US Citizen is IR-5 category. Also, be sure to keep your time-line currently updated. All the aforementioned information is important for those of us who try to give assistance to others.

Hope this information to your questions helps makes things more understandable.

    Best Wishes,

    ~Bleauwolf

    Thanks B!

You're correct. She is the sponsor and I am a household member/cosponsor. Sorry late night posting on MB threw me off. Thanks again for your help! I checked yes on both boxes and also responded to Federal Tax Question.

  10. Hello All

I am in process of filling out an I-864 form for my mother-in-law (Beneficiary)

    Here is my situration:

My wife filed a petition for her mother (my mother-in law). My wife currently does not work and do not have any income. I will be the sole/primary sponspor

My wife is filling our for I-864 and I will fill out form I-864a as soon as we 're done with wife's form

    I have a quesiton regarding my wife's i-864 form

Q#8 on the form states :

(checkbox) I am sponsoring the principal immigrant named in Part 2 above.

(checkbox) Yes or (checkbox) NO (Applicable only in cases with two joint sponsors)

Does she need to say YES or NO.. Again, she is not the sponspor and does not have any income at all. I am so lost. Please help

ALSO does she need to answer question#25 regarding federal tax return. I (husband) filed tax return jointly but she did not have any income

  12. flowchart looks great however, I have couple of questiosn regarding AOS and IV Track

    According to your flowchart

    AOS track

    nvc invoices AOS Bill

    Petitioner pays AOS bill

Send in AOS Package ? (Does NVC sends petitioner AOS package to be completed by Petitioner. Petition then sends it back to NVC ? is this correct)

same questions for IV track. I am assuming NVC sends petitioner DS-230 packet. Petitioner then completes the packet and sends it to NVC

Can we send AOS package and DS 230 package at the same time ? or does AOS must be submitted before NVC can generate IV Package?

I am not clear on these two items at all. Please help

  13. Read the guides, they'll tell you what you need. The certificates in the IV package need to be original/certified copies.

Keep in mind, if this is this is for an IR-5 visa, the IV package will also need the petitioner's birth certificate and current (and past) marriage certificates, if applicable.

Which guide are you referring to ? Can you please provide a link ? Thanks in advance

  14. Hi Ali

I am also in a same boat as you're. Petition for in-law recently got approved. NOA2 is dated 4/9/12 and its still awaiting on a case number from NVC. Per my phone conversation with NVC agent, he stated it will take upto 15 biz days before we get a case number. In the mean time, I have made a copies of my last three years tax returns, employment letter and will be finishing up I864 form pretty soon since I will be the sole sponsor

As far as documents from beneficiary is concerned, I am bit confused as to what to send to NVC. I am thinking they would need DS-230 form, copy of mother-in-law's birth cert and marriage cert. Not sure if I need to send originals or copies ? I am researching it now...

    Thanks!

  15. :bonk:

After getting shafted on the wait times for our NOA2, and finally receiving it almost 6 months later, I thought we were going to be back on track and get to follow a nice, clean time line. As it turns out, that's not the case.... We got our NOA2 on March 16, and have been calling the NVC every day since to check on the status. Nothing, nothing, and more nothing. After our "15 days" were up, they asked us to scan it in and e-mail it to them. They e-mailed back saying they would call the USCIS on our behalf to research the case...

That was over a week ago. Called again this morning, and still no record of our case. When I asked how long it usually takes to hear back from NVC Research, she said, there is no time line.

UGH! I just wish that these guys would get their s*** together. I'm just so tired of having to put our life on hold becasue of a packet of paperwork.

Sorry... I just really needed to vent.

Can not blame you at all. Some one needs to take action and put NVC/USCIS supervisor/management team to PRISON. I am sick and tired of calling them and getting different response each time. I called them last night regarding sending death certificate of my in law in order to withdraw his petition. One agents says to scan and email while other tells me to post mail only. As you stated, they need to get their act or #### together!

    Thanks all.

  16. Sorry for your loss, my sympathy to your family

I am not sure why u need to be in a haste to inform them. You will not be saved any money by doing that or gain time- not to say that is what the motive is, but do not bother yourself to compose any special letter because as much as u try to make sense or justify your actions, govt workers are just dumb.

My advise as said earlier will be to add the death certificate or let your mother in law present your hand written affidavit or whatever letter plus the death certificate when she goes for her interview.

    Remember both petitions are separate.

They sometimes process mother and child petitions separately and we have seen cases here where the minor gets interview date first and things of that nature.

Goodluck do not add this to your stress.

Thanks for the kind advise 1love. I will just write a simple letter and submit a copy of death cert as well as NOA#2.

  17. Hello all

I am in need of an urgent help here. My wife (US Citizen) recently filed petition for her parents (my in-laws). We received NOA#2 about a week ago and both petitions (Father and Mother) were approved. However, I am sad to announce my father in law has recently passed away due to medical issues. I need to withdraw his I130 petition. I called NVC but they have not yet received the file from USCIS and hence no nvc case number yet. Both petitions were recently approved so I am thinking NVC should receive the case within a week or two.

I need help writing a letter to NVC withdrawing only Father in Law's petition. I am still planning to bring my mother-in-law here.

Can some one please help me with an sample letter ? In the sample letter, do I even need to mention mother in law since she has her own receipt number? I just want to be careful and ensure NVC does not cancel/withdraw both petitions I will be sending them a copy of death cert as well as NOA#2 via certified mail. I need to do this as soon as possible. Please kindly advise. Thanks in advance

  18. Hello all

My wife (Us Citizen) filed a petition for her Monther (my in-law). We recieved NOA#2 last week. I called NVC last friday and they have not received the file from USCIS yet and thus no nvc case# at the moment. Before NVC assigns a case number, I want to get all neccessary documents ready to speed up the process

My wife is currently a housewife and does not have any income. I will be the "sole sponspor" in this case. Does my wife and I both need to fill out two seperate 864s ? or Do I need to fill out I864A since I am considered a household member ? Please kindly advise

Thanks in advance for all the help!

    Regards
